cussed this with residents in Pine Needle Park and the areas between the
sidewalks and behind the sidewalks in the last area of construction have _
not been raked and seeded and there are other items that they are concerned
with that they would not disclose until they come before the Board. It was
the consensus of the Board to have Town Planner Maurer acknowledge the
receipt of this letter.

Minutes
/ March 12, 1973
10. Board met with Mike Murphy and Paul Dalton from Cabot, Cabot and Forbes.
(Clerk Grant left the room and did not participate; in any discussion.)
Mr. 'Dalton explained that the preliminary plan was a typical breakdown of:
the land with several large parcels to be ''broken up into smaller lots.
He stated that they would bring water through the subdivision and loop it
around. Mr. Dalton pointed out that there would be 60 foot right of ways
with 50 foot cul-de-sacs. He stated that the grades will be a maximum of
1% with the controlling factor being the rail grades and the drainage.
Mr. Dalton pointed out that the 15 acre ;reservation area would remain the
same with the present ditch running into it now. >Mr. Dalton stated that
he would like the Board to look over the preliminary plans in case there
are any questions.
Town Planner Maurer questioned if construction would begin on this
particular subdivision this year. Mr. Dalton stated that along towards
fall they may be ready to begin.
Planner Zaffini questioned if they were going to end1Pl'ymouth Street or
eventually carry it out further. Mr. Dalton stated that in the future it
might be usable so they were going to leave a stub to carry it out.
It :was noted that Roads B and C on the profile would require clot of fila.
Mr. :Dalton questioned what the present procedure was for preliminary plans.
Town Planner Maurer informed him that the 'plan would be taken around to
the various Town Boards and Departments before taking any ;action on the plan.
I1. Mr. Dalton 'informed the Board that he was in receipt of the Board's letter
regarding the acceptance of the Hodges Brook flowmeter. Mr. Dalton requested
the Board to contact the Board of Selectmen regarding the acceptance of the
flowmeter and that it was installed and The Board was free to use it.

proposed Circle "C" Stables subdivision before taking any final action on
the 'plan. The Board -informed Mrs. Jellinek that they would take it under
consideration.
13. Board met with Mr. FrancisVazza and Mr. Bill Schappe to discuss the
plan for the Great Woods Estate Trust, it was noted that it was,a plan .of
land signed in 1962 for the subdivision entitled ''Great 'Woods Estate", and
the present 'owner would like to have "Planning Board approval not required
under the'Subd-i'vision Control Law." since the subdivision was once approved.
(Clerk Grant left the room and did not participate in any discussion.) Mr.
Vassa pointed out that the front lots had ,been changed to ;give them the re-
quired frontage on both streets, and the up-to-date abutters are shown on
the new plan. Mr. Schappe questioned if it would be alright to use
Cobbler Drive instead of Cabot Drive.
Planner Zaffini pointed out that Route 25 is proposed to cross the property.
Mr. Vazza stated 'that `he has not been notified of any taking of land as of
yet.
Town Planner Maurer questioned what the intent of Barco Realty was back in
1962 when the plan was submitted. Mr. Vazza stated that he felt it was
just to lock in the zoning.

Minutes
March 12, 1973
Town Planner Maurer stated that he would like to check this out with Town
Counsel, before any action is taken,as far as relocations and so forth. Town
Planner Maurer pointed out that the subdivision regulations have changed since
1962 and this should be checked out.
Planner 'Latham stated ;that if the Board signed the plan they could not ,begin
to supply a development of this size with water. Planner Latham pointed out
that the original developer had talked of, putting his own water in, and then
donate them to the 'Town.
Town Planner Maurer stated that he would like to check with Town Counsel to
see if Planning Board approval is required under the subdivision control law.
Planner Wellington questioned how long,attime-,does.the plan run after it is
approved. Town Planner Maurer noted that as far as the 7 years going on the
subdivision of the roads, there is nothing in the regulations as there is in
':the zoning.
Town .Planner Maurer pointed out that back In 1968 a plan was submitted that
wiped the streets out and that he would like to check the status of the plan
before the Board takes any action. Mr. Vazza stated that the 1968 plan was
just a perimeter plan to lock in the zoning longer.
Motion: To check with Town Counsel on the status of the pian for Great
Woods Estate before taking any action on it.

In place of Cabot Street. The Board to notify Mr. Vazza when he can meet
with them again, upon their receipt of a reply from Town Counsel.
14. Board met with Mr. 'William Slattery to discuss the Form A Plan for land
for the gravel removal operation. It was noted that the Form A has the
locus plan and the zoning classification as requested.
Motion: To approve the Form A Plan for Boro Sand and Stone, Inc, for the
Gravel Removal operation.
(Grant-Zaffini, all in favor) NOTED
Mr. Slattery requested the Board to write a recommendation to the Board of
Appeals on the gravel removal operation, whether it be favorable or not as
he would like to get all his letters from the various Boards before going for
the hearing. It was noted that the present regulations stated that the 'plan
does not have to be 'signed by the Planning Board but Mr. Slattery stated
if it is requested by the Board of Appeals he would be back in to have the
gravel removal plans signed. Planning Board to send a letter of recommendation
to the Board of Appeals.

15. Board met with Mr. Robert Rizzo to discuss the petition to change the
existing Zoning Maps by altering the district boundaries in the vicinity
of Sweet's Pond from an existing Industrial District to an Agricultural
District. Mr. Rizzo pointed out that he ispresently under an agreement
with Mr. Sweet for piece of land containing 40 acres that is presently
zoned Industrial. Mr. Rizzo stated that he was under the ;impression that
it was the Boards intent to .zone this agricultural and that he has filed the
petition with the Town Clerk and he is looking for a recommendation from the
Planning Board. It was noted that it is considered to be primary land. ,Mr.
Rizzo stated that it is sandy and gravel material on the land and it is located
in a medium density area, which in Agricultural is ;for single family with
30,000 square foot lots.
Town Planner Maurer pointed out that the Board would have_to hold a public
hearing, and the petition came through on March 12, 1973 from the Town Clerk
and now the necessary steps will have to.be taken to advertise for a hearing._
Mr. Rizzo .stated that he would be meeting with the Conservation Commission
on March 13, 1973 to obtain their opinion. 'Mr. Rizzo presented a map to
show the property he was interested in, which is attached to the petition.
It was noted that there is a 50 foot right of way into the 'property. It,
was noted that the land is presently owned by Mr. Sweet.
Planner MacFarlane questioned if they could take action on the petition.
Town 'Planner 'Maurer 'stated that any petition coming into the Town 'Clerk
regarding rezoning the Planning Board has to hold a hearing on. Town
Planner Maurer pointed out that Mr. Rizzo had obtained the 10 signatures
required to hold a hearing but the Board of Selectmen does not have to put
into an article until there are 200 signatures on the petition. The decission
is in the hands of the Board of Selectmen.
Board met with David Millette and Engineer Ralph Maloon to discuss the
preliminary subdivision plans for the Circle "C" Stables Estates. Engineer
Maloon stated that he had prepared 'a certified list of abutters and it was
in the Assessors office to be checked out.; Planner Zaffini stated that
there were alot of big holes in lots 10 and 11 from Route 95• Engineer
Maloon stated that there is an existing hole right in the middle of the
lot. Planner Zaffini stated that there was water on Lot 1. Engineer Maloon
stated that there were mounds of gravel in the front of the subdivision that
would be pushed into the low areas.
Planner Latham questioned where the present boundary marks were. 'Engineer
Maloon noted that the bounds at the back corner of lot 16 and 18 is still
there but the fence is gone. Engineer Maloon stated that there is a cart
road along the lot line of lots 5 and 6 leading into a pine grove and that
they would leave as many trees as possible. It was noted that the State has
chain link fence along their property line.
Planner Latham questioned where the; drainage would run. Engineer Maloon stated
that the drainage would go along into a swamp on their own property which runs
onto the land of Hood and then runs along with Route 95 and eventually gets
into the Wading River. The drainage from lot 21 eventually goes into lake Bungay.
Planner Latham questioned if they had permission from Hood to dump over there.
Engineer Maloon stated that they would not be dumping directly onto the land of
16

Hood that they would be putting it into a piece of swamp on their own land.
Planner Latham questioned if lots to and 11 were buildable. Engineer Maloon
stated that they would be after they were filled.
Town Planner Maurer pointed out that this plan would be looked at with the
Highway Department and the Water Department and then the Board could go out
next week and review the property.
Planner Wellington requested Engineer Maloon to change the lot area on lot
34 from 33,400 to 30,400.
Engineer Maloon pointed out that if the well across the street from Route 95
gets developed theJown:could consider trying to cross the land of Rezza and
then run it out onto Brown Avenue and they could have another water loop.
17. ,Board reviewed theForm, A Plan for David Smiley for land on Smiley Avenue.
It was noted that the abutters around parcel B were stili 'omitted and that
the property was not outlined on the Locus Plan. 'Planner MacFarlane noted
that his property l;ine is 225 feetlinstead?of'210.feet, i
18. Town Planner Maurer informed the Board that they had just received the plan
back for 'Magna Vista Subdivision. It was the consensus .of the Board to review
this plan at:!their next meeting.
19. Board reviewed the Zoning Article for the Town Meeting on March 19, 1973.
Town Planner Maurer informed the Board that the artcles left consisted of
the Cluster Development article,,Planned Unit Development Article, Mobile
Homes Article, elimination of the cumulative effect in the Business zone;:
Article, and the Site Plan ;approval Article, Enforcement Procedure Article,
and'Article7. Town Planner Maurer questioned how the Board would like to
approach the articles for 'discussion.
Planner Wellington questioned what they were going to do if they opened with F
the Special Town Meeting and it was voted to adjourn it to next week.
Town Planner Maurer stated that they should point out that it had been voted
to have it at this time. Planner Zaffini stated that he felt the Selectmen
were going to vote to'hold off on the specials because it is getting late in
the year and they want to get the budget taken care of. Planner Wellington
stated that he felt if getting duplexs out is the only thing they would
accomplish they they should move for an indefinite postponement and try again
at another time. ,Town Planner Maurer stated that if they move to have the
Special adjourned that the Planning Board should debate them on ;it. Planner
Zaffini questioned what steps should be taken if it is debated and lost.`
Town Planner Maurer stated that they should move to disolve the meeting.
It was the consensus of the Board that if the motion is made to adjourn the
special town meeting items that the Board should debate on the motion.
Town Planner Maurer suggested that ,the Board discuss their opinion with the
Board of Selectmen prior to the Town Meeting and it might avoid the Selectmen
postponing the special town meeting items.Planner Wellington questioned if
the yspecial `items were discussed 'how would they present them. Town Planner
Maurer stated that they had more slides made up to present the Cluster Develop-
ment and they now have the answers to many of the questions that were raised
at the hearing. Town Planner Maurer stated that if the Cluster Development
passes they should go right to Planned Unit Development and if the Cluster

Development did not pass they should go for an indefinite postponement
i on the Planned Unit Development. Town Planner Maurer stated that the
Mobile Home Parks might pass but if it didn't they should try to pass
the first part of the article into the present zoning. Town Planner
Maurer stated that on the Cumulative Effect the concern from the residents
is that the apartments on the second story in the down -town area would be
eliminated. He felt that an amendment might be made to this. Town Planner
Maurer stated that he did not feel they would have any problem with site -
plan approval or the enforcement procedure with the Building Inspector,
Town Planner Maurer noted that Article 7 would cause some debate.
Motion: That Town Planner -Maurer -make the presentation of the special
article at the Annual Town Meeting on March 19, 1973.
(Zaffini-Wellington, all in favor) VOTED
20. Board reviewed the Articles for the 1973iAhnual Town Meeting. Town
Planner Maurer pointed out that the Planning Board Budget had been
reduced by about 15% over what was requested. He pointed out that
the reductions were made as follows:
Office Expense and Equipment - because they did not feel that a new
calculator should be ,purchased untillsomething goes wrong with
the old one.
Hearings and Advertising - based upon what was spent last year.
Office Equipment Maintenance - because they feel that the maintenance
of the copy mashing should come out of one account instead of
several different accounts.
Town Planner Maurer pointed out that the Secreterial Account was set
up as an expense account but the,TowniManager-,stil.l.would like to make
it a salary account with 20 hours ;coming from the, Planning Board :and
4 hours coming out of the Building Inspectors salary account.
Town Planner Maurer pointed out that in the Capital Improvement Program
accounts the Finance Committee recommends everything except the appro-
1prietion of an unmarked police vehicle and the amount of the Maple
Park Project was reduced. > Town Planner Maurer pointed out that the
Board of Selectmen would be requesting up to $50,000 for sewer line
infiltration. He stated that this would be discussed in detail on
Thursday,March 15, 1973 at the Capital improvement Program Committee
Meeting. Town Planner Maurer informed the Board; the Town Manager is
hoping to get somebody from Penetron and somebody from Camp, Dresser
McKee to speak on this matter. Town Planner Maurer stated that they
were trying to get another appointment for Saturday, March 17,-1973
to set up a TV Monator'on the system to show how, it works. Anyone
interested in this is -invited to attend. Planner Wellington questioned
if Bill Cahoon, Superintendent of the Water and Sewer Department, had
stated that it was completed sealed on Central Street and if so that
was the line that 'should be checked,

Town Planner Maurer pointed out that the Town Hall/ Police Station
" Building Committee would Like a recommendation on the proposed plans
prior to the Town Meeting. Town Planner Maurer stated that he had
reviewed the plans and noted that the Planning ,Board meeting room
would be across the Hall from the Planning Board Office and he could
see no problems with the Planning Rooms but questioned where the
duplicating machine would be located as it should not be in an
internal office because it, is used ,by;different departments. Town
Planner Maurer suggested that it might be possible to have it in
the janitors room as it is large efiough'to handle the copy machine.
Town Planner Maurer statedthathe felt that the Planning Board
meeting room'should:have tackboard so that plans could be hung.'
It was noted that the walls could be painted with a magnetic,pAint
for this purpose. Town Planner Maurer pointed out that the only;
questions brought up by the Board previously was the paving of
the driveway and the fact that the drainage for the parking lot ran
into the drainage ;pipe instead of directly into the river. Town
Planner Maurer pointed out that the architect has already changed
the plans to have the driveway paved. Town Planner Maurer pointed
out that they are talking of getting their fill from fultons Pond '
and that the poweris going to be underground as the plans have
been adjusted. It was noted thatitwould be gas heat.

Planner Zaffini informed the Board that he and Planner Wellington had
walked through the land of the subdivision plan for Mansfield Industrial
Park Realty Trust. Planner Zaffini pointed out that the railroad tracks
are not in the same location as shown on the plan and that the _switch :is
closer to Maple Street than shown on the plan. They noted that the first
culvert is full and is covered with crushed stone. The grade goes up.
from Maple Street on Francis Street before going down.- It was '`noted that
there is a ditch that runs near the railroad tracks and as the ditch goes
further down the lot there is an oil scum along, the water. The water
drains down a bank and as you get down into the back of lot 2 there is
a ditch with about 3 feet of water before the retention area. It was
noted that Mr. Guerriere stated that there was no water past 100 feet `
in lot 3'and Planners Zaffini and Wellington noted that the water runs
over the retention area, across lot 3, ;across Copeland Road, and into
the Maple Park swimming area. Planner Wellington noted that the water`
runs quite wide as it leaves the retention area. It was noted :that the
water the whole length of the ditch is stagnant.
Town Planner Maurer stated that he and the Town Manager had walked the
same area and found the same things that Planners Zaffini and Wellington
had noted. Town Planner Maurer stated that he had talked with Mr. Francis
and told him that there was no way the Planning ,Board could approve the
drainage system the way the land is now ;as they only approve plans that
show the drainage going into a body of water. Mr. Francis stated that
they would be reviewing the property again.
Planner Zaffini questioned if they came up with an ,agreement with the
Town if it would be valid. " Planner Latham stated that there must be
a plan for drainage in the industrial park from previous construction.
It was noted that the Planning Board did not have a copy of such plan.
Planner Wellington noted that they could run a ipipe under the road
and carry it along under the edge of the parking lot and run it into
the Shell easement. Town Planner Maurer pointed out that Bill Cahoon
Superintendent of the Water and Sewer Department, did not want the
water to drain in that direction and he would rather put it down into
the lower pond on the opposite side of the Shell easement,
-Minutes - 10 -
March 12, 1973
Town Planner Maurer noted that Mr. Cahoon was not satisfied with the
layout for the water as he felt it should be looped back to Maple Street.
1t was noted that they were only proposing 15 foot radius at Maple Street
and the Subdivision regulations require 30 feet and Cabot, Cabot and 'Forbes
had sometimes been required to have 50 feet. It was also noted that before
the drainage gose into the ditch it will either flood the road or Horner
Waldorfs driveway without a better drainage system.
It was the consensus of; the Board to inform 'Ryan and Elliott that the
Board could not take any action on this plan until they, submit more
definitive information in regards to the location of the railroad tracks,
the drainage at the beginning of, proposed Francis Street from Maple
,Street
and the drainage outlet ;at the end of lot 3, and the proper curve radius
at the Maple Street entrance.

Board reviewed the application of Conley, G. Eagan for a VARIANCE under
Section 111, Paragraph D:of the Zoning By-law to allow the conversion of
a twenty-four (24) by twenty-four (24) foot storage building into a
three (3) room house. Said conversion would create two separate

be nonconforming_ In an Agricultural Zone.
