Board reviewed the Form A plan for Patrick Walsh. Motion: That we not sign the plan because lot 6 does not conform to zoning, and the strip along the property line should be identified as a stream, if it is one. (Mendes -Latham, Wellington, Macfarlaneii.n favor, Carl Nelson present but not voting) - 2 - 6. 8:00 PM - Alfred Turinese and Conley Egan came before the Board to discuss their subdivision entitled Brookside Estates. The Board was informed that a representative from the Department of Natural Resources looked over the site and he felt that the construction of the lot would not alter any wet lands. The question was that if the drain pipe came out into the wet land they would have to file under Hatch Act. The representative suggested it come to a headwall and filter down through the wet area. A letter is forth- coming from the Department to this effect. The plan will be returned next week showing the drainpipe extended beyond the last lot on both Brookside Road and Gale Lane. 7. 8:30 PM - Mt. Leslie Ferrier of the Municipal Light Dept. met with the Board to discuss the placement of utility poles within the Wayside Estates Subdivision. He presented alternative plans to the Board. Motion: To amend the cross section for Wayside Estates to set the light poles no more than 7z feet from the property line, and any poles that have already been set be moved back and that on any curves or corners the poles be moved to some position out of the line of site. (Mendes -Latham, all in favor) Motion: To set up a meeting with Mr. Ferrier to discuss the installation of electricity in future subdivisions. (Mendes -MacFarlane, all in favor) 8. 9:15 PM - Ralph Maloon came before the Board to discuss subdivision New Mansfield Estates. He noted that he put the lip in the road that was requested but neglected to change the lot line of lot 6 on the other two plans. It was noted that the Board of Health was in favor of this plan provided it is connected to the sewer, Town Planner Maurer noted that some type of restriction should be put on the plan stating where the water can come from going into that sink hole. A note should be put on the plan concerning the removal of loam and gravel, all lots will have to tie into the sewer system, locate the utility poles and also thehydrant, show in the typical cross section light, gas, telephone, man holes. It was noted that the name of the street would have to be changed. 9. Attorney i;Ernest White, Jr. came before the Board representing Carl Nelson's subdivision '(Planner Nelson excused himself from the table and did not participate ;in any discussion). Mr. White referred to the Board's letter to Mr. Nelson noting requirements. Concerning requirement number 3 he feels this is not within the authority of the Board and has not complied with number 4 either because the apartment complex is not definite and would have no significance. Town Planner Maurer advised that it was within the Board's authority to require an easement. In view of the opinion we received from Town Counsel, this is not a legally constructed Form A Plan. This is a subdivision, It was noted that lot A does not have proper frontage. Motion: To declare this a subdivision based upon the fact that Lot A does not conform and that the plan shows two proposed street ( entrances which are apparently for development of Lot A plan as presently constituted. (Mendes- no action taken) Mr. White informed the Board that he was withdrawing the application for the present and would make changes on it and refile the plan. -3- 10. A representative of Landmark Engineering came before the Board representing a subdivision plan entitled Highland Estates. He was informed that the plan would have to be re -submitted with required changes made. 11. The Board reviewed the Form A Plan of Joseph Todesco on Webb Place. Motion: That the plan be rejected based on the fact that we are creating at least two infractions of zoning and that he will have to go before the Board of Appeals and that the Town Clerk be so notified. (Mendes -Latham, all in favor) 12. Board reviewed Form A Plan of Carl Nelson on Jewell Street (Planner Nelson removed himself from the table and did not participate in any discussion.) Motion: To sign the plan for Carl Nelson (Mendes -Latham, all in favor) 13. Town Planner Maurer advised the Board of a meeting of the Citizen's Advisory Committee on Thursday evening to discuss the Comprehensive Planning Program. Mrs. Thomas will be at the meeting. 14. Motion: That we authorize the Chairman to sign the "701" contracts provided that they are approved by the Town Counsel (Mendes -Latham, all in favor) 15. Discussion was held on figuring frontage on a corner lot. 16. Planner Mendes told the Board about the Department of Public Works meeting held a few weeks ago concerning Environmental Impact of Limited Access High- ways. 17. Planner MacFarlane raised the question of the installation of the drain pipe at Magna Vista. Motion: That the Town Planner take whatever action is necessary to get the job done. (MacFarlane -Mendes, all in favor) Planner MacFarlane informed the Board about complaints directed to him concerning the Fernandes market and wondered if anything could be done to stop them from building there. He was informed that there was nothing that could be done, since the property has been properly rezoned at the 1971 Town Meeting. 18. Clerk Latham noted that a time should be set for a meeting with Mr. Ferrier. September 23 was agreed upon. It was also felt that the Chairman of the Board of Light Commissioners and/or the Town Manager should attend the meeting. 19. Chairman Wellington informed the Board of a request from the Airport Commission to show on their plan any proposed or existing subdivision in the way of their proposed extension of runways. He also informed the Board that the Commission would like to meet with them. 20. It was agreed that the Town Manager should be asked what he is going to do about the broken control box at Maple Park. 21. Motion: To adjourn (Mendes -MacFarlane, all in favor) 12:20 PM
