Board discussed the definitive subdivision plan for Camelot at Mansfield. it was noted by the Board that, after complete review of the site, there would be no problem with the drainage if the easement is obtained from Smith. Planning Director Maurer questioned the Board as to the proposed retention area. Clerk Grant felt that he did not want a retention area in a residential area. Planner Wellington noted that it is so far away from the proposed homes that there would not be much problem and that it should never get filled. 10. Board discussed the letter from the Planning Board to the Building Inspector regarding the site plan approval for the United National Bank. Planner Wellington noted that the letter did not say what the pipes were for and it did not state that they should be stone back filled or that they were leaching basins, as it 'should be written as it appears in the minutes of September 18, 1974. Amended letter to be sent to the Building Inspector. -3 - Minutes September 25, 1974 11. Board reviewed the letter from the Registry of Deeds regarding the street acceptance. Planning Director Maurer noted that the only problem he could foresee was that in Magna Vista all easements are in the proper location except for the one on Darby Drive, so this might have to be adjusted. It was noted that the easement on the property of James Wills had never come to a formal agreement with the developer and Mr. Wills. It was noted that the construction plan shows the revision however, the lot plan was:cnot corrected. Planning Director Maurer to obtain a copy of the dedd for the property of James Wills. Planner Wellington noted that last year the Town accepted several private drainage easements and felt that this one could be accepted in the same manner. 12. Board reviewed the Board of Appeals application of James Breen to extend an existing building, which has an existing sideline of 12 feet. Motion: To recommend to the Board of Appeals that the variance be granted on the application of James Breen (Grant -Wellington, all in favor) VOTED 13. Board discussed the letters received from Cabot, Cabot and Forbes requesting a reduction in bonds being held for work completed on Hampden Road and Norfolk Street and Middlesex Road. (Clerk Grant 'left the room and did not participate in any discussion.) It was noted that these roads were complete through to the black base. Planning Director Maurer to check figures requested for release compared to what is being held, for the next meeting. 14. Board discussed the Hodges Brook Evaluation. Chairman Zaffini noted that the drainage master plan shows an arch as 5'x8' and in reviewing the site the arch did not appear to look 8'. Clerk Grant presented plans showing the location of the Hodges Brook and surrounding areas, which he prepared himself. 15".'Board discussed the Planning Directors budget proposal for 1975-76. it was noted that the budget has to be submitted to the Town Manager by October 7, 1974. 200 - 1 Supplies - Chairman Zaffini questioned if the increase of $35.00 would be enough to take care of the cost of the typing of the Capital Improvements material. Planner Wellington felt that this expense should be shared with the Town Manager as he is the Chairman of the Committee. It was the consensus of the Board to request $300.00 for this account. 200 - 2 AdvertiS'Ing.- It was the consensus of the Board to request $425.00 for this account. 200 - 3 Telephone - Board questioned why the Planning Board is now charged for two telephones and it was noted that at the old Town Hall the telephone was shared by the secretary and the Planning Director and now there are two separate phones. It was the consensus of the Board to request $500.00 for this account. Pl'anneP MacFarlane entered the meeting at this time. 200 - 4 Travel, Dues and Business - Planning Director Maurer requested that $25.00 be appropriated for his membership in the Conference of Massachusetts Planning Directors. Planner Wellington felt that -4 - Minutes September 25, 1974 if he wished to join this he should do it on his own. Planning Director Maurer stated that this was a benefit given to the Water Department and Police Department and felt it should be extended to him. Amount to be requested to this account is $320.00. MacFarlane, Dunn, Grant and Zaffji0i in favor, Wellington and Latham, opposed,. The consensus of the Board was to request $320.00 for this account with $25.00 being paid for the Planning Directors membership to the Conference of Massachusetts Planning Directors. 200 - 5 - Printing - Planner Dunn questioned if the amount proposed was enough to cover the reprinting of the Zoning By-laws as well as the Subdivision Regulations. Planning Director Maurer noted that it would be. It was the consensus of the Board to request $350.00 for this account. 200 - 7 Board of Survey - it was the consensus of the Board to request $5,;00 for this account. 200 - 6 Equipment and Maintenance - It was noted that the Planning Director recommended $785.00 for this account for which $60.00 would be for maintenance and $725.00 for a new typewriter. Planner Latham questioned the typewriter previously bought by the Planning Board. Planning Director noted that the typewriterbought in 1969 was only a portable one which did not even meet the standards for its use as it could not even cut a stencil and it is now in the possession of thePolice Department. The typewriter now being used in 18 years old and is an IBM Electric with a service contract which cost $60.00 a year. Planner Wellington stated that if the repairs were being made under the service contract that he was in favor of using the machine until it is no longer usable. Motion: To look into the possibility of acquiring a second hand typewriter. (Grant - MacFarlane, all in favor) VOTED It was noted that monies for the microfilm reader account had been turned back to the Town. 16. Board attended a joint meeting with the Mansfield Board of Selectmen, Representatives from Foxboro, Norton and Commonwealth of Massachusetts to discuss the regdonal sewer system. Board of Selectmen Chairman Titus introducted the various representatives and informed him that Mansfield went before the Water Pollution Control Division and requested a meeting to find out where the various Towns stood in regards to establishing a Regional Sewer District. Chairman Titus gave a brief summary of the last meeting held for this, which was July 27, 1974 in Boston. Mr. Thomas MCMahon,Director of the Water Pollution Control Division, noted that the original plan was for a sewer plant in Norton and that an alternative would be for the plant to be established in Mansfield with a interceptor around the Norton Reservoir. Mr. McMahon pointed out that if the Towns did not wish to form a district for this that they would have to pay for complete sewer facilities at alater time as they would no longer be eligible for the 90% federal funding. He further noted that if Mansfield wishes to continue without Norton that an interceptor would still be required in Norton which would mean an easement around the Reservoir, which can be done by Town agreement or it can be done by Legislature. If the Towns agree to form -5 - Minutes September 25, 1974 this district I they will be eligible for the 90% funding this could be done by legislature under Chapter 6$5. Norton Selectman Patenaude noted that the problem in Norton is that it lies in the decision of the voters and that in 1973 there were two articles for this which was voted down, as they did not want to get involved in funding at this time. Mr. McMahon noted that if this is done on a regional basis it can be done on modular fashlon; where the Town's are assest. Norton Selectmen Patenaude noted that this year there was nothing presented at the Town Meeting in regards to this and noted that the State has not been helpful to Norton in the years in which they have complained about Mansfield's affluent in the Resevoir Lagoon. Mr. McMahon noted that when the problems of the Lagoon had arfsen that Norton was dealing with the State Health Department and not the Water Pollution Control Division. Selectmen Patenaude questioned if the plan submitted in the report was the actual proposed location of the plant in Norton or just approximate as it was in a residential area and would be running into a well site in Norton and noted that there is the area of the Miles Standish State Property that would be an excellent location for such a site. Mr. McMahon noted that this was an approximate site. Foxborough Selectman Kevin Sullivan stated that it was his understanding that Foxborough was willing to go into a tri -town system with Mansfield but Norton wanted no part of it and that he also understood that if all three towns did not agree the tri -town system could not be proposed. °Selectmen Titus noted that it is not necessary that the Towns join and that this was the reason for the meeting tonight teeau -Mansfield would like to take further steps if the other two Towns do not wish to proceed. Mr. Frank Fortin of the Foxborough Regional Sewer Study Committe noted that Norton and Foxborough had tarried through and appointed a committee to study this and it was put on the agenda for the Town meeting of both Towns and once it was voted down that there was nothing they could do until the State gave them alternatives, which they did not do. Mr. McMahon pointed out that, in order to be eligible for funding, you have to have a ba3in plan and that once this plan is approved it can not be deviated from. Mr. McMahon noted that if Foxborough does not want to join the regional system, in the future if Foxborough wants to allow additional growth they will have to enlarge with their own money. Mr. McMahon noted that if Norton will not allow a treatment plant in Norton, then they will have to spend their own money for an interceptor to bring their affluent up to the Mansfield plant. Mr. Alan Willis, Mansfield representative of the Regional Sewer Study Committee noted that the plans for this had been done by Anderson -Nichols and that Mansfield has acted in good faith to get a study committee together and attend various meetings and when Norton was called to attend these meetings Mr. Dugan, the Executive Secretary for the Board of Selectmen stated that he was the representative for Norton and noted that it was mandatory by the State that a three member committee be formed in each Town. Norton Selectmen Patenaude noted that when this was first started that they had a three member committee and this was why monies were appropriated in the beginning, however, the committee dissolved after it was voted down at Town Meeting. Mr. Fortin noted that it is not mandatory from the state to get this Committee but it was a requirement under the river basin plan and there has been no mandate since the report was completed. MC. Fortin noted that at no time have any of the three Towns been advised that they would not have to put up money Minutes September 25, 1974 at all to join a regional sewer district. Mr. Bob Morini of Camp,Dresser McKee questioned if they were ever informed that if the Raver Basin was not formed that they would not be eligible for funding. It was noted that they were informed of this. Selectmen Titus noted that lack of communication and information is one of the reasons this meeting had to be called and hoped that things could be completely understood from this point. Mansfield Selectmen Caponigro questioned if Foxborough felt they wanted to go regional. Mr. Fortin stated that at no time did he inform the State that Foxborough did not want to get into this. Mr. Fortin pointed out that they are a voluntary committee who has to work this in whereas the State is getting paid to review this and felt that Mansfield should not have had to ;approach the state but the State should have come up with a solution to Mansfields problems. Mr. McMahon noted that the federal government has just changed their standards under the 303 and that the state could take no action untfl this was changed. Mr. Morini noted that the public law 92-500 has done more to bog down the Water Pollution Control Division than to help it. Mr. Forton questioned if it is mandatory that a proposed system conform to the standards of the Division of Water Pollution Control and if the affluent has to go into a stream or if there can be in -ground systems. Mr. McMahon noted that they have to conform, however there are some systems acceptable that are in -ground systems. Mansfield Selectmen Levine noted that if Norton and Foxborough are not interested that Mansfield would like very much to establish a one town regional sewer system, and if Norton is not interested in granted easements, Mansfield has (, to make the decision whether they shoOld go before the legislature and take the land by eminent domain. Norton Selectmen Patenaude questioned how long it has been available for Norton to particrlpate without involving any money. Mansfield Town Manager Hannon noted that it was pointed out in 1972 that other options were available to the Towns by Camp, Dresser, McKee. Mr. Morini pointed out agreements with various Towns in which funds were not paid until the system was needed and they hooked into the regional system. Mr. McMahon noted that the main factor to this _proposal will be Norton ,as the interceptor has to go through Norton and noted that the Special District could be set up through legislature to allow Mansfield to build in Norton under Chapter 41 funding, and questioned how Norton felt about a regional sewer in their community. Selectmen Titus questioned if the towns would be willing to appoint three members to a committee to continue the study. Norton Selectmen Patenaud stated that his Board would take an interest in Norton's partleipation. Foxborough Selectmen Sullivan stated that they would be very interested in activating the committee and that the committee should bring back the options to the Town. Selectmen Titus questioned if the other towns would agree to meet again two months from this meeting. Norton Selectmen Patenaudestated that he felt that the committee should report to the Selectmen for Town Meeting. Selectmen Caponigro felt that £t is very important for the three Board's of Selectmen to make a decision and recommendation on this. Selectmen Patenaude felt a time 111int of 2 weeks be given to establish the committees and put a time limit of 2 months for the committee to report to the Selectmen. This was agreeable for all three Towns. This meeting adjourned at 9:40 P.M. Planner Parsons entered the meeting during this discussion. ®7® Minutes September 25, 1975 17.
