Planner Latham informed the Board that the Regional Sewer Study Committee would be meeting on April 18, 1973 in Foxborough to review the final report before printing. It was noted that the Planning Board would be receiving a copy of the report. Planner:.Latham pointed out that it has been accepted by the State but he did not know the opinion of Anderson -Nichols. 5. Board reviewed the statement for services rendered from Boston Survey Consultants for the setting of stone bounds in the Magna Vista Recreation Area. Planner Nelson questioned if Mr. D'Annolfo was aware of the amount of the bill. Town Planner Maurer stated that he was not becuase the original figure quoted was a not to exceed figure of $500.00. it was the consensus of the Board to return the bill to Boston Survey Consultants and have them adjust the bill to the not to exceed figure of $500.00. Planner Nelson questioned if they had run into some kind of problem in setting the bounds. Town Planner Maurer noted that they had to do more cutting than was anticipated. 6. Board reviewed the minutes of March 20, 1973 and noted the following change: Page 6 the last paragraph to read - "Chairman Flynn stated that the State approval is only required if it is more than 2,000 gallons per day." Motion: To approve the warrant of March 27, 1973 in the amount of $53.00 (MacFarlane -Nelson, all in favor) VOTED - Clerk Grant not present 8. Board met with Mrs. Margot Jellinek to discuss the Form A plan and the Preliminary Subdivision Plan for Waldor Realty on West Street. Mrs. Jellinek pointed out that the deed from Globe Financing to Waldor Realty was only for five parcels of land and that ,parcel 6, which was the land to be subdivlded'ewas still owned by Globe Financing Co., and therefore the Planning Board could not sign the Plan for Waldor Realty. Planner Wellington pointed out that the deed had been drawn up before the final signing of the Form A Plan by the Planning Board and that it was the Planning Board who added the number 6 to the parcel in the rear so that they could distinquish it as "not a buildable lot". Mrs. Jellinek stated that legally the Planning Board could not sign the Preliminary Plan. Town Planner Maurer to inform Waldor Realty to draw up a new deed to include parcel 6 as outlined by the Board. The Board informed Mrs. Jellinek that she had brought it to their attention and they would look into it before the plan is signed. An abutter to the Preliminary Subdivision of Waldor Realty pointed out that the land is extremely wet in the rear of the parcel and that they had put gravel and rocks in the brook.to stop the brook. The Board pointed out that there would be a public hearing on this parcel before the Definitive Plan was signed. -3 - Minutes March 27, 1973 r.°I 9. Public Hearing was held at 8:00 P.M. for Village Estates on -Srs Street. Transcript of that hearing is on file. 10. Board reviewed the letter from Town Counsel regarding the Great Woods Development. Motion: To write to Mr. Vazza of Vazza Properties, Inc, and inform him that it is Town Counsels opinion that the 1968 Approval Not Required Plan had the legal affect of cancelling out the 1962 approval and the March 12, 1973 Approval Not Required Plan is really a new subdivision and should be acted on as such. (Wellington-Zaffini, MacFarlane, Nelson, Latham in favor Grant abstained) VOTED 11. It was the consensus of the Board to have Town Planner Maurer send a letter to the Easton Planning Board stating that the Board is tied up with Town Meeting and would be able to meet with them on a Tuesday night to discuss the Oakhill Subdivision Preliminary Plan. 12. Board reviewed the Form A Plan for Donald Pioof for land on Gilbert Street. PlannI4 Wellington noted that there were three bearings that were incorrect. Motion: To return the Form A Plan to Donald Ploof for land on Gilbert Street to have the three bearings corrected. (Grant®Zaffini-all in favor) VOTED 13• Board met with the Conservation Commission and Mr. Charles Francis and Engineer Lou Guerriere to discuss the Preliminary Plan for Mansfield Industrial Park Realty Trust. Mr. Francis pointed out that the plan was being resubmitted based on the response to the Planning Boards letter of March 15, 1973. It was noted that the 12 inch water line was looped back to Maple Street as requested and that the corner radii for the street entrance was 30 feet as ,requested. The road would be only 40 feet wide instead of 60 feet. It was noted that the railroad tracks had been re- located to the proper location with the switch off to the side. Mr. Francis stated that they had not shown any drainage on this plan because they would like the opinion of the Planning Board and the Conservation Commission before making any final decisions. It was noted that the water is presently running into the Maple Park Swimming area. Mr. Francis pointed out thatwhen the land of Horner Waldorf was sold they put in a ditch that followed behind Horner Waldorf and along the existing railroad and into a retention area. He pointed out that therein a berm that just allowed the water to go across Copeland Road. Mr. Francis requested some input from the Planning Board and the Conservation Commission as to how to handle the water problem. Town Planner Maurer pointed out that the letter of March 15, 1973 mentioned an alternative of going into the pond north of the swimming area and that it has since been discussed and it is not considered to be acceptable. It was considered that they could possibly dump into the pond south of the swimming area known as"C" Pond. Mr. Francis stated that he did not believe the retension area was full during the rain which was within the past few days. Planner Zaffini pointed out that he and Planner Wellington had walked the area during the time of the rain and ®4_ Minutes March 27, 1973 it was over flowing with an oil scum on the water going down into the ditch and it crosses the road and into the swimming,,area. Commissioner Button questioned exactly how much water would be going into the pond. Engineer Guerriere stated that they had not come up with the figures as it would be based on the size of the buildings going on the two lots. Commissioner Jones stated that they would not be allowed to dump on the Conservation Land into the pond "C" as it would pollute the area. Engineer Guerriere stated that they could possibly put a larger retension area with a dam to keep the water from crossing Copeland Road. Engineer Guerrier stated that the "A" pond, north of theswimming pond, was too deep for them to gettinto. Planner Zaffini pointed out that the water department superintendent, Bill Cahoon, had advised them not to let them dump into the "A" pond. Mr. Francis stated that he was considering putting berms further along the retension area. Engineer Guerrier stated that the water would back up if this was done. Planner Wellington stated that the water presently backs up as far as the curve in the railroad tracks. Engineer Guerrier questioned if the water went in south of the well site into the Canoe River if this was acceptable. It was pointed out to him t that the Town will be digging for water south of this area for future sites and that the Towns of Norton and Easton get there water from the Canoe River. It was noted that the retention area on the land now is only about 2,000 square feet. Commissioner Jones questioned if there was any way they could trap the water on their own land. Engineer Guerrier stated that theycould dam the water near Copeland Road. Commissioner Jones stated that at least it would have a chance to filter before it went into the ponds if it was done this way. Town Planner Maurer pointed out that this would not be a permanent solution to the problem and that this was the time to find the permanent solution before construction began. Commissioner Jones questioned how many acres of land was in the Industrial Park. Mr. Francis stated that it was approximately 150 acres. Commissioner Jones stated that they would then have to find an area to handle the drainage for 150 acres. It was pointed out that 130 acres drains in the direction of the Maple Park and the other property drains to another area. Commissioner Jones stated that the Town thinks alot of the Maple Park area and to pollute it would not be right. He pointed out that there would soon be a plan with 50 or 60 acres of land to be made into a recreation area and the rest of the land would remain natural land. Engineer Guerrier stated that they are on the high side of the water area dnd they do not own all the way to the river so they are look.i.ng for a solution that they can work with. Commissioner Jones questioned if a large enough retension area would solve the drainage. Engineer Guerrier stated that if they did not collect from the parking lot and let it work its way into the ditch it would be workable. Mr. Francis pointed out that for the proposed use of the land the roof would be the problem and not the parking lot. -5 - Minutes March 27, 1973 Planner Zaffini questioned what would be done with the natural spring and the ., wet area in parcel 2. Mr. Francis stated that Owens-Illinois would probably leave it there as the Ryan and Elliot setback requirements would not allow them to build that close to the roadway. Mr. Francis pointed out that with the original berm the water table has been lowered in 'that area and a larger berm would applie to the whole area except where the natural spring is located. Planner Latham stated that he felt that Ryan and Elliot should come up with some sort of drainage •for the whole park and then let the Boards decide on it. Commissioner Jones stated that if they put enough retention area it will filter before entering into the Maple Park area. Commissioner Boyden stated that he felt they should inform them on how much water it is going to have to handle. Mr. Francis stated that if they are going to build a retension area it will handle anything they will get into that area but they could not be responsible f or any unnatural storms. Mr. Francis stated that they would bring in a plan showing the retension area. Clerk Grant stated that they should bring in a plan for the whole industrial park to handle any future development. Town Planner Maurer pointed out that the• plans they presented at this meeting did not give any more definitive information than the plans presented two weeks ago for the Planning Board to make a decision on. Town Planner Maurer stated that they should do some engineering for drainage on their own land and also onthe Conservation Land even though the Conservation Commission is not favorable of the water going yin their ponds because in order for anyone to make a decision they need more detailed information. It was noted that pond A is going to be a fishing pond and pond B is the swimming area so they would consider the use of pond c, the skating rink. 14. Planning Board met with the Conservation Commission to discuss the Subdivsion Plan for the Magna Vista II subdivision located off of Lawndale Road. It was noted that the developer was asked to contact the Conservation Commission because of the wetness of the area. Planning Board requested a recommendation from the Conservation Commission on this plan. Commissioner Jones stated that they were concerned with the fact that the swamp drains on the property of J. Carina on Stearns Avenue, and the developer would be dumping clot of water into that swamp. Clerk Grant noted that there is a outlet on his property so they have the right to dump into it. Planner Zaffini stated that he felt the swamp is going tobe raised more than 1/2 inch. Commissioner Boyden stated that they were informed it would be raised 1/4 to 1/2 inch. Planner Nelson stated that they had talked about the fact that the culvert was clogged up and what affect it would have on the water table. Town Planner Maurer read the engineers statement on the water drainage. Chairman Jones stated that they would have to require a Hatch Act on this property. Tpwn Planner Maurer pointed out that they cannot hold the hatch act untl the plan is approved and then the plan might be changed by the Hatch Act. Clerk Grant questioned if the Town was going to clean out the 30 inch culvert. Commissioner Boyden questioned who.had the responsibility of cleaning the culvert. Town Planner Maurer stated that it might be the responsibility of the new developer. Commissioner Jones stated that he felt the developer should talk to the abutter, about running a ditch through his property and dump into the culveO on Stearns Avenue. Town Planner Mauner pointed out that the only thing the Planning Board could do is approve the plan with the ditch to the culvert and approve it with any restrictions from the Conservation Commission -6 - Minutes March 27, 1973 It was noted that lots 17-21 could not be build upon until approved by the Conservation Commission and the Board of Health. It was the consensus of the Board to have the developer make lots 17-21 one lot and then he could make separate lots out of them after they are approved by the Conservation Commission and the Board of Health. It was noted that one of the lots could possibly be used as a retention area. It was noted that there is no record of percolation tests being taken on the lots. Board of Health Chairman Flynn pointed out that the State law states that the land must perc before it is filled. 15. Board reviewed the Form A Plan for Leon Grant on Ware Street. It was noted that it is the same plan that was filed on June 5, 197 with lot 10 and 11 combined into one lot. Motion: To sign the Form A Plan for Leon Grant for land on Ware Street. (Grant-Zaffini, all in favor ) VOTED 16. Board reviewed the Form A Plan for Leon Grant for land on Creedon Street. It was noted that it had been returned before because it did not have the proper dimensions on the buildings. Motion; To sign the Form A Plan for Leon Grant for land on Creedon Street. (Grant -Latham, all in favor) VOTED 17. Board reviewed the Form A Pian for Ann M. Chambers for land on West Street. It was noted that parcel 1 has frontage on West street and Gilbert Street and parcel 2 has frontage on Gilbert Street. Motion: To approve thb`Form A plan for Ann M. Chambers for land on West St. (Grant -MacFarlane, all in favor) VOTED id. Board reviewed the Form A Plan for Frederick Specter for land on Williams Street. There -,was much discussion as to if a house was located on the property and was not shown. It was the consensus of the Board to have Town Planner Maurer review the property before signing the plan. Plan to be reviewed on April 3, 1973. 19. Board reviewed the Form A Plan for Norman Gray for land on South Main Street. It was noted that the plan had been endorsed by the Norton Planning Board for the property located in Norton. Plan set aside to be discussed on April 3, 1973. 20. Board reviewed the Form A Plan for Home Developer3 Inc, on for land on Franklin and Maple Street. Plan Set aside to be discussed on April 3, 1973. 21. Board reviewed the Form A Plan for Antonio Savini for land on South Main Street. It was noted that Parcel B was to be conveyed to Fuller. Clerk Grant stated that if they were going to break up the parcel into two lots they are making parcel A nonconforming and there should be anote on the plan stating that Parcel A is going to the land of Savini and Parcel B is going to the land of Fuller. -7 - Minutes March 27, 1973 22. Planner MacFarlane pointed out to the Board that the piece of land on South Main Street and Fruit Street has been staked out. 23. Town Planner Maurer pointed out that the Spruce Acres Subdivision, they have stripped the loam from the streets and has it stock piles. He pointed out that Allan Willis would like permission to take the loam off the site. It was noted that it is all surplus material in relation to the street con- struction. It was noted that at the time the subdivision was approved the permission to remove the loam has to come from the Planning Boards. it was pointed out that he would be unable to truck the loam out of Town. Motion: To permit Allan Willis to reprove the excess loam which was taken from the roadways within the Spruce Acres Subdivis ion but it must be done in conformance with any other regulations governing the removal of gravel. (Grant -Latham, all in favor) VOTED 24. Planner Wellington pointed out that the offer of land for the parking lots in the center of Town discussed last week that he had learned that they did not own the land all the way out to Old Colony Way. It was noted that a letter confirming the offer had not been received. 25. MeePC, adjourned 10:5 P.M. / g`7 A Clerk / _ 4-1/g Date
