3. Town Planner Maurer advised that there had been no further information received
on the plan for Antosca and that the Board would have one more meeting before
this plan is up. It was suggested to send the developer a registered letter
reminding them of what they had agreed to provide with respect to more
information of where the wetlands were and a topo of the street. The plan is
for lots on Tremont Street.

4. Town Planner Maurer advised that he had spoken to Town Counsel Grady with
respect to the problem in Magna Vista. The contractor for the street is
not aware that the developers money is being attached and Town Counsel
advised that we tell him that it is. The contractor is willing to solve
part of the problem between the Marshall and Klenk property by installing
a pipe. Town Planner had contacted the company that is attaching the
developers money and suggested that they attach some other property of the
developer so that Mansfield could get the road built.
5. Board reviewed a plan for Joseph Gonsalves for 10 lots on Mill Street. The
plan had been send back because it was not tied down to any street and there
were not enough prints. These adjustments had been made. It was noted that
the radii at the entrance was part of the roadway and not part of the lot,
there was no street width shown, if he is going to close off the end of the
road it will have to be shown as a building lot, and make lot five conforming.
6. Mr. Richard Butler met with the Board to discuss the flow meter proposed at
the School Street bridge. Mr. Butler described how the system would work and
the data the Town could receive from it and that each flow meter would cost
approximately $450 plus installation costs.
7.
Clifford Turner met with the Board to discuss his preliminary subdivision
plan for lots on Ware Street. The plan was submitted under the old regulations
and was advised that the proposed 650 foot road was in excess of these
regulations, but would conform with the new regulations. He will make a
decision on whether to withdraw the plan and resubmit it under the new
regulations.
R.
Board reviewed a plan for Waldor Realty showing 40 foot curb radius for
New Mansfield Estates Subdivision off South Main Street.
Motion: To sign the plan for Waldor Realty
(Grant -Nelson, all in favor) VOTED
9,
Board discussed Home Developers subdivision off Willow Street. There is
still
the question to be resolved concerning the connection of the road through
to
New Mansfield Estates. A public hearing is scheduled for June 26 at BPM.
The design of the sewer pumping station was also discussed. Town Planner
will
meet with Mr. Millette and Mr. Boutis to discuss the details of joining
the
the two streets together.
10,
Margot Jellinek met with the Board to discuss the proposed swap of the
Mansfield Fish and Game Association land with the Town of Mansfield land.
She feelsf, that this would not be a wise move in the event that the Town
would want the`.land for recreation purposes at some future date.
Il. Board reviewed a Form A Plan for William J. Barrows for lots on Gilbert
Street. The plan will be returned for the correction of several errors:

13. Board reviewed a plan for Cabot, Cabot & Forbes for Forbes Boulevard extension.
(Clerk Grant left the room and did not participate in any discussion.)
The Board noted several points that should be adjusted prior to the formal
submission of the Definitive Plan.
1. At station 82 the median narrows down from 16 feet to 12 feet with
the center line of bhe roadway on a four foot offset. The Board is concerned
with how this will join into the 60 foot road which is proposed south of
the temporary turn around. A detail of this merger should be shown with
the submission of the Definitive Plan.
2. Definitive information should be presented to the Board concerning the
proposed method of signalization of the railroad as it crosses Forbes Boulevard.
3. The typical 80 foot section right-of-way should be adjusted to more
clearly indicate the proposed reduction in the median strip as noted in
item i above. It would be advisable to establish a second detail showing
that adjustment.
4. The curb pavement detail should be adjusted to show the base of the
granite curb covered by the 2 inch binder coarse and not sit on top of it.
The Board will require approval of the Definitive Plan prior to the installa-
tion of any required improvements. The Board will not go along with the request
that stumps be allowed to remain under the roadway. The Board is concerned
with the merger of the 80 foot road and the 60 foot road as well as the 90
degree turn under the railroad and would like to meet with Cabot, Cabot &
Forbes to discuss these points.
14. Board reviewed a plan for F. E. Bonvie for 13 lots on Ware Street.
Motion: To sign the plan for F. E. Bonvie subject to street stamp.
( Grant -Latham, all in favor) VOTED
15. Town Planner advised that Leo Wolf would like some type of decision from the
Planning Board on his apartment proposal for Tremont Street. He is making
a formal request to the Board of Appeals in the form of an application for a
hearing for amendment to the extension of time.. It was the consensus of the
Board to hold a joint meeting with the Board of Appeals to discuss this matter.
1e1. Town Planner Maurer advised that there was a joint meeting with the Norton
Planning Board on Tuesday, June 20 to discuss Oakieaf Estates Subdivision.
17. Town Planner advised that the final bonds of the Subdivision Regulations were
being adjusted by Mrs. Thomas' office and will be printed as soon as they
return. It was decided to run the forms off onstencil's.
18. Town Planner Maurer advised that Engineer Booth for Canoe River Acres has
requested that he be allowed to use aluminum pipe for the underdrain system.
it was the consensus of the Board that this would be permitted.

19. Board reviewed the Board of Appeals application of Dorothy M. O'Shea for
a variance to construct a three family dwelling in an Agriculture Zone.
Hot ion: To approve the draft letter as follows: (Latham -Grant, MacFarlane,
Zaffini in favor; Nelson opposed) VOTED
The Board recommends that this variance not be granted for the
following reasons:
1. Three family dwellings are not a permitted use in the Agriculture
Zone and it would be an unwise precedent to allow the new construc-
tion of a new three family dwelling in this Zone.
2, The long range planning for Mansfield does not envision that
three family dwellings would be a permitted use in this area.
3. The hardship as stated in the application relates to a personal
hardship of the applicant as opposed to a hardship relating to
conditions affecting the land, or one that is imposed by the
literal enforcement of the Zoning By-law.
The Board is of the opinion that if this variance were granted a
precedent would be established whereby three family dwellings could
be petitioned for in the Agriculture Zone. in both Article 16 and
Article 22 of the 1971 Town Meeting, it was voted to eliminate
three family dwellings and multi dwellings from the Agriculture
Zone. Any future change to allow additional dwellings in multi-
unit buildings in the Agriculture Zone should be subject to a vote
of Town Meeting as an amendment to the Zoning By-law, and not as
a decisionof the Board of Appeals.
20. Board discussed Court decision of Rizzo vs. Bedard et al. (Clerk Grant left
the room and did not participate in any discussion.) It was the consensus
of the Board to send Town Counsel Grady the information he requested as to
how many acres would be effected by this decision. The Board did not make
a formal recommendation concerning the appeal of this decision,
21. Clerk Grant requested that since the regulations are requesting developers
to show high water marks, that culverts and bridges could be numbered and
marked with this information. It was suggested that the Town Engineer and
Town Planner could do this.
22. Planner Nelson suggested that since Leo Wolf was willing to pay for the
sewerage to his apartments on Tremont Street that the Board should make a
recommendation to the Board of Selectmen that they give him the opportunity
to put it in. Town Planner will draft a letter for next week.
23. Planner MacFarlane questioned if the Board had ever received a plan for the
drainage at Fernandes Supermarket. He was advised that they had not.
24. Chairman Mendes requested that each member of the Board receive a copy of the
newly published Planners Handbook.
25. The warrant for the Special Town Meeting will be mailed out as soon as possible.
26, The Finance Committee will meet with the Board on Monday, June 26 at 8:30PM.

27. Chairman Mendes suggested that the Conservation Commission be advised of the
availability through the Plymouth County Cooperative Extension Service of a
speaker on the subject of Conservation Activities in Southeastern Mass.
28. Chairman Mendes advised that now that the Board had adopted new subdivision
regulations with a fee system there was no account to put the money into.
Town Counsel and Town Clerk will be advised of this.
