Board discussed the Definitive Subdivision Plan for Magna Vista 11. It was
noted that the existing streams were relocated and that the drainage ditch
was relocated to run between lots 19 and 20. It was the consensus of the
Board that the easement should be shown on the tops plan as well, as on the
lot plan. Town Planner Maurer informed the Board that in talking with Mr.
Boutas, the developer, that he does not feel that he should have to loop,;
the water back to Stearns Avenue so he is ;putting
,a gate at the end of the
subdivision for the Town to pick up from there.
It was noted that on lot
26 the bearings were not correct„-Planner,Wellington noted that he would
like to see a drainage plan with the two profiles which shows that he can
drain to the proposed area; It was noted that "vertical"was spelled incorrectly,
on the profile plan. It was noted that near lot 33 the 90 degree curve angle
was 'incorrect, and that the curve information was missing. After further
reviewing the plan ;it was noted that the 90 degree curve angle was incorrect
on 'several of the lots and that the curve information was missing in all
instances.
Motion: To send the plans to Home Developers Inc. and inform them of the
engineering errors and to let the engineer find. the errors himself.

7.
Board met with Attorney White and Mr. Alan Willis to discuss a waiver for
the; land court. Attorney white informed the Board that Mr. LaPlante would
be steeping three lots of the subdivision and that the only way he could sell
the land, with the covenant was to sell the entire subdivision so the land
court requested. a waiver of the covenant imposed. at the time of the approval
1
of the Subdivision plan. Attorney White informed the Board.that no lots could.
be developed, until all the conditions of the covenant had.been met so there
was no harm to the Toon, Chairman Mendes questioned if the three lots owned
by Mr. LaPlante would. still be covered under the covenant and Attorney White
informed him that they would- Mr. Willis informed. the Board. that the land.

would be t-ra.nsfered from Waldor Realty to Home Developers Inc. and Parcel "C"
would be transfered from Home Developers Inc. to Waldor Realty.

Motion: To sign the transfer of land plan for Home Developers lnc. and.
Waldor Realty.

9. Board_discussed.the preliminary plan for Richard Hallett for an industrial
area off of Fruit Street. It was noted. that the catch basins and the
distances between the catch basins were within regulations for a subdivision,
and that the drainage would run along by the old railroad tracks. It was
noted that there was a proposed 50 foot right-of-way for the subdivision.
It was the consensus of the Board =to -require that it be a 60 foot right-
of-way and that the dimensions should be given. It was noted that lot
11 did not have frontage on Fruit Street and would therefore become part of
the subdivision.' The subdivision would. include lots 5,6, and 11.
Planner Wellington noted.that between the plan and. the profile that the
drainage does not agree and that it should be straighted but. The plan was
returned.
10. Board discussed. the Form A Plan for Peter De Girolamo for land on Fruit
_Street. It was noted that the lot<sizes had -already been approved by the
Zoning Board of Appeals.

12. Board.discussed.the gravel removal permit for Norman Gray for land on So.
Main Street. It was noted that the stone bounds had been set and that the
proposed contours had been fabled as requested, and that the brook was shown
and the distance to Reservoir Street. It was noted that there was not 100
feet from the sideline of Route 140 to the point of excavation. It was noted
that the Board. of Appeals hearing was scheduled for December 19, 1972 and that ;
the usual restrictions for gravel permit plans required staking out the area
at 100 foot intervals. It was noted that due to the shape of the area it would
be best to require stakes at every corner, ant that these stakes be maintained. -
throughout the period ofexcavation as a`reference point for the inspecting
authoritibs. It was the consensus of theBoardthat upon completion of earth
and gravel removal operation loam should be spread. over the entire site for
a minimum depth of five (5) inches. It was noted. that the special permit could

Planning Board. I

Board of Selectmen, Board of 'Appeals, Town Manager, Too_ Counsel and
Building Inspector. -It was noted that Planner Wellington could not attend

Latham regarding the meeting.

it for proofing on Thursday, December 21, 1972 and it would have to be proof
read by Tuesday, December 26, 1972.
15.
Board discussed the Town Meeting Warrant Articles. 'It was noted that Town
Planner Maurer had met with Mr. D'Annolfo and Mr. D'Annolfo did not have the
plans ready for the Town's acceptance but, would get them from his engineer.
Town Planner Maurer suggested putting an article in for the' -,Town Meeting;„
and then if it wasn't ready for acceptance it could be omitted. TheBoard
reviewed the draft letter written by the Town Planner and requested.that
the donator be listed and that it be specified that the land will be run
by the Reacreation Committee.
16.
Board. discussed the draft letter written by; Town Planner Maurer to the
Board of Selectmen requesting a Special Toon Meeting on January 29, 1973
Toorn Planner Maurer informed the Board that Town Counsel had suggested
having two articles only - one for the by-law and one for the map. l, It
was the consensus of the Board that this was not the right may as the by-law
could then be adopted without the map. It was the consensus of the Board to
check into this further and just inform thelBoard of Selectmen that they are
requesting a Special Toon Meeting and will send them the articles for the `
warrant at a latter time.
17.
Town Planner Maurer informed. the Board that the Rotary Club has scheduled
a meeting with the Planning Board regarding the Zoning on January 16th
in the afternoon and that ;the Planning Board can meet with the Lions Club
on January 23rd. to help sell the 'zoning.
18.
Board. discussed the proposed route ,25-140 interchange. It was noted that
the road being proposed would have a "Y" interchange, and. that they would
be eliminating Route 140 at the interchange and.carrying route 25-140 to
Bay Road and. then carry Route 140 into Taunton all the may. Planner
Wellington stated that if the Dnl would check their figures they would find.
that the traffic figures they have are no longer valid and they would be
better off not to relocate Route 140 but just put slip ramps on the present
road.. It was noted that under the proposed road once you got on near
School Street you could.not get off again until Route 123 at the Norton -
Easton Line. It was noted that they would. be takin g 6 or 8 houses by
relocating Route 140. ' '
- Bonlevard> It was the of the Board to have

and give them some ideas on howMnsfield. Planning Board feels it should be.
19.Board discussed Parking in the Rear vs. Parking in the'Central-Bus iness Area.
Chairman Mendes questioned if they had received anything from the Board of
Selectmen regarding a Parking Committee. Toon Planner Maurer informed him
that they had not but in talking with Chairman Caponigro there are two traffic
engineers that will be willing to serve on the committee.- It was the consensus
of the Board to write a letter to the Board of Selectmen stating that once the
Committee is formed. that the Planning Board would. be pleased to help them in
any may they can.
20.Planner Nelson stated that he felt something should be done about the heating
conditions in the Planning; Board office and Planning Room. It was noted. that
the owner req_uested.that the Planning Board go directly to him and not to the
Board of Selectmen on heating problems. It was the consensus of the Board that-
The
hatThe Town Planner should inform the owner of the heating conditions once; again. -
21. Planner Nelson noted that, in No. Attleborough they are dropping the Garbage
Collection and having just one pickup for .both. It was noted that Mansfield
has :a new contract for garbage pickup. Town Planner Maurer informed the 'Board
that there was a representative from a Commercial Sanitary Landfill operation
and they came in to see what they could to to cut the cost of running the
landfill area. The representative was of the opinion that they 'could not cut
the cost from what it is now except by recommending that the Town eliminate
the garbage pickup. Planner Nelson felt a'letter-should.be sent to the Board
of Selectmen to see if they could eliminate garbage pickup and save the Tovm
some money. Chairman Mendes recommended waiting and he would bring in an
article from the Solid Waste Control. _I
22. Planner Nelson noted that in the article from Camp, Dresser, McKee that there
will be $18 'billion available for running sewer plants and questioned. if the
Town of Mansfield mould be eligible for some funds. It was noted that there
is :a long waiting list of Towns that are eligible and Mansfield is not on the
I
list yet but if they go Regional with Foxborough and Norton then they are
more likely, to get the funds.
23. Board discussed the letter from Waldor Realty requesting the release of
Bank Books amounting to $3';500 for the tapping of the water main on So.
Main Street and.the installation of the binder 'coat.
Motion: To release the Benjamin Franklin Savings Bank Books 43050 and

been changed at all and he felt that it should. be raised.. Town Planner'
Maurer noted that if it was raised it would become a safety hazard.
25. Board reviewed the letter from Town Counsel regarding Canoe River Acres.
It was noted. that the action taken was legal. -It was the _consensus of the
Board to see if the Town Counsel vould.orrite a letter to Mr. King pointing
out the different steps and stating that they were r; legal. If Tovm Counsel
could not write a letter then Town Planner Maurer was to draft a letter.
It was noted. that the word. "proposed." should be "existing."ground level.
26. Board. discussed.the letter from Ryan & Eliot regarding lot 45 being changed
by the land. court to lot 43. It was noted that no action was need. on this
as the land. court often changes the lot numbers and. just to attach the letter
