4. Planning Director Maurer informed the Board that Ryan and Elliott, through
the office of H.W. Moore Associates put a boring machine in the area of the
proposed retention area, and they hit ledge. In order to design the retention
area they will have to drop it back and go on to the land of Owens-Illinois.
The design they presented at the Conservation Commission hearing is almost
what was, suggested but it was designed fora 25 year storm instead of a 100
year storm. Under the new proposal they will bring a pipe of 24 inches into
the skating pond and then go out of the skating pond with a 36 inch pipe.
There was question raised at the Hatch Act hearing as to the owner of the
land of the Conservation commission and questioned if they had the right
to let Ryan and Elliott cross conservation property. It was voted several
years ago at Town Meeting to transfer the control of the land from the
Board of Selectmen to the Conservation Commission but it was never transferred
in the form of ardeed. All that was recorded in the registry was a copy of
- the vote taken in 1966.
it was the opinion of Town Counsel that it would have to go through Town
Meeting for them to be able to cross conservation land. It was noted by
the Planning Director that this years commission may allow Ryan and Elliot
to 'cross the conservation property but next years commission may forbid it.
Plannind Director Maurer pointed out that Owens-Illinois will require an
easement which can only be obtained by 2/3 vote at Town Meeting.
Planning Director Maurer informed the Board he had net with Charlie Frances
and Lou Guerriere from Ryan and Elliott and Mr. Guerriere pointed out that
they are having a 'problem acquiring the '26 feet of Horner Waldorf property
to give rthem the proper radii at Maple Street as this land was to be transferred
to Mansfield Industrial Finance Authority and it was deeded to the Town of
Mansfield instead. They only way they can transfer the property back is through
a Town Meeting Vote. They are requesting that they show the radius on the plan
with a note that it will be up to Town Meeting action to give the property the
proper rounding. Question was raised by the Board that it was possible that
the Town Meeting vote would not go through and how would they get the rounding.
5. Board reviewed the Preliminary Subdivision Plan for Donald Ploof, and noted the
following:
1) it was noted that the center line of the roadway had been added as requested.
2) The profile of the streets had been labelled as requested.
3) The catch basins were shown near Station #2 as requested.
4 The catch basins were ;'shown "h0l' the radius of lot #7.
Clerk Grant noted that the catchbasins should be 7 feet from the center of the
road and paralell. Therefore, the catchbasins should be pulled back.
5) The existing drain easement is shown on the plan as requested.
6) The existing buildings are shown as requested.
it was noted that several of the buildings were located to close to the property

lines and conditions will have to be placed on the plan that either the
buildings'be,taken down or the lot lines changed.
Clerk Grant noted that there should be a leveling area and Planner Wellington
noted that it Was a dead-end road and they were therefore in conformance with
the Subdivision Regulations, it was 'noted that the time limit for the
Preliminary Plan was up on the 3rd of July.
Motion: To give tentative approval of the preliminary plan subject to the
following conditions:
F
1) That the storm drain°:system be designed to have the drain lines
running seven (7) feet off the center of the road. There are
several instances on the Preliminary Plan where this does not occur.
2) That the buildings shown on the Plan be labeled as to which ones
will remain. All buildings that will remain shall be required to
have proper setback in conformance with the Zoning Bylaw.
3) That the profile be corrected to show proper vertical curves on
Road B.
4) That the grade coming off of Road B on to Road A should have a
fifty (50) foot vertical curve.
(Grant -MacFarlane, ail in favor) VOTED
6. Board met with Mr. Edward Stivaletta and his attorney John Morley to discuss
the bond estimate for Elmwood Park. Mr. Stivaletta requested a bond estimate
for Bonney Lane up to Erick Road which would create a 775 foot dead end road.
It was noted that it is the Board's policy not to allow a dead end road in
excess of 500 feet, as there is no guarantee that the remainder of the develop-
ment will be completed.
It was noted that a simillar situation had occured on lot 9 in Elmwood Park
which brought the road length to 700 feet but the Board had allowed this because
the driveway looped back to the required 500 feet. Mr, Morley stated that
they would like a waiver of having to bond Erick Road as well as Mr. Stivaletta
was unable to obtain the funds for the complete road, which would amount to
$50,000. He was able to obtain the required $9,000 to finish Bonney Lane.
It was noted that there Is a loop situation on all lots so there is no
absolute dead end.
It was noted that the bond has already been released for the first 700 feet
of road, but the road has not been accepted by the Town and will not be
recommended for acceptance until the entire road is completed for a period of
one year.
Mr. Stivaletta stated that he would like ,to=complete Bonney Lane and then start
Erick Road from the back of the property so as to keep the project clean. I
The Board informed Mr. Stivaletta that bank books could be placed as security
f instead of a bond and as different aspects of the work is =coipg]Vtbdthatamount
would be released. Mr. Morley stated that they could raise the 59,000 for Bonney
Lane but they could not get the amount required for Erick Lane as well.
Chairman Zaffini informed them that the Board would discuss this and get back
to them at a later date.

Planning Director Maurer stated that it is his understanding that the Board of
Health will not sign the plan until the hearingis held to rescind the subdivision.
Planning Director Maurer suggested the Board add a note to the plan for the
following conditions: (1) That the old subdivision was wiped out and (2) since
he already has utilities installed on parts of the 'parcel that the Town will not
be held responsible for these unused utilities.
It was noted that there Is a change in configuration on lot 1151. It was noted
that the Board had requested that other condiminium plans be metered for water
at the street and it should be done in this instance to be consistent, as it is
not a public street. Planning Director Maurer to check with Town Counsel on
the status of the utilities already ilnstalledia
10. Board reviewed the Definitive Subdivision Plan for Highland Estates. It was
noted he had submitted a check of $141.00 for the fee, along with all proper
certificates and application. Also submitted rainfall and run-off information
and a summary of the land and how it is to be dlvted,up - easements, roadways, lots
It was questioned if the applicant would still be under the three year protection
for zoning as the lots are so large that they may be considering putting in
duplexes or small apartments. it was noted that the drainage was being carried
out to Elm Street and that there was a swamp in the back of lot 5, which is
lower than the road.
It was noted that the Form A Plan was signed in 1970 and question was still
raised as to the possibility of construction of apartments. Planning Director
Maurer pointed Out that it was filed in conformance with the new Regulations
and that there is a note on the plan that it is revised to meet Planning Board
Requirements of September 24, 1971.
it was noted that the proper abutters should be shown on the plan. Planning
Director Maurer to review minutes of 1970 and find out when the Form A plan
was actually signed by the Planning Board. it was the consensus of the Board
to have the engineer for Highland Estates meet with the Planning Board to discuss
the Plan on July i1, 1973. Clerk Grant noted that the street name will not be
accepted as there is already a Highland Road. Planning Director Maurer to
advertise the public hearing for Highland Estates on July 25, 1973.
il.Board reviewed the Plan for Cabot, Cabot and Forbes to deed lot 4C to
Diano. (Clerk Grant left;:the room and did not participate in any discussion.)

12. Planning Director Maurer pointed out that on the Street Reconstruction and
Improvement Program the letter to the Board of Selectmen said that the
Planning Board would come up with a Program and forward it to them and questioned
If the Program sent out to the Planning Board last week was acceptable to them,
to be forwarddd to the Selectmen.
Chairman Zaffini noted that in the meeting with the Selectmen he asked them
If they were considering reconstructing some streets and if they would put the
utilities in and their answer was they were thinking about it.
Planning Director Maurer stated that he felt the Caplt31"'improvement Program
was doing some good as to seeing that the projects are being carried out. The
Capital improvement Program will be sending out a list of a detailed summary

Clerk Grant questioned who has the priority of what needs to be done for
Street reconstruction the Planning Board or the Capital Improvement'Committee,
the Finance Committee or the Board of Selectmen. Planning Director Maurer
stated that all they will be saying to the..Board of Selectmen is that they
are going to consider the different streets and make a recommendation to them.
Clerk Grant stated that it should be sent out to the Capital Improvement
Committee. Planner MacFarlane stated that before they put slot of time and
effort into it they should have an agreement with the Selectmen and Finance
Committee before they through it down the drain.
It was the consensus of the Board to send a copy of the draft proposal for
the Street Reconstruction and improvement Program to the Board of Selectmen
and the Finance Committee, -and hold a joint meeting to discuss the proposal.
13.Board reviewed the Bond Estimate for Elmwood Park. It was noted that the only
problem they have had with "Edward Stivaletta was with drainage and that he is
going to dredge the brook from one swamp to the other and it should be straightened
out. Clerk Grant questioned the water pressure in that area. it was noted that
there was an informal agreement with R'gt.e ,C,amp, clnd>E; tiSti-v&Let.tat,ha oou:ld,bu.ild4
