6. Board met with Mr. Walter Millette and Mr. David Millette concerning the
preliminary plan for the Circle "C" stables Park. It was noted that the
Board did not grant tentative approval because the signature of the record
owner was not on the 'Form B application. 'Mr. Walter Millette noted that .
he had a letter from the record owner. The Board stated that this was not
enough that they would need his signature on the Form B application. Mr.
Walter Millette agreed to have the record owner sign the Form B application.
Mr. Millette informed the Board that he is going to obtain an easement from
Boro Sand and Stone, Inc, and have the drainage pitch towards the Bungay Lake.
The Planning Board stated that the drainage should be straightened out on the
preliminary plan rather than making changes on the definitive plan.
Board noted that they would like to see the drain line brought out to West
Street so that puddling conditions would not occur on the street entrances.
Mr. Walter Millette agreed to have his engineer take elevations on West
Street to determine how much closer the catchbasins would have to go near
West Street.
Mr. Walter Millette noted that there exists 14,000 cubic yards of excess
material on the site that would be graded to the northwest side of the site.
He 'noted that he would like to transplant the trees on the edge of the site
tovarious locations on the site. :Mr. Walter Millette questioned the Towns
policy on the installation of underground facilities and it was noted that
the Planning Board requires the installation of electrical facilities under-
ground and this has to be worked out with the Light Department.
Mr. Millette requested to meet with the Planning Board on Tuesday, May 8,
1973. An appointment was set up for 8:00 P.M.
7. Mrs. Jellinek questioned the legal status of a Form A lot on West Street.
(Planner Latham left the meeting at this, point as he felt Mrs. Jellineks
addressing the Board was an improper interruption of the proceeding of
the meeting.) Mrs. Jellinek was advised that the lot was proper because
it had proper frontage when the tangency of 27 feet is added to the radius
of 9 feet and it has the required frontage of 120 feet, which is the
required lot frontage in the Agriculture Zone.
8. Planning Board met with the members of the Conservation Commission, which
includes Charles Meszoely, Debbie Button, Carlton Mason, Walter Nelson,
Paul Boyden, and Stewart Sweet. The Conservation Commission presented a
memorandum from the Chairman including the conditions of approval which the
Conservation Commission would require of Ryan and Elliot. The general condi-
tions of the Conservation Commission is that they do not want the water from
the Ryan and Elliot Industrid Park to flow into the pond system on the Con-
servation Land.

- Planning Director Maurer presented a recommendtion concerning the drainage
with a retention system. One retention areaon the Ryan and Elliot property
and the expansion of the skating pond on the Conservation property. The size
of the retention area was not rioted because more definitive information is
necessary. The design of the system, as suggested, would have a retention
area on the Ryan and Elliot property with an overflow through a pipe to the
skating pond with a skating pond overflow through a pipe to the swamp adjacent
to the Canoe River. Planning Director Maurer recommended that Ryan and Elliot
only be allowed to cross the Conservation Commission property at one point,
to eliminate the amount of disturbance to the Conservation land.
Charles Meszoely objected to the Planning Directors suggestion because of
the possibility of running polluting water to the conservation pond. Planner
Nelson stated that he felt that the system should be designed in the best
interest of the Town and the Town should tell ;Ryan and Elliot what they want.
He felt that a pipe from =therretention area be of a certain size and located
at the bottom of the pond. The pond would drain out at the natural level
through a pipe at the top of the pond and overflow should be allowed to have
theyopporunity to leach back into the ground, If at all possible, and the
water could leach into the ground at the proposed Ryan andElliot retention
area as well as the retention areato be developed at the skating pond.
Planning Director Maurer noted that lf.there are pollutants in the water this
system would provide for the elimination of pollutants into the ground and
avoid them getting into the Canoe River. There would be three points to the
retention system, 1) Ryan:and Elliot retention area, 2) skating pond =N•::-., .:„
area, 3) swamp before the Canoe River.
Planner Nelson stated that they should hire an engineer to prepare a design
criteria for the system. Planning Director Maurer suggested that he prepare
a recommendation to be sent to the Conservation Commission and the Planning
Board on Friday indicating the position of the Planning Board and the Con-
servation Commission and that the two Boards meet next Tuesday, May 8, 1973
and come up with a final position for Ryan and Elliot. It was the consensus
of'both"BoafBs'that this procedure should be followed. The decision for
hiring an engineer will be made at the next meeting.
9. Planning Director Maurer presented a memorandum to the Board on the Wading
River Condominiums. The Board decided to review the material and make
their formal recommendationat the next meeting. Planning Director Maurer
to draft a formal recommendation for their consideration prior to the
meeting on May 8, 1973.
10. Board reviewed the Form A Plan for Betty Tintindo for land on East Street.
Motion: To sign the Form A Plan for Betty Tintindo for land on East Stteet.
(MacFarlane -Grant, all in favor) VOTED
11. Board reviewed the Form A Plan for Frederick Vallett for land on Union Street.
It was noted that the land is not on Union Street but on Union Street Exten-
sion. The plan will be returned for this correction.
12. Board reviewed the request for Robert Rizzo for the rezoning of a parcel of
land on Otis Street. (Clerk Grant left the room and did not participate in
any discussion.) Planning Director Maurer to prepare the draft for the
Board's consideration at the meeting on May 8, 1973.

school projectlon:Jigures and questioned how much time the planning
Director had spent on this. Planning Director Maurer stated that the
figures were avai;labte in the office and Mr. Avery had reviewed them
in the office and his projections for school enrollment and population
were not the same as the Planning Directors but slightly lower.
15. Planner MacFarlane stated that he would like to witness percolation tests
has he noted several lots on Branch Street and wondered how they could
get percolation with so much water surrounding the property.
16. Planner Zaffini noted that he read in the paper that Planning Director
Maurer had met behind closed doors to discuss Owens-Illinois with the
Board of Selectmen -and wondered what the reason was for executive discussion
and what was discussed. Planning Director Maurer pointed out that he had
been asked to meet with the ,Board and right after they met the meeting was
closed to the public. They met to discuss concern for the Owen -Illinois
project and statements which the Planning Director had made at the Board
of Appeals hearing concerning the restriction and the drainagewhich had
been discussed by the Planning Board.

Town Managers letter and copies of the letter will be forwarded to the
