(Nelson-MacFarlane,all in favor) VOTED 5. Planning Director Maurer noted that he received a call from Brad Griffith stating that when Owens-Illinois pays Ryan -Elliott the money for the land, immediately $300,000 will be placed in an account which will be held by the Town re: Mansfield Industrial Park Realty Trust. Owens-Illinois would like the Planning Board to notify them by letter when Ryan -Elliott requests release of the bond and when we release it. Discussion followed and it was noted that if the matter of the letter was important enough to Owens-Illinois to hold up the passing of papers due to take place September 20, then Owens-Illinois could come in and explain why. It was further noted that Owens-Illinois should be made aware of the fact that the release of securities was a matter of public record and simething they could check at any time. Motion: To send a letter to Ryan -Elliott explaining it is the policy of the Planning Board not to send a letter of release to anyone other than the applicant as is the usual procedure. (Grant -Dunn, all in favor) VOTED 6. Planning Director noted that Mr. Millette probably would not be at the meeting tonight as scheduled re: Circle C Estates because he still had to go before the Board of Health. He also noted that Mr. Millette stated that he went to the Registry of Deeds and that the plan for lot lA was recorded in May, 1973 in Plan Book 139, page 44. In a conversation with Neil Roche, he told the Planning Director that he has prepared a description for the corner lot and how it will come back to the -3 - Minutes September 19, 1973 road. He also stated that he would like Town Counsel, Jim Grady, to see it before the Planning Board. The Planning Director told him he thought the Board should see it first, but felt that Roche would probably take it directly to Grady. Attorney Roche also noted that he would provide the Board with a covenant sometime next week. In a conversation with Ralph Maloon, he noted to the Planning Director that he was in the process of obtaining a letter from Smith and DeSantis regarding the drainage across their property. Planning Director noted that he had met with the Recreation Commission on Tuesday night and that they were not interested in acquiring any land in this subdivision but would like to be kept aware of any other subdivisions. Planning Director noted that he spoke with Mr. Armel, representing Margot Jellinek, concerning the proximity of the drainage ditch outfall at the stream by the, well. It was noted that on the plan the outfall goes into the stream and it is about 1200 feet from the well. ,The question raised was how close did the stream come to the well. `in checking with Engineer Maloon this afternoon, he told the Planning Director that it was approximately 900 feet from the well. Armel'also noted his concern about the salt used in this subdivision and 4ts, impact on the fish hatchery in North Attleborough. 7. Planning Director noted that Mr. Santos probably would not be able to attend the meeting tonight as scheduled re: Highland Estates because he was going to meet with the Board of Health on Thursday night. He also noted that Mr. Santos still had to get a covenant signed by his client. 8. Public Hearing was held at 8:00 P.M. on the Definitive Subdivison Plan entitled Mansfield Trust. Transcript of that hearing is on file. (Clerk Grant left the room and did not participate in any discussion) 9. Planning Director noted that he still had not received any information back from the different department heads on the plans for Mansfield Trust, although he did note that he did not think there was anything major wrong with the plan and that the only department that might have anything important would be the Water Department. He also noted that the surveyor's stamp had to be added and they had to get the plan recorded and that the Planning Board had to work out a bond figure. Planner Latham asked how long the street was and the Planning Director stated it was 650 feet. Planner MacFarlane also pointed out that the street still had to be named. 10. Board reviewed the Definitive Subdivision Plan for Great Woods Development. (Clerk Grant left the room and did not participate in the discussion) Planning Director noted that he still had:: not heard from any of the different department heads yet. He also noted that he had met with 2 gentlemen from the state who told him that the state would probably take all of the 104 acres and sell what they would not need to the abutting owners regarding Route 25. It was also noted that the Planning Board has until October 28th to make a decision regarding this definitive subdivision plan and one of the appraisers from the state mentioned that if the state did not take this land before the 28th of October, then on the 29th of October they would have to have the whole parcel re -appraised. sin Minutes September 19, 1973 11. Board reviewed Form A plan for Franklin Allen for land on Ware Street. It was noted that the land was zoned industrial, although it did not indicate such on the plan. The Board agreed to send the plan back to Mr. Allen to have the abutters shown along with any buildings and the zone. 12. Board reviewed Form A plan for Alice Flint. It was agreed to hold it out until next week. 13. Board reviewed Form A plan for the Land Preservation Society of Norton, Inc. It was noted that they had complied with the Board's previous requests. Motion: To sign Form A plan for the Land Preservation Society of Norton, Inc. (Nelson -MacFarlane, all in favor) VOTED 14. it was the consensus of the Board to hold the budget until there was a full group present for discussion. 15. Planner Nelson noted that he had quite a few people ask him about the progress of subdivisions. He noted that he thought it would be a good idea if the Planning Board members could receive some kind of a progress report on a weekly basis regarding the different subdivisions. 16. Planner MacFarlane noted that the cleaning of the catch basins had been discussed at the Capital Improvement Committee meeting. His question was whether it was cheaper for the Town to buy equipment to do this work them- seltves or to con:tractA t out. It was noted that on a contract basis it would cost $3.00 per catch basin for the first year and $2.50 after that. He noted:.thdu he•thought the Town should try it on a contract basis for 1 year and then if they were not satisfied, then buy the equipment. 17. Planner Dunn noted that while driving by the Twin Oaks apartments he noticed that the water was pouring from the parking lot. Planning Director stated that people on the northerly section of Hope Street had started complaining about that and that it was being looked into. 18. Planning Director noted that a couple of weeks ago he received a request from CC & F for release of bonds for the road. (Clerk Grant left the room and did not participate in any discussion). He also noted that they were requesting that the installation of the bounds be part of the finish coat that goes on, the reason being that there is still a lot of construction going on within the area. It was also noted that on Berkshire Road they had put in as a temporary measure wood chips along the ;road. They will not finish off the grass until it is fully developed. Planning Director also pointed out that some of the bonds expire in January, 1974, so they would have to make sure that they were rewritten at that time. 19. Board discussed the letter to the Department of Community Affairs re: 701. Motion: That the letter to the Department of Community Affairs be considered a dead issue. (MacFarlane- Dunn, all in favor) VOTED 20. Planning Director stated that they would be passing on Owens-Illinois tomorrow and that he would be going to Boston with the plan as previously agreed, at which time, once'the check was received, we would release the plan. Minutes September 19, 1973 21. Planning Director noted that on Monday evening there had been a special meeting of the Board of Selectmen to discuss street reconstruction. After much discussion, Willow Street was selected for reconstruction, and it was also noted that Willow Street may be designated as a "Scenic road''. Discussion continued on street construction and it was pointed out that if the Town was not going to have street construction to the standards in the Subdivision Regulations, then the planning Board should reconsider the standards in the Subdivision Regulations. Motion: To send a letter to the Board of Selectmen regarding street construction. (MacFarlane -Grant, all in favor) VOTED 22. Meeting adjourned at 9:30 P.M. L6 Clerk Date
