Mr. Roche noted that with respect to item 16 in the.letter from the Planning Board to Mr. Millette dated August 14, 1973, Town Counsel approved the agreement dated September 18, 1973 from Waldor Realty Corp. Planning Director read a portion of the agreement. Mr. Roche also noted that Town Counsel requested an authorization from the people that purchase the property also and Mr. Roche stated that he understood that that was coming. Waldor Realty Corp. had also signed a similar authorization which he read to the Board. Mr. Roche also noted that they would be willing to accept the restriction that no salt be used on the roads within the subdivision and that the restrictions of the Board of Health would be drafted on the plan as requested. Mr. Roche questioned the jurisdiction of the Board of Health to hold up the approval of the subdivision. He stated that he wondered whether it would be reasonable for the Planning Board to delay action on this plan becuase of the Board of Health. Chairman Zaffini asked about the letters from Smith and DeSantis regarding the drainage across their property. Mr. Roche noted that Mr. Maloon had approached both of the people and they were unwilling to put in writing certain things to satisfy their requirements. Mr. Roche asked the Board to waive that provision and accept the waiver dated September 26, 1973 from Waldor Realty Corp. Planner Latham pointed out that the letter from Waldor Realty Corp, dated September 26, 1973 should be corrected by deleting the word "drawn" from the letter. He thought that it was consistent with what was done with other town employees. Planning Director Maurer noted that it was town policy to pay for 1 membership and that money had been set aside for this, therefore, he should be given the same right as other individuals. Chairman Zaffini noted the bond amount for Ryan -Elliott in the Mansfield Industrial Park for electrical installation was $42,000.
