(Wellington -MacFarlane, all in favor) VOTED 4. Board met with Mr. Cliffton Holman, Engineer from Landmark Engineering of New England to represent Nancy B. Skene to discuss the Definitive Subdivision Plan for Highland Estates, for land on Elm Street. It was noted that the dead-end road was only 504 feet to the end of the Cul-de-sac. Planner Nelson informed Mr. Holman that the new regulations allow up to 650 feet for a dead end road. Mr. Holman noted that the back land was wet area so they would remain at the 504 feet. Mr. Holman pointed out that they have the requirdd 120 foot frontage on ,all lots. Clerk Grant questioned if the lots were intended for single-family dwellings. Mr. Holman stated that they were. Mr. Holman stated that the conditions of a 25 ;year storm ata maximum would be no more than 2 cubic feet of run-off per second on about two acres of land. it was noted that some of the abutters names would have to be updated. It was further noted that the name of Highland Street was already being used in Mansfield so the name of the road would have to be changed. Clerk Grant noted that the 35 foot radius was not tangent at the intersection at Elm Street. Clerk Grant informed Mr. Holman that all that is required by the Planning Board is 30 foot radius. Mr. Holman stated that he would correct this to make it tangent. Mr. Holman requested a letter stating the corrections be sent to Landmark Engineering Co. of New England as well as to the applicant. 5.Board reviewed the Form A Pian for Robert L. Rizzo for land on Wayside Drive. (Clerk Grant left the room and did not partipate in any discussion.) it was noted that the Board had requested an .opinion of Town Counsel regarding the status of the utilities when the Subdivision Plan approved in 1971 is rescinded. Motion: To send a letter out dated July ii, 1973 stating that the Board refuses to sign the plan as they are waiting a letter from Town Counsel regarding the status of the utilities already installed. (Wellington -MacFarlane, all in favor) VOTED 6. Motion: In the future when they review a plan and do not want to sign -4 - Minutes July 11, 1973 it pending more detailed information from various sources that the owner/applicant be notified prior to the deadline date. (Wellington -Latham all in favor) VOTED 7. Board reviewed the Form A Plan for the Mansfield Trust for land on Forbes Boulevard. (Clerk Grant left the room and did not participate in any discussion.) It was noted that the land of lot 4C was to be conveyed to Diano. The Board signed the Form A Plan for Mansfield Trust for land on Forbes Boulevard as per their motion at the meeting of June 27, 1973. 8. Board met with Walter Millette and Ralph Maloon, Engineer, to discuss Circle "C" Estates Defintive Subdivision Plan. Mrs. Jellinek also requested to discuss the Circle "C" Estates Definitive Subdivision Plan. Engineer Malbon stated there was not much difference between the Preliminary Plan and the Definitive Plan except they were one lot less. Mrs. Jellinek requested to see the Pre- liminary Plan as well. Mrs. Jellinek questioned why the Planning Board had not signed the Preliminary Subdivision Plan. Chairman Zaffini informed her that they had requested the signature from the owner of the property on the Form B application, which they never received. All that was received was a letter from the owner of the property giving permission to process theplan. It was noted that the owner has signed the Form C application for the Definitive Subdivision Plan. Mrs. Jellinek questioned the elevation of the water hole in'the ,,rear of the subdivision. Mr. Maloon stated that it is approximately 150 feet and it a manmade. hole. Mrs. Jellinek questioned how deep the hole was. Mr. Maloon stated that it was approximately 5 feet above the level of the swamp. Mrs. Jellinek questioned the elevation of Maverick Drive. Mr <Maloonn stated that there was a hill that is a little higher than Mrs. Jellineks property, however there will be a cut in that area. They have planned a 4-1 slope. Mr. Maloon stated that the elevation at the peak of the hill was 168 feet. Mrs. Jellinek questioned the highest elevation on Morgan Road. Mr. Maloon stated that the highest elevation was out near West Street. Mrs. Jellinek stated that in the Planning Board minutes of May 1 that Mr. Millette proposes to take 17,000 yards of gravel off the site. Mr. Millette stated that before he purchased the property he had his engineer do a topographic plan to see if there was enough material in the subdivision to take care of the filling. 'Mr. Miatette, stated that he is not interested in a gravel permit or moving material out of the site, except maybe enough for a driveway someplace else in Town, but no great amount. The 17,000 yards of loam is surplus after it has all be filled, but it can be used in the subdivision, easily. Mrs. Jellinek noted that they would be sloping down at her property line and questioned if they are going to make a retaining wall so that her land would not fall. Mr. Malbort=stated that they are going to leave a 4-1 slope, which does not require any walls. Mrs. Jellinek pointed out that in the Planning Board minutes of May 1st, on page 7 it reads that the radius of 97 feet and it should be 93 feet. Mr. Millette informed Mrs. Jellinek that there is no necessity in going to court because the point of intersection has been rectified. -5 - Minutes July 11, 1973 Mr. Millette stated that he would like it to go on record ,that he is trying his hardest to answer Mrs. Jellineks questions. Mrs. Jellineks point was from the point of the lot line to the point of the PC there was a 93 foot frontage. Mrs. Jellinek objected to this and Mr. Millette in turn came over to the point of intersection and gave Mrs. Jellinek the required 120 foot frontage on lot 1. Mr. Millette pointed out that if this plan is approved they will get an easement transfentexdi and they will still have the 120 foot frontage. Clerk Grant requested the Minutes of May 1st, 1973 Page 3, Item -'17, Line 6 to read 93 feet instead of 97 feet. Planner Latham questioned the 50 foot right-of-way on the end of Maverick Drive. it was noted that this right-of-way will go with lot 20 but it is to provide access to the land of Robert Eames, 3cPlanner Latham noted that they would not have the proper frontage on lot 20 if this was done. Planning Director Maurer stated he felt it should be an easement with a note that it is an access to the land of Eames and not a right-of-way, for constant use. 9. Mr. Millette+stated that he would like to see-aboutr§ettfng the remainder of the monies being held for Pine Needle Park and Leonard Street. Mr. Maloon noted on Leonard street that they do not have the finished grade elevation on the manhole installed by the Town as it has not been raised to grade. Mr. Maloon stated that the 'as built' plans should be ready by Monday, July 16, 1973. Mr. Millette questioned if the 'as built' plans were submitted if the monies could be released without waiting for the Board to meet again in two weeks. Chairman Zaffini stated that the Board would get back to them on this matter. 10. It was the consensus of the Board to advertise for the public hearing for the Circle "C" Estates for Wednesday, August 8, 1973. 11. Board reviewed the Preliminary Subdivision Plan for Robert Rizzo for land on Otis Street. (Clerk Grant left the room and did not participate in any discussion) Board to review further at the next meeting. 12. Board reviewed the Form A Plan for the Land Preservation Society of Norton for land on Mill Street to be conveyed to them. Planning Director Maurer informed the Board that he had sent the plan back to them twice for more information such as the locus plan, zone classification, and signature block. It was noted that there was only room for one signature on the plan. it was noted that the engineering stamp did not have a number. On the application there is no plat and parcel number for the assessors. There is a discrepancy between the title on the plan and the name of the owner on the Form A appli- cation. 13. Board reviewed the letter from Bristol Equipment to Bella Construction, regarding the finishing of Leonard Street. Planning Director Maurer informed the Board that a triangle had been left unpaved because of a pole in the street. The pole has been moved but they never came back to pave it. Bella Construction just wanted to let the Planning Board know they had sent a letter out on this. - 6 - Minutes July ll, 1973 14. Planning Director Maurer informed the Board that he had spoken with Jim Sanders from Bristol Equipment about two weeks ago and he said they would be paving in about a week or sorin Magna Vista Subdivision. Planning Director Maurer informed the Board that this still has not been done, and the three residents that live on that particular:part of Darby Drive are still complaining as it has not even been graded. Planning Director Maurer informed the Board that the Town takes bids the first of every year for paving and suggested that maybe it could go towards the completion of Darby Drive. It was noted that there is a bond in the amount of $10,000 being held for this work, which is not enough to cover the costs. Planner Nelson stated that he felt the Board should tell Bristol Equipment that they are going to consider this road when they want to do other work in the Town. Planning Director Maurer suggested that they tell him that they will not permit him to do any more work within the Town until this is completed. Planner Macfarlane suggested getting an opinr,on from Town Counsel to see if this was legal. It was the consensus of the Board that a letter should be sent to Town Counsel to see if the Planning Board can prohibit Bristol Equipment from working within the Town until this road has been completed. 15. Planning Director Maurer informed the Board that they have a copy of the plan for the Recreation Area within Magna; Vista and questioned if it could be recorded without the deed as Mr. D' Annolfo has not returned the signed deed to the Town. It.was noted that it could not be recorded without a deed. Motion: To have Planning Director Maurer call Mr. D'Annolfo and see if he could send the signed deed 'back as soon as possible so that it can be recorded with the Pian at the Registry of Deeds. (Nelson -Grant, all in fgvor,)VOTED 16. Planner MacFarlane questioned the Planning Director on the trips to Easton as noted in the warrant of July 17, 1973. Planning Director Maurer informed the Board that the trips were to the Southeastern Regional School. 17. Board met with Mr. Doug King to discuss the Subdivision Plan for Canoe River Acres. Mr. King informed the Board that they are putting the drainage in and they are about 3/4 of the way done now. Mr. King stated that they are doing it in accordance with the plan and before he will pay the persons doing the work he would like a letter from the Planning Board stating that the installation would be accepted. Mr. King stated that they are putting 1 foot of stone under the drain and the water is running under the stone into the ditch and in very heavy rain it runs through the pipe. Planning Director Maurer noted in his Memorandum to the Planning Board that he suggested to the Board that-lf,.they are going to approve any of it it will be only for the portion of Canoe River Drive which is completed. Mr. King informed the Board that the lots percolation was 2 inches in six minutes. Chairman Zaffini noted that the Planning Directors memorandum suggested that they give Mr. King a letter that the drain has been installed in conformance with the Plan but that the final approval will not be given until the test holes are dug. Planner MacFarlane stated that he fce.It that the Planning Board had nothing to do with Mr. King paying his workers so his request was unnecessary. Minutes July 11, 1973 Planning Director Maurer stated that the water is flowing through the ditch but he is unable to say if it is lowering the water table. Planner Nelson suggested the possiblity+e of Planner Wellington inspecting the system. Planner Wellington stated that he wants some kind of report that shows that the water table has been lowered. Chairman Zaffini stated that the Board would discuss this and get back to Mr. King with a reply. Chairman Zaffini stated that he really could not see where the Planning Board can say that it is actually working properly and what that would actually have to do with Mr. King payingthe contractor. Mr. King stated that Planning Director Maurer had witnessed it working. Planning Director Maurer stated that it was working at the level of the water table now but he did not know-how it would be at a higher water table. Clerk Grant stated that by law the Planning Board is supposed to have a letter from the Board of Health before they can approve the plan. Planning Director Maurer pointed out that in Mr. Kings lawyers letter of April 23, 1973 that Mr. King was required to install the entire subdrain system indicated on the plan. When this sytem is installed and is shown to be working property the Definitive Subdivision Plan will be approved on the basis of the test results. Clerk Grant noted that one of the stipulations in Mr. Kings letter was that the entire system be installed-. MrtKing questioned who would be witnessing the test pits. It was noted that the holes would be dug bye, =Mr. King and witnessed by an Agent of the Planning Board. Planner Wellington stated that it should be discussed and get back to Mr. King later. 18. Planning Director Maurer informed the Board that back on the 25th of April a letter was sent to Mr. Scarpellini for a bond estimate for Oakleaf estates for work which remains to be completed in the amount of $32,807.99, on Oakleaf Drive. There was also a condition that the Mansfield Planning Board would not release any lots on the Mansfield side until the security was placed on the Norton side 6f the Subdivision. It was noted that the bond has beenreceived and it states that it is good for a period of one year. It was also inofed that a letter from the Norton Planning Board had been received stating that securities had been posted for the Noton side. Mr. Scarpellini was requesting the release of lots 8,9,10,11,12,13,14,16, 17,18,21,22,23,24,25,26,27,28,and 29. Motion: To release lots 8, 9, 10, 11, 12, 13, 14, 16, 17, 18, 21, 22, 23, 24, 25, 26, 27, 28, and 29 on Oakleaf Drive within the Oakleaf Subdivision. (Grant -Nelson, all in favor) VOTED 19. Board reviewed the proposed amendments to the Subdivision Regulations and noted the following: Chairman Zaffini-On page 8, item i. -noted that it calls for Water bodies and their elevations shall be shown with the date of mearsurement, and noted that the dates had not been on several of the plans submitted. Chairman Zaffini-On page 12, item n - to omit and/or sewage disposal system at it is part of the Board of Health requirements. Chairman Zaffini-On-::page-13, item p - it was noted that the location of trees, --larger than 6 inches in diameter for the trunkicwas not being shown on the plans as required. Minutes July 11, 1973 Clerk Grant -On Page 13- Total areas chart -what is that actually for? The Board to consider if it is necessary. Planning Director Maurer -Page 10 -item b- questioned if the time allowed for the construction of the Roadways would conflict with the changing of the bond figures after a one year period. 20. Board discussed the request of Douglas A. King for a letter stating that the drainage had been installed properly on Canoe River Drive. Planner Wellington stated that he felt his attorney's letter noted that he will complete the entire system, and felt the Board should quote his own letter that the Board will not consider the system complete until the test holes are dug. Planning Director Maurer informed the Board that Mr. King had asked him in the field if he could install the water line and the Board noted that if he did he would be doing it at his own risk and the Water Department could not inspect it until the plan was approved. It was noted that percolation tests had been dug on each lot but the results have not been received from the Board of Health. Motion: To send a letter to Mr. King stating that what has been installed has been installed properly and "the proper functioning of the sub -drain system will be determined on the basis of test holes to be dug on each lot in the subdivision." after the system has been installed in its entirety. (Wellington -MacFarlane, all in favor) VOTED 21. Board reviewed the Board of Appeals notice of a hearing on the application' of Francis Porter for a Variance to extend the store front on So. Main Street by enclosing the porch. Motion: To recommend to the Board of Appeals that the variance on the the application of Francis Porter be granted. (Nelson -Grant, all in favor) VOTED 22. Board reviewed the letter from the MilfordPlanning Board, Town Planner, requesting information regarding the Comprehensive Plan for the Town of Mansfield. Motion: To have Planning Director Maurer send the requested information to the Milford Town Planner at no charge. (Latham -Grant, all in favor) VOTED 23. Board discussed the request of Mr. Millette for the release of the i remaining bonds for Pine Needle Park and Leonard Street. " +, Motion: Not to take any action on the releasing of the remaining bonds for Pine Needle Park and Leonard Street until the "as built" plans have been submitted. (Wellington -MacFarlane, all in favor) VOTED Z4. :Planner MacFarlane noted that at the Town Meeting it was voted that there would be no funds for the Maple Park and the selectmen are running the Maple f Park anyway and questioned if this was legal. Chairman Zaffini noted that it was being run by the Recreation Commission with their own funds and according to the Finance Committee if the funds run out and they come back for more money it will not be appropriated. Minutes July 11, 1973 25. Planner Dunn questioned if there was money in the budget for refurbishing the microfilm account. =:Planning Director Maurer noted that the money in the account was for a microfilm reader. -printer and that all of the microfilm is labeled as to what they are and the condition they are in. Most of them are in fair to poor condition and felt that it was the quality ;of the film and not the fact of them getting wet. Planner Dunn questioned if the Board should be thinking of this as a Capital Improvement. Planner Nelson noted that they had originally plannd& to have a reader -printer in the assessors office so that people could buy copies of plans. 26. Chairman Zaffini noted that on Leonard Street, where the new sidewalk joins with the old one, that there is a steep slope and questbned if anything could be done as it may be a hazard. It was noted that there has been no problem for bikes, carriages and ped6strsians. 27. Clerk Grant lnfoerinii the Board that there would be a Capital Improvement Committee Meeti,.ngie on Thursday, July 12, 1973, and that anyone was welcome to attend. 28. Clerk Grant noted that on the Public Law Memos it states that the Planning Board shoUld not sign the plans for a subdivision unless the covenant or bond is placed on them. Clerk Grant also noted that the Planning Board is not supposed to sign a plan until the Board of Health signs it first. Planning Director Maurer stated that they have an agreement with the Board of Health on this and if it is on public sewer it has 45 days to take action. When it is not on public sewer they have no time limit but they know the Planning Board has a timelimit and will have approval or disapproval before the Planning Board time expires. 29. Planning Director Maurer informed the Board that he spoke with Mr. Rizzo regarding his Form A Plan on WaysiderDrive. Mr. Rizzo informed Planning;Dlrector that he does not wish to rescind his subdivision plan signed in 1971, and if the Planning Board requests it, he will give them an extension of time for signing the,Form A Plan, or he would withdraw the plan. Mr. Rizzo Informed the Planning Director that he would make easements for the utilities and the drainage line that is already installed. Town Counsel has informed the Planning Director that if they are going to rescind the subdivision plan it should be done with conditions which Mr. Rizzo has to agree to, such as the Town not being responsible for the water line and drainage. Mr. Rizzo informed the Planning Director that he is not certain if he wants to go in with apartments or put in duplexes. It was the consensus of the Board to still send a letter to Mr. Rizzo stating that the Booed refuses to sign the Form A plan as they are waiting a letter from Town Counsel regarding the status of the utilities already installed. 30.Clerk Grant questioned if the Memorandum to the Citizens of Mansfield from the Town Clerk regarding the Zoning Amendments had been posted in five public places as required. Planning Director Maurer informed the Board that it had been posted in the five public places as required. 31.Planning Director Maurer informed the Board that at 4;00 P.M. on July 11, 1973 Ryan and Elliott submitted the Definitive Subdivision Plan for Mansfield Industrial Park Realty Trust, along with a check for $525.40. It was noted that they had sent several letters along with the submission. One letter stated that they will require a drainage easement across the conservation land. Another letter stated that the Mansfield Industrial Park Realty Trust will not hold the Town responsible for the switch gear and the tracks for the railroad across Francis Avenue. The last letter concerned the land owned by the Town of Mansfield for the required right-of-way, which would depend upon 2/3 votes at Town Meeting. - 10 - Minutes July 11, 1973 Planning Director Maurer questioned if the Board would like to have it advertised for public hearing on August 8, 1973. It was the consensus of the Board that it should not be advertised until after the Board reviewed the plans at the next meeting. 32.Planner Nelson noted that in the Cabot, Cabot and Forbes Industrial Park, they are paving on Forbes Boulevard and at the intersecition of Forbes Boulevard and the Railroad tracks and the island they have left sharp corners and questioned if this could be rounded out as they have done in other instances. 33.Planner Wellington stated that he would like to make a suggestion ,that at future meetings that from the first Interruption from outsiders the Board should hold an executive meeting to get their work done. Planner Wellington stated that he was not going to sit on this Board any longer w1th the amount of interruptions from those present unless they are recognized. He further stated that the first time someone from the audience opens their mouth he - is leaving. 34.Meeting ourne at: 11:0 P.M. s7't C Clerk Date
