(Latham -Grant, all in favor) VOTED -2 - Minutes December 12, 1973 6. Board discussed the definitive, subdivision plan for Robert L. Rizzo for land on Otis Street (Clerk Grant left the room and did not participate in any discussion). The Board reviewed the December 12, 1973 memorandum from the Planning Director concerning this development and noted their concern with the low area between lots 1 and 2 and the elevation of the proposed culvert under Otis Street with respect to the brook north and south of Otis Street. It was also noted that information should be provided concerning the impact of the drainage from the development on the swamp south of Otis Street. It was further noted that the developer had not submitted the required, convenant and that the Board of Health had not taken final action on the plan and that there were three comments from department heads which should be included on the plan. Planning Director Maurer noted that all of the information was not received and that the Board could disapprove the plan but note in their disapproval where the plan does not comply to the regulations, with the understbnding that once the developer complies with the regulations, the pian would be approved. Motion: To disapprove the Definitive Subdivision Plan for Robert L Rizzo for land on Otis Street for the following reasons:., I. In accordance with Section 111 - C - 8 - Performance Guarantee of the Mansfield Subdivision Control Regulations, the required covenant or bond has not been submitted. 2. In accordance with Section ill - C -'Definitive Plan of,the Mansfield Subdivision Control Regulations and Chapter 41, Section 81U of the Massachusetts General Laws, the Board of Health has not taken definitive action on this plan because they have requested additional Information of the applicant as noted ,in a letter to the Planning Board dated November 27, 1973. 3. In accordance with Section IV - Paragraph F - Lot Drainage of the Mansfield Subdivision Control' Regula tions. insufficie;t information was shown on the definitive plan regarding the drainage from'.the low area located on the property line of lots 1 and 2. This point Is lower than the proposed street elevation, it is recommended that the developer provide an outlet from this low point for the, water to run to the street drainage system or else to fill in the low area so that the water can drain directly toward the street. This modification should be shown on the final definitive subdivision plan. 4. in accordance with Section 111 - C Mansfield Subdivision Control Regul was not submitted with respect to,i Street, therefore the following ini ai The -installation of the culvert the relationship between the in, to the elevation of the bottom and southerly side of Otis Strei elevation on Otis Street. Iefinitive Plan of the ons, sufficient information proposed culvert under Otis nation will be required: der Otis 'Street, specifically, : of the culvert in relation the 'brook on both the northerly ind with respect to; the street b. A statement ;should be received concerning, the required alternative .3 - Minutes December 12, 1973 on the brook to keep the water flowing freely. This would include showing the elevations of the center line of the brook from the outfall of the drain line southerly to the edge of the swamp. c. A statement evaluating the impact of the storm runoff of the swamp on the southerly side of Otis Street should also be presented to the Planning Board. 5. The following additional mbdlfications should be made to the definitive subdivision plan: a. The island in the middle of the cul-de-sac should be eliminated. b. The fire alarm pedestal should be located on the left side of the roadway between lots 7 and 8. c. A note should be added to the plan indicating conformance to the electrical specifications of the Mansfield Municipal Light Department. (MacFarlane•Latham, all in favor) VOTED 7. Van Cleaf Bachman of Williams Street met with the Board to discuss the effects of the Wading River Park development as presented by Millhaus Construction on his property. He noted that the property behind his house has been a pine swamp since the 1800's and is not a useless swamp which has large pine trees in it. He noted that there is a stream of about 8 feet wide flowing out of the swamp and that the proposed subdivision might create a dam across that stream. He noted that lots 40 and 24 are quite low and he Is concerned that with the filling of these lots, that water could be forced back in the direction of his house. He is also concerned that the level of the swamp might rise and, therefore, do damage to the existing vegetation. He was-advised='that the ;Board will be putting an Article in for cluster development and that the developer is interested in developing this portion of the subdivision under the cluster provision. Mr. Bachman noted that he Is considering giving the back portion of his land either to the Town or a land trust, but he does not want to give the land if the land adjacent to it is going to be developed and the swamp filled in, or if all of the houses that could go in the swamp will be crowded In another portion of the `site. 8. Board met with Percy Slayton:>df:'Cen.tral`.+Street regarding the rezoning of his property. Mr. Slayton noted that in 1973 the Planning Board proposed to rezone his property which would have half of his property In Business 8 and half in Residencel8 and he wanted to advise the Board that if they are considering rezoning the property at the next Town Meeting, that he would like to have all his paoperty zoned residence. 9. Chairman 2affini suggested contacting the Light Commissioner for removal of the light pole. It was noted that HomeDevelopers, Inc. rgquested the removal of the pole in August. 15. Board discussed the variance application for Owens-Illinois, Inc. Motion: To recommend that the variance not be granted for the following reasons: 1. The granting of the variance would derogate from .the ,original decision granted by the Board of Appeals on May 9, 1973 because it would not afford.a reasonable protection to 'the Housing Authority property as described in the original decision. 2. The Planning Board feels that the Board of Appeals would be setting an unwise precedent in amending a major decision ohly 7 months after it was granted, 3. The facts of this application do not demonstrate that the applicant has a substantial hardship if a literal interpretation of the May 9, 1973 variance is applied. (Dunn -Latham, all In favor) VOTED 16, A note was recieved few Selectmen taponigro concerning the renaming of School and -Elm Street.
