A letter was also received from the Board of Health with comments on the subdivision. The outstanding point is the easement across the property of Smith, there has been no written agreement submitted to the Planning Board to date. - 2 - Minutes October 9, 1974 4) Planning Director Maurer advised the Board that the Form A Plan for Anthony Sarro was returned to the applicant upon request by the applicant as they wish to change the lot dimensions and the plan has not been received. Motion: To rescind the motion of October 2, 1974, item #6 of the minutes, to sign the Form A Plan for Anthony Sarro for land on Hope Street. (Latham -Wellington, Parsons, Dunn, MacFarlane, Zaff-ini in favor Grant abstained) VOTED 5) Board reviewed the definitive subdivision plan for Foxfield Estates for land on John Street and Fox Street. Clerk Grant noted that there were six (6) bearings which were not shown on the plan. Board felt that the description of the easement granted to Mr. Scarpellini to be checked into as it would eventually become a Town accepted street. It was noted that lot 5 should not be shown as a lot but should be shown as remaining land of Scarpellini as it does not have frontage on the proposed right -of way. 6) Board reviewed the Form A Plan for Guntis Reks for land on Gladiola Terrace. It was noted that there is an existing house on the lot with only a 10 foot sideyard instead of the 18c1eet as shown on the building permit. Motion: To sign the form A Plan for Guntis Reks for land on Gladiola Terrace. (Wellington -Dunn, all in favor) VOTED 7) Public Hearing was held on the definitive subdivision plan of Camelot at 'Mansfield for land on Williams and Tremont Streets, :at 8:00 P.M. Transcript of that hearing is on file. 8) Board met with Mr. Scarpellini and advised him that the time limit for the Planning Board's recommendation is December 1, 1974 and that a public hearing has to be held and the plan has to be circulated to the various department heads for comments, regarding the definitivesubdivision plan for Foxfield Estates 9). Planner Dunn questioned the status of the Rizzo subdivision of Wayside Estates. (Clerk Grant left the room and did not participate in any discussion.) Planning_ Director Maurer noted that three years ago when they put the dra:i.nage in they put covers on all the manholes and the kids kept taking the covers off. Last summer someone complained about the manholes being open and Mr. Rizzo put new covers on them. Planning Director Maurer advised that he reviewed the site last week and there were 21 manholes and/or catchbasins that were exposed and 10 did not have plates on them, and rockscand sticks are being thrown into them. Mr. Rizzo plans to replace the plates and cover them with gravel to try and keep the kids from removing them again. Planning Director Maurer noted that noone has raised the question as to how much damage the kids in the area are causing and that possibily the property should be posted. -3 - Minutes October 9, 1974 10) Planner Wellington noted that he had driven through three subdivisions recently. They were Oakleaf Estates,, Brookside Estates, and Village Estates. He noted that Village Estatesisa mess and you can't drive down the road from all the potholes and that on Brookside Estates they, pave the road one day and dig a'trench across it the next day. Planning Director Maurer noted ;that in Brookside_ Estates; all the trenches have been filled in, as the trenches in BrooksT(Je Estates were for the underground telephone cables. Planner Dunnnotedthat on Francis Avenue that the manholes are way down be -low the grade of the road and Planner Wellington noted that they could put some cold patch and mark where the manholes were. Motion: To send a letter to Christian;, and Schromm regarding the condition of the road in Village Estatesandadvise 'them:to;,have it corrected before cold weather sets :in and to send a letter to Ryan, Elliott and Company and advise them to correct the manholes on Francis Avenue., (Wellington -Dunn, all in favor) VOTED 1.1.) Planner Wellington noted that on Pratt Street in the past they have stated that the did not ,repave that area because of a leak in, the water main or some other type of leak and noted, that the road had been repaved=and questioned if the leak was taken care of. Planning Director Maurer to look into this. 12) Planner Wellington questioned, on the monthly summary of subdivisions, if there; was any need to carry the subdivision that have been completed such as Pineneedle Park ;and New Mansfield Estates. Planning Director stated that he would put them in:.a separate category as he is trying to show the development since 1970. 13) Planner MacFarlane stated, that he hopes someone from the Board can explain to the nextpersonwho comes in with a;plan and wants it signed the same night and .the Board advises them that this is not the policy why they "signed a plan this evening when they had never seen it before. Planner MacFarlane stated that they should keep to their policy and not break it whenever it is more convenient. Planner Parsons agreed with, this. 14) Planner Parsons informed the Board that he leftthe public hearing to meet with ;the Board of .Selectmen in a ,joint meeting with representatives from Foxborough, No. Attleboro, Attleboro, Plainville and the Bungay Lake Association to, discuss a proposed regional study of the Bungay water shed area, which takes in approximately 27 square miles. He, noted that there has been an initial study and ,it was noted thatin-the -near ,future the variious Towns will be drawing a total of -7z million gallons per day from that area, and the study is to see if the land can handle this use. He noted that there will be -a committee set; up consisting of two representatives from each town to do some -initial studying through SRPEDD and rthere will probably; be federal monies available through the state ,to help finance this. Planning Director Maurerquestionedif the ,purpose of ,this project was for the protection of the, Bungay. Lake. Planner Parsons stated that it was his impression that it was to see how much water is available as -- rights to this water go back to 1829. Planner Parsons noted that he was not certain who would-be asked to serve on this Committee, whether it; would be a Planning -Board -member or not. Minutes - 5 - October 9, 1974 Planner Latham felt that a letter of intent to sign the plan at the next meeting would have been enough for the applicants attorney. Chairman Zaffini noted that the Planning Board had previously voted to look at the plan twice before signing it and that they should have stuck to this policy. Planning Director Maurer noted that this is the second time that an Incident has occured in which Owens-Illinois was involved. Planning Director Maurer noted that the Agenda closes at noon time on Monday and if a plan is not on the agenda it should not be signed, that the plan should be held until the next week. Planner Parsons noted that in some instances the Board looks at a plan once and makes a motion to sign it at the next meeting then it is signed without a second review so it could have been signed at the first meeting, there would be no difference. Clerk Grant suggested the possibility of going along with the Planning Directors suggestion that if a plan, or visitor, is not on the agenda at the close of the agenda on Monday at noon time that they be held until the next meeting. Planning Director Maurer noted that this would be difficult to do with visitors and noted that there are four time openings on the visitors agenda and that the persons be turned away only if the four time openings are taken. Planner Dunn felt that if there is no question on the plan then it should be signed. Motion: To rescind the two week policy and not set any time limit on the review for signing the plans except the 14 days required by law to act. (Parsons -Grant, Zaffini, Dunn, Latham in favor, MacFarlane present but not voting) VOTED Planner Dunn noted that if someone comes in with a plan that they be advised that the Board will take it under advisement and review it after the person leaves so they are not rushed into signing it. 21) Board discussed the definitive subdivision plan for Camelot at Mansfield and Planner Dunn questioned if this subdivision would come under the wetland provisions. Planning Director Maurer to check into this. Clerk Grant noted that use is the only regulation that a Form A gives three years Protection on. It was noted that in 1972 there was a Form A Plan for the perimeter of the property on April 20, 1972 and this would allow duplexes if a building permit is issued before April 20, 1975. Planner MacFarlane felt that,as brought up at the public hearing, a meeting should be scheduled with Cabot, Cabot and Forbes regarding the agreement for their retention area and that this should be a joint meeting with Cabot, Cabot and Forbes and Mr. Antosca the developer of Camelot at Mansfield. Planning Director Maurer to send Cabot, Cabot and Forbes the informtion on the run - off and set up a joint meeting in two weeks. Planner,;MacFarlane noted that the easement agreement should be notarized and stamped by the notary. It was noted that the linens for the subdivision should be cross-referenced to the plan for the easement and that the easement plan should be cross-referenced to the subdivision plan. 22) Meeting adjourned at 10:55 p.m. Clerk %G iG}752-r Date
