(Clerk Grant left the room and did not participate in the discussion). Planning Director Maurer reviewed the comments from the different Department Heads which had been summarized in a memorandum to the Planning Board. He also presented a plan that John Tom, from the Department of Public Works, brought in. Planner Wellington suggested that the plan from the DPW be sent back as it was the same plan presented previously. Planner Dunn noted that it appeared to be evident that they had not changed the presliminary impact statement. Motion: That a letter be sent to Mr. Vazza requesting the 13 points stated in the memorandum to the Planning Board from the Planning Director dated October 10, 1973. (Wellington -Latham, all in favor) VOTED 5. Board reviewed the memorandum regarding the Preliminary Subdivision Plan IPM Minutes October 10, 1973 for Robert Chavaree. Planner Latham noted that on Point No. 7 under Sewer Department, that ''tele -metering" should be eliminated. Board looked over the plans for Robert Chavaree and noted that the location of the buildings on the lot between lots 6 and 7 should be shown on the plan. Motion: That a letter be written to the applicant stating the points discussed in the memorandum to the Planning Board from the Planning Director dated October 10, 1973. (Wellington -Grant, all in favor) VOTED 6. Board met with Margot Jellinek regarding the rezoning of airport property. Mrs. Jellinek presented 6 copies of a Contract that the Town had made with Carleton Whitney Aero Service, Inc. dated March 25, 1959• She noted that she was presenting only 6 copies of this contract as she did not recognize Mr. Nelson as a member of the Planning Board. Motion: Not to accept the copies of the contract unless every member of the Board received one. (MacFarlane -Grant, all in favor) VOTED Mrs. Jellinek presented the Board with the copy of a plan of the airport which indicated that the runway extended into the Town of Norton. She ( also noted that she had a copy of a letter from Town Counsel, James Grady, to the Airport Commission dated October 18, 1971, which she presented to the Board. Mrs. Jellinek also noted that the airport complex was only 6,000 feet from the school buildings and that she had been told by experts that even if the airport did not accommodate jets, that small cargo planes would make more noise that jets when 'taking off. She also presented a plan from Arthur D. Little Co. showing what the airport planned to do. Mrs. Jellinek noted that she felt that if the Board wanted this request by the Airport Commission positively supported that they should have some input from the other side. 7. Board met with Kelton Potter and Ralph Maloon regarding land on Branch Street. Mr. Maloon noted that at present the land was split into two zones; the major portion of the property.is in the agricultural zone and the balance is in the Residence A zone. Mr. Potter would like to have the property re -zoned for Residence A. The property is serviced by the municipal sewer system and he feels that 15,000 square feet is an adequate lot size when the property is connected to sewer. It was noted that several of the lots would have frontage on two streets. Planner Grant suggested a revision in the street system where two loop roads would be connected by a single road through the middle. The Board asked the Planning Director to check on the proposed zoning recommendation by the Planning Board on this property. The Board asked Engineer Maloon to revise the street system in accordance with two alternatives, the first for 15,000 square foot lots and the second for 30,000 square foot lots. The Board also noted that the Back Bay Brook flows through the property and that it may have to be relocated. -3 - Minutes October 10, 1973 H. Board met with Joseph Menendes from Darby Drive. Mr. Menendes stated that when Darby Drive was finally paved, rocks were pushed onto his property. He noted that the other side of the street had been graded and finished by Bristol Equipment but that there was about'another 650 feet to be done on his side of the street starting with in front of his property. Planning Director noted that he spoke with Bristol Equipment about this and was informed that the street was on their schedule for completion this week. He also noted that ,,the ,:Town was, sti>ll.:holo ng $9,000 and that possibly the Board could tell Bristol Equipment to finish the road or the Town would contract the work out. Motion: To send a letter to Bristol Equipment requesting that they finish Darby Drive within 10 days or the Town will contract the work out. (Wellington -Dunn, all in favor) VOTED 9. Board reviewed the Massachusetts Housing Authority plan for land off Pratt Street. It was noted that the plan was submitted under the old regulations and that it was approved under the old regulations. Planning Director noted that everything would be the same except that the curbs should be granite and that the wiring should be underground. Planner Wellington suggested that the Planning Board let the Board of Health know that the Planning Board intends to advertise this for public hearing and wait for their reply. 10. Board reviewed the 1974-75 budget for the Planning Board. Planner Wellington noted that the $65 figure for Dues should have been changed to $40 as the budget was dated October 3, 1973 and a motion had been made to reduce the figure on October 3, 1973. He also noted that the footnotes were not necessary and that they should be removed. Motion: To approve the Operating Budget for the Planning Board for 1974- 75 in the amount of $2,031. (Grant -Wellington, all in favor) VOTED Planner Wellington noted noted that the footnotes could be left on the budget but that they should be re -worded so that they do not sound like a recommendation to the Planning Board. He also noted that Chairman Zaffini read the revised budget, sign it and send it along to the Town Manager. 11. Planning Director reviewed the request of bond release by Cabot, Cabot & Forbes. (Clerk Grant left the room and did not participate in any discussion). He noted that an additional bond should be posted in the amount of $2,500 on Suffolk Road to cover the final inch of bituminous concrete. Motion: To release the bonds as noted in the memorandum to the Planning Board from the Planning Director dated October 4, 1973. (Latham -Wellington, all in favor) VOTED -4 - Minutes October 10, 1973 12. Planning Director reviewed the Street Acceptance Program with the Board. He noted that although streets were voted to be accepted, they still had to be filed before they were actually accepted by the Town, and that in some instances they had not been filed. Planner Wellington suggested that the Planning Director obtain copies of pages from the Registry of Deeds of those streets that may have been accepted and work from that. 13. Board discussed the letter from Universal Engineering dated October 1, 1973 regarding the 701 study. Planning Director read the letter to the Planning Board dated June 7, 1973 from D. F. Nugent, Jr., Vice President of Universal Engineering. It was noted that the Planning Board had not accepted that letter by signing it and indicating their agreement. Clerk Grant read the letter to Mrs. Thomas from the Planning Board dated September 14, 1973. Motion: That a letter be written to Universal Engineering to the effect that with their vast experience in dealing with the DCA, that they should have recognized that there are unforeseen difficulties when dealing with federal agencies and that this is normally built into their fee structure. We would suggest that our original letter of September 14, 1973 offering to offering to accept reimbursement of $3,000 plus Universal Engineering Corp. paying the printing costs instead of the $4,500 as a compromise and we would expect payment within 10 days or we will revert to the original contract. (Wellington -Grant, all in fa w r) VOTED 14. Board reviewed application of Janice B. Barrows for a variance under Section Ili, Paragraph "A" of the Zoning By;Law to allow a room in her home at 370 Pratt Street to be used as an Insurance Agency office. Said use would be non -conforming in a Residence "A"Zone. Motion: To write a .Letter of approval to the Board of Appeals on the Application of Janice B. Barrows with the following restrictions: (1) That only the applicant and members of her immmediate family be engaged in the insurance agency Speration and;,Ehat the variance be terminated on the sale of said property to another Individual. (Wellington -Grant, all in favor) VOTED 15. Board reviewed application of Mello,: Sign Co. for a variance under Section V, Paragraph "H" of the Zoning By -Law to erect a sign six feet three inches (6'-31 by three feet six inches (3'-611) on the property of the Attleborough Savings Bank located at 71 Copeland Drive. Said sign would be larger than allowed in a Business "B" zone. Motion: To recommend that the variance not be granted to Mello- Sign Co. (Wellington -Grant, Dunn, Latham in favor, MacFarlane - opposed) VOTED 16. Planner MacFarlane noted that the reason he opposed the vote for a variance for Mello Sign Co, was because he was unaware of anyone ever making a study on sign regulations. -5- 17. Clerk Grant read a letter to the Planning Board from Yankee Builders requesting release of $3,000 regarding Minute Man Estates. Planning Director recommended the release of $2,500 because he thought there ( may be some extras in the contract which were not covered in the bond amount. Motion: To release $2,500 to Yankee Builders. (Grant -Wellington, all in favor) VOTED 18. Chairman Zaffini read the memorandum to the Town Clerk from the Planning Board regarding the Re -Zoning of Land on Otis Street from Industrial to Agricultural. (Clerk Grant left the room and did not participate in any discussion). Board signed the memorandum to the Town Clerk as voted on October 3, 1973. 19. Board reviewed the Bond Estimate for Village Estates for work that remains to be completed on the three roads within the development. It was noted that the 10% contingency would be held for one year after the completion of the roadway and that if the work was not completed within one year of the date of the posting of the bond, that the Planning Board reserve the right to review the estimate and adjust it in accordance with the increased costs of construction. Motion: To approve the bond estimate for Village Estates in the amount of $35,239.27 with the 10% contingency of $3,265.57 held by the Town for a period of one year from the date of completion of the roadway and that if the work was not completed within one year of the date of the posting of the bond, the Planning Board reserve the right to review the estimate and adjust it in accor- dance with the increased costs of construction. (Latham -Grant, all in favor) VOTED 20. Planner MacFarlane noted that he had been out to the Owens-Illinois site, and he questioned the base of the road going in. He noted that he had walked the road and that it was quite spongey. 21. Chairman Zaffini noted that he would like to be brought up to date on the meeting between the Board of Health, Town Counsel and the Planning Board, as he was unable to attend that meeting. 22. Planning Director Maurer noted that Ryan -Elliott would be coming in next week, and that the state had given them tentative approval to the retention area and they would be bringing in the new plans. 23. Planning Director noted that the Board of Health had taken action on Circle C Estates. It was noted that they would approve the plan pending all the restrictions drafted on the plan. 24. Planning Director noted that the Board of Health had not approved Highland Estates because they still had not received the information they requested from the developer. 25. Planning Director noted that last Friday he attended the Public Hearing on the new proposed shopping mail in Foxboro, and the interesting thing was the traffic. They propose to take some of CC & F's land and they estimated that 75-85% of the traffic would be coming from 1-95 and the rest would come from local traffic. They also mentioned that this project would have a minimal effect on the envoironment. 26. Meeti g ad'our d a j'10:40 P.M. Clerk /
