Planner Latham stated that he found an old letter regarding regulations
for electrical power for apartment complexes regarding going underground
and noted that the ditch was only required to be 30 inches deep instead
of 48 inches but he couldnot find the letter referring to the 10% difference
between overhead and underground.
5.
Planner Wellington noted that Mr. Dalton of Cabot, Cabot and Forbes had
requested the Planning Board to request the Board of Selectmen to accept
the Hodges Brook Flowmeter and questioned if this had been done, Town
Planner Maurer pointed out that it would be done just as soon as the housing
is installed around the flowmeter. It was noted that the flowmeter has not
been sealed as of yet.

Board met with Mrs, Margot Jellinek. Mrs, Jellinek requested to see a copy
of the Form A Plan signed by the Board on February 20, 1973 for Waldor
Realty Corp. on West Street. Mrs. Jellinek stated that a portion of land
r
owned by the Foxborough Bank deeded to the Globe Financing was not shown
and that the state took 3.5 acres and the total area was 39 acres and lot
6 showed only 33.5 acres so all the land was not shown on the plan, Planner
Wellington stated that the rest of the land area would be in the 5 lots with
frontage on West Street. Mrs, Jellinek requested to be put on the Agenda for
Tuesday, March 27, 1973 to discuss this further.

Minutes
March 20, 1973
10. Town Planner Maurer informed the Board that Village Estates Definitive
Subdivision Plan has been advertised for hearing on March 27, 1973.
11. Town Planner Maurer informed the Board that he had not discussed the
Cabot, Cabot and Forbes Preliminary Plan with the Town Manager and the
various other department heads but he hoped to get to it next week.
12. Planner Latham questioned if the Board had heard from the Easton Planning
Board regarding the drainage for the Oakhill subdivision off of Stearns
Avenue. Town Planner Maurer noted that they had not received a reply from
the Easton Planning Board but that several residents of Easton were complaining
about it.
Town Planner Maurer noted that in discussing the Oakhill Subdivision Plan with
the various Town 'Departments that it was noted that the suggestion was made
to carry the drainage from Station 3 out to Stearns Avenue and put 2 catch
basins in on Stearns Avenue. It was also suggested by the Water Department
that a note be put on the plan that the Town is not obligated to install Water
to that area.It should be understood that the signing of the Plan does not
commit the other Departments. Town Planner Maurer pointed out that this is
the same procedure that they used in the Subdivision Plan for Hallett on Fruit
Street.
Planner Wellington questioned who made the suggestion of the two catch basins
on Stearns Avenue. Town Planner Maurerinformed him that the Highway Department
Superintendent was concerned with this. Planner Wellington noted that Stearns
Avenue runs down hill and it is not going to catch water on the other side of
the subdivision entrance and that it would run into the subdivision first.
It was the consensus of the Board that only one catch basin was needed at the
entrance of the Development.
13. Planner Latham informed the Board that he had a letter from the Massachusetts
Department of Community Affairs regarding drainage in subdivisions if anyone
is interested in reading it.
14. Board reviewed the Preliminary Subdivision Plan for the Circle "C" Stables
Town Planner Maurer informed the Board that there is an 81' water main and a
14 inch water rain on West Street and that the Water Department would like the
developer to come in from the 14 inch main and then loop through the develop-
ment and hitch up to the 8 inch main. It was pointed out by the water depart-
ment that it is good to cross the mains and this was the opportunity to have
it done. Engineer Maloon had informed Town Planner Maurer that this should be
no problem to the developer:. it was noted by Planner Wellington that it was
not the responsiblity of the developer to cross the m ins at his expense. It
was the consensus of the Board to discuss this with the developer and if he
did not object it could be done but if he did not feel he should have to do
this he would not be required to.
Planner Zaffini stated that he would like to go out and look at the area of
lots 10 and 11 as there are hbt&s-out there, and they are more than 5 foot
contours. Planner Wellington stated that the regulations require that on a
Preliminary Plan they are required to show 5 foot contours as shown on the
latest U.S.G.S. Map and that the excavation on this land had been done after
the printing of the latest U.S.G.S. Map.
Minutes
March 20, 1973
Town Planner Maurer pointed out that the Water Department would like to have
blow off valves at the end of the cul-de-sacs as they have had problems in the
past with low pressure at cul-de-sacs.
Town Planner Maurer pointed out that there is still the question of where the
drainage is going as under the new regulations Hood would have to be notified
that the drainage>,would be crossing his property. Town Planner Maurer pointed
out that for lot 21 they are trying to get a drainage easement through the
property of Rezza. It was noted that there is a low point between lot 37 and 38
and the various departments questioned if this was going to be filled. It was
noted that there is a high point shown on the profile at the beginning of
Morgan and Maverick proposed roads and the Highway Department wanted some way of
collecting the water on the West Street entrances. It was the consensus of the
Board that with Catch basins about 100 feet in on the subdivision roads would
allow for the water to run into the subdivision instead of making a lip at the
beginning of the subdivision road.
15. Town Planner Maurer informed the Board that the Mansfield Industrial Park
Realty Trust was scheduled to come in on March 27, 1973 with revised preliminary
plan based on the letter sent by the Planning Board on March 14, 1973 re-
gesting more information be shown. Town Planner Maurer informed the Board that
Ryan and Elliot was looking for an alternative method of getting rid of the water
and this would involve getting a easement across the Conservation Commission
property and taking it directly into the Canoe River. It was the consensus of
the Board that the water should not be dumped into the Canoe,::River but should
go into the pond on the other side of the parking lot. Town Planner Maurer
informed the Board that they were going to relocate the Railroad tracks on
the plan.
Planner Latham questioned Planner Nelson if he could remember if there were
any plans for drainage in the Mansfield Industrial Park. Planner Nelson
stated that they might be with the plans for Horner Waldorf. It was noted
that the Planning Board did not have any drainage plans. Planner Wellington
noted that the gully that the drainage was going into ends at the railroad
tracks and that it ends up into an area of water 4 feet deep. and 25 feet Wide.
Planner Nelson stated that it was supposed to have run into a pond.
16. Board met with the new Board of Health members. Chairman Flynn of the Board
of Health stated that they were still reviewing their responsibilities and
authority and that they would like to work out a cooperative method within the
Planning Board and the Board of Health. Chairman Flynn stated that on subdivi-
sion plans he would like to know what input the 'Planning Board gives to the
Board of Health and what input the Board of Health should give to the Planning
Board. Chairman Flynn stateddthat it was his information that the Planning
Board has a definite time limitation but the Board of Health does not have a
time limitation to make their decisions, and that he felt in some instances
the Poard of Health cannot make a decision until the Planning Board is: to the
point of almost approving the plan, such as grade elevation. Planner Nelson
pointed out that when you start doing drainage you end up with a different
topo. Chairman Flynn stated that they were still going to have to run the
final perc on the lot when it is done, and that the concern of theBoard of
Health was the leaching field location on a definitive plan. Planner Nelson
pointed out that you still can't tell anything until you see the lot finished.
Chairman Flynn stated that what they would like from the Planning Board is to
know what is expected of the Board of Health, as they have not set up their
procedures yet. Planner Nelson noted that the on-site sewer system was going
to be the biggest problem.for the Board of Health.

Minutes
March 20, 1973
Town Planner Maurer pointed out that they would also have to look at lot
drainage. Planner Nelson stated that they would like the Board of Health
to look at where the water is going as they are of the opinion that you
can't run it into the ground that you have to run it into a stream or pond.
Chairman Flynn questioned if there was information that the Board of Health
could give to the Planning Board. Planner Latham questioned when the Pere
tests could be taken. Chairman Flynn stated that they intended to go along with
the procedures of the past Board of Health until they find which areas are weak
and then they would notify the Planning Board. Chairman Flynn stated that they
would like to know what the Planning Board expects from the Board of Health so
that the two Boards could work in a co-operative fashion. They would like to
stop the building of foundations before the issuance of the building permit.
They would like to know how a person gets from submitting a plan to the issuing
of the building permit to the issuance of the occupance permit. Board of Health
member Walter Main stated that he felt the biggest thing is to try to cooperate
100% with both Boards so that they do not criss-cross.
Chairman Flynn questioned if there was any way that the subdivision plans
could be cross-referenced to a soils map so that it could serve as a flag to
the Board of Health that it may be a potential area of problem and they can
therefore instruct their agent to be careful. Chairman Flynn stated that they
intend to observe with the agent.
Chairman Flynn questioned why the Board of Health did not get copies of the
Form 4 Plans. Planner Nelson stated that a Form A is basically a method to
record; a lot in Taunton and that it is not a subdivision.
Chairman Flynn stated that they would not be using the soil map as a decision
making tool that they would just be using it as a guide. Board of Health
requested to have a copy of the Form A plans submitted and have them associated
with the soil map.
Chairman Flynn questioned the procedures on the subdivision plans. Planner
Wellington noted that the applicant first submits a preliminary plan. Chairman
Flynn questioned if this same plan would be submitted to the Board of Health
for their recommendations. It was noted that it would be. Planner Nelson
suggested that the Board of Health could have a stamp stating that the Board of
Health approves the plan based on perc tests and drainage be acceptable when the
builder is ready for a building permit. This way the Planning Board will know
that the Board of Health has looked at the plans and the Board of Health
requirements would be right on the plan. Board of Health Member Main stated that
this would be good in case the property is sold the restrictions are still on
the plan. Town Planner Maurer noted that the past Board of Health had required
some lots to have percolation tests done prior to the approving of the lots.
Chairman Flynn stated that if the Planning Board would cross-reference the soil.
map to the subdivision plans it would be easier for them.
Town Planner Maurer pointed out that in the Canoe River Acres Subdivision the
previous Board of Health had required the percolation test be taken before the
approving of the plan based on its location in reference to the soil map and
based on the results of the percolation test the Planning Board has required
that the underground drainage be installed and working properly prior to the
approving of the plan. Board of Health Member Kevin Hunt pointed out that by
cross-referenc,ing.the subdivision plans to the soil maps they would be pro-
tecting the Town, would be getting better co-operation between the two Boards,
and they are protecting the developer.

March 20, 1973
Planner Wellington stated that he thought it might be helpful to the Board
of Health if they even cross-referenced the Form A Plans, as sometimes they
approve forms A's with subdivision going in the rear property and then the.
Board of Health could be aware of this. Chairman Flynn requested this to
be done to try to prevent buildings from being started prior to the issuance
of a building permit. Town Planner Maurer informed the Board of Health that
the Planning Board keeps a list of all the Form A's that come in every week
and they could just add a column for soil association and forward a copy to
the Board of Health at the end of each week.
It was noted that a State law has been passsed that the Planning Board cannot
approve a subdivision plan without- approval of the Board of Health. The
Planning Board has to act within 60 days on a subdivison plan but the Board
of Health has no time limit. Question was raised as to how the Planning Board
can take action within 60 days if the Board of Health does not make their
decision within that time. Board of Health to question this with Town Counsel.
Board of Health agreed to try to have their approval or recommendations to
the Planning Board before the 60 day period has elapsed, and would try to have
It within 45 days.
Planner Zaffini stated that he felt they should get together with the Board of
Health on plans that they feel they will have problems with drainage. Chairman
Flynn stated that the Board of Health was going to try to meet onces a month
on the same night as the Planning Board so that they can get together if they
have any problems.
Board of Health Member Main stated that his Board had decided to have a member
of the Board walk the property prior to making a decision on the plans and
suggested that a member of the Planning Board could go at the same time. This
was agreeable to both Boards. .Planner Wellington stated that it might be a good
idea to have a member of the Board of Health attend the public hearings on the
subdivisions. This was agreeable to the Board of Health.
Town Planner Maurer pointed out that the 60 days is very critical when it relates
to the definite plan. He pointed out that the,Gircle "C" Stables Park was in
a, ;preliminary plan, and the Board has 60 days to act on it. If the plan is
disapproved it would have to be in regards to the subdivision regulations. Town
Planner Maurer pointed out that on the Circle "C" Stables Park if it was related
to the soilmap it would show gravel except in the back lots. Town Planner
Maurer suggested that the Board of Health could ask them before the definitive
plan is brought in if they would do test holes in certain spots as all of the
review takes place during the preliminary stages and this would save time for the
definitive deadline. Chairman Flynn noted that there were areas of prbblems that
the Planning Board could do nothing about but if they would tell the Board of
Health about them they have the authority to require more information, and would
be glad to do so.
Chairman Flynn noted that Page 30 paragraph 3 of the Sub&vis-ion Regulations
refers to Communal sewerage systems and questioned if they were an accepted
practice within the Town. Planner Zaffini stated that this would usually re-
quire state approval. Chairjynn stated that the State approval is only
required if it is more than gallons per day. Chairman Flynn questioned
if the Board allowed private on site wells under a subdivision. Planner Zaffini
informed them that they are considering one right now on Stearns Avenue. Chairman
Flynn questioned if it was a requirement that septic systems be build in the
front yards in subdivisions. Town Planner Maurer stated that they should be
where there is best percolation.

Planning Board to notify the Board of Health as to which property they feel
{ should be walked and when it is going to be walked. Board of Health requested
( a copy of the minutes of this meeting.
17. Planning Board and Board of Health reviewed the definitive subdivision plan
for Canoe River Acres. Town Planner Maurer pointed out that the Planning
Board required the installation of the under -drain system before approval
of the plan. He pointed out to the Board of Health that they had met with
the developer two weeks ago and that they had agreed to install the under -
drain system. However, they were concerned with the fact that the test holes
be dug upon the decision of the Planning Board, preferably during the wet
season, and questioned if the Board of Health percolation test and the Planning
Board test holes could be combined with an agent from both Boards present.
Chairman Flynn questioned how close they would be to the Canoe River. Town
Planner Maurer stated that it was 500 to 700 feet. Chairman Flynn questioned
if they would be developing on the other side of the river. The Planning
Board stated that they felt they would be as it was better land. It was the
consensus of both Boards that the test holes and percolation tests could be
combined, the Board of Health to determine the date at a later time.
Town Planner Maurer pointed out that the former Board of Health was requiring
a':$2000 bond to cover the construction of the under -drain system for houses
on lots 5 and 7. It was noted that this installation has not been done yet.
18. Planning Board and Board of Health reviewed the definitive subdivision plan
for Magna Vista Il. It was noted that the plan had not been reviewed by the
previous Board of Health and that the plan stands disapproved by the Planning
Board because they were waiting for more definitive information from the
engineer. Board of Health member Main requested that a copy of the correspondence
be sent along with the plans to the Board of Health.
19. Planning Board and Board.of Health reviewed the definitive subdivision plan
for Village Estates. It was noted that the hearing would be held on March 27,
1973 at 8:00 P.M. It was noted that the previous Board of Health had required
additional information as far as test holes and there were questions on a
couple of the lots. They were going to put washed stone underthedrainage
system. Board of Health to check the records of the previous Board of Health.
20. Planning Board and Board of Health reviewed the preliminary subidvision plan
for Circle "C" Stables Park and noted that the Planning Board would have to
take action on this plan;by April 30, 1973.
21 Planning Board and Board of Health reviewed the preliminary subdivision plan
for Oakhill. It was noted that the Planning Board would have to take action
onthis plan by April 28th, 1973. It was noted that this is a proposed sub-
division off of Stearns Avenue with no Town water., and that the developer
had to obtain a drainage easement into a swamp in Easton. Planning Board
pointed out that they have written to the Easton Planning Board and to the
abutter regarding this easement. Planning Board to forward a copy of the
correspondence along with the plan to the Board of Health. It was noted that
in relation to the soil association map there should be no problem with perco-
lation and that the approval would have to come from Easton before the Mansfbld
Planning Board could approve it.

22. Planning Board and Board of Health reviewed the preliminary plan for Mansfield
Industrial Park Realty Trust. Planning Board pointed out that a glass manufact-
uring company has a option on the property in question, and that the water runs
across the land and into the Maple Park. Planning Board felt the Board of Health
should look at this property. Chairman Flynn pointed out that the Conservation
Commission has requested a joint meeting to discuss this. It was noted that
the Planning Board has to take action on this plan by May 4 1973
23. Planning Board and Board of Health reviewed the preliminary plan for Cabot,
Cabot and Forbes. It was noted that the property is South of Route 25. The
drainage plan was all approved by the Department of Natural Resources about
a year ago, and they have a retention area. It was noted that the Planning Board
has to take action on this plan by April 27, 1973.
24. Board reviewed the Definitive Subdivision Plan for Magna Vista II. Town Planner
Maurer pointed out that he had talked with Engineer Maloon and Enginner Maloon
will be meeting with the Coneeevation Commission on Tuesday, March 27, 1973.
Town Planner Maurer stated that it.might be advisable to meet with the Conser-
vation Commission after thein, meeting with Engineer Maloon.
Planner Zaffini questioned if it would solve the problem of the water going
through the land of Carine. Town Planner Maurer pointed out that the figures
showing the amount of water that will go on Carines property are not high and
that Carine is all low land right up to Stearns Avenue. Town Planner Maurer
pointed out that the problem they will have with drainage is that the culvert
is blocked up.
25. Board reviewed the Form A plan for Great Woods Estate Trust. Town Planner
Maurer informed the Board that he wrote to Town Counsel and gave him the
information concerning the plan back in 1962 and then the approval not
required plan filed in 1968. Upon speaking to Town Counsel he was of the
opinion that the approval not required plan in 1968 would eliminate the
effectiveness of the approved subdivision. Town Planner Maurer informed
the Board that a representative from the Department of Public Works came in
and upon discussing this plan the representative stated that they -would like to
see the Planning Board not approve this land because it would increase the
value of the land in taking the land for Route 25.
Town Planner Maurer informed the Board that the deadline for the plan would
be on Monday, March 26, 1973 and the PlanningBoard would have to give a
response to the Town Clerk, so that the plan will not be approved by default
Motion: To advise the Town Clerk that the Planning Board will not sign the
Form A Plan because they are presently of the opinion that it is a
Subdivision and not a Form A Plan and they have therefore asked for
the opinion of Town Counsel.

26. Board reviewed the Board of Appeals application of Woods Real Estate, Inc.
for an appeal from a Decis;i,on of the Board of Selectmen under Section VI,

attach a four (4) by eight (8) foot so-called "Commander" sign to two (2)

March 20, 1973
27. Board reviewed the letter of March 15, 1973 to Home Developers Inc, regarding
the Leonard Street Pump Station. Town Planner Maurer pointed out that the
Planning Boards approval of the pumping station was based on the advise from the
Company and the Electrie6l Engineer for the Town. At that time the subdivision
was a joint subdivision between Waldor Realty and Home Developers. The pump was
on the Home Developers site. Waldor Realty had 4 occupants prior to the in-
stallation of the pump. They held up letting anyone into the houses before the
pump was installed. About two weeks ago Town Planner Maurer was informed that
the pumps had been installed and it was going to be inspected by the manufacturer
and Town Planner Maurer was unable to attend the inspection. Bill Cahoon,
superintendent of the water department stated that he would not accept the
pump station as it was not covered and the shed was not built around it.
Town Planner Maurer informed the Board that on March 14, 1973 they found obt
that Home Developers had requested an occupancy permit, and Town Manager Hannon
would not give one until the pump was inspected. Town Planner Maurer pointed
out that another test was run with himself and Bill Cahoon present and one of
the floats would not work. Bill Cahoon stated that he would not accept it until
it was working properly. After repairs were made Bill Cahoon retested the
pump station including the emergency float and emergency alarm. Bill Cahoon
accepted the pump as working properly because it was the kind of pump that was
approved by the Planning Board. Upon talking to the manufacturer it was brought
up that every house contained garbage disposals. The manufacturer stated that
there might be a problem because the grease would cause the float to stay tipped,
and the floats would have to be cleaned. Bill Cahoon is recommending that the
Town not accept the maintanence for a period of one year. The Town will check it
out but will not be responsible for the repairs, if any. It was the consensus
of the Board that it should not be accepted until the roads are accepted.
Town Planner Maurer to arrange a meeting with Charlie Boutas and Bill Cahoon
to discuss this matter.
28. Town Planner Maurer informed the Board that the bounds are all set within the
Magna Vista Recreation Area by Boston Survey Consultants, and the plan was
sent back to the Planning Board with the bounds shown on it. Town Counsel
to draw up the deed on this property.
29. Town Planner Maurer reviewed the Planning Board account.for Town Meeting.
Town Planner Maurer pointed out that the Board had originally requested that
the secreterial account be a salary account, and the Finance Committee is
insisting that this remain an expense account. The Bristol Community Re-
tirement Program states that any person working more than 20 hours for the
Town has to participate in the retirement program. Under the salary account
the secretary would be eligible for Blue Cross -Blue Shield and a life insurance.
Benefits from the Town would be $319.68 on a yearly basis. The present rate
of pay is $3,307.20 per year, when you add the benefits it comes to$3626.88 per
year. If the Finance Committee does not go with the salary account, the secretary
is entitled to a raise, which comes to $3,494.40 with the raise. The diference
between the benifits and non-benifit is $1,1320 cheaper not to go for the benefits.
Town Manager Hannon feels that for that amount they should go for the benefits.
The secretary would work for the Building Inspector 6 hours a week and there is
the possibility of her working for the Board of Health and other agencies. The
new account would be 201-2 Planning Board secretary. The amount would be through
the end of March assuming 18 hrs a week would be $621, to April 1st. The balance
of $3,170 would be put into the salary account for a total of $3,955.

30. Town Planner Maurer stated that at the Town Meeting on March 19, 1973 the
Planning Board had indefinitely postponed the zoning articles until sometime
in the future, but they did not say when.t1T4wn':Pl:bnner Maurer felt there
is concern for performance standards, siteplan approval, and enforcement
procedures. He did not know how they felt on Mobile Home Parks but he knew
they did not want Cluster Development or Planned Unit Development.
It was the consensus of the Board to have Town Planner Maurer get together
the information on Performance Standards, Mobile Homes, Sit Plan Approval,
and Enforcement Procedures and advertise for public hearing.
Town Planner Maurer questioned if the Board wanted to consider having
apartments in the second story of the Downtown Business area. It was the
consensus of the Board that they are already existing so they shou,l.d keep
them in.
31. Town Planner Maurer informed the Board that plans had been Brought in for
Chambers and two for Leon Grant, all three are Form A Plans. It was the

be no problem.
