5) Board met with Attorney Bernard Martin and Mr. Charles Boutas regarding
the Green Acres definitive subdivision plan for land off of Franklin
Street. Attorney Martin advised the Board that he had contacted the
Town Clerk and the Town Clerk cialms he has no previous correspondence
regarding this subdivision. Attorney Martin asked what the Planning
Board was requiring Home Developers to do with respect to the drainage
of the subdivision. Planning Director Maurer advised him that the
definitive plan as submitted showed a retention area which would limit the
flow down stream and the Planning Board felt that since the problem with
the drainage in the area was at Winter Street that it might be more
advisable to solve the problem down stream than create a retention area.
The Planning Director also noted that the plan was submitted as a
definitive plan and that the Board did not have the opportunity to review
it in the preliminary stages. At Martin noted that his client was
having problems getting the easements down stream as was requested by
the Board. Mr. Boutas stated that he had not approached the owners
personally but Ralph Maloon had advised him of the owners reluctance to
grant easements.
Mr. Martin requested all correspondence on this and would like to meet with
the Board in two weeks to discuss this further.
The Planning Board felt that a detailed letter should be sent as a cover
letter for this correspondence.
6) Board met with Harry Connors and Lou Guerriere to discuss the definitive
subdivision plan for Mansfield Industrial Park Realty Trust. The Board
reviewed the Form A Plan which was also submitted which took land from the
Francis Avenue Right-of-way and established it as a lot. 'Board noted on
the Form A Plan that the zoning classification would have to be added to
the plan and the name of the record owner changed to Mansfield 'Industrial
Park Realty Trust. The Board noted to Mr. Conners the compliance to the
Planning Board's letters of July ;11, 1974, August 9, 1974 and August 23, 1974,
and discussion was held as to how the developer would preserve the trees
along the railroad tracks. Mr. Conners noted that he had sent a letter
to the Planning Board and would send copies to the'abbutors to note their
intent to maintain a buffer.
Planning Director Maurer noted that on the approval of the subdivision plan
it should be done in 2 stages. The first stage would be the apppoval of
the definitive subdivision and the second stage would be the amendment to
the subdivision plans endorsed on September 13, 1973 relative to the rail-
road tracks.
Motion: To approve the definitive subdivision plan for Mansfield Industrial
Park Realty Trust for land off Francis Avenue and to approve the
amendment to the subdivision plan endorsed September 13, 1973
relating to the railroad tracks.
(Wellington, MacFarlane, all in favor) VOTED
7) Planning Director Maurer noted that Mr. John Adams of Dedham Construction
would be meeting with the Board regarding Twin Oaks Apartments, and he will
be submitting a Form A plan to divide the parcel into two lots, one with the
apartments and one as vacant land. Planning Director Maurer noted that the
land was part of the Board of Appeals decision and may be covered by this
decision and that before making any decisions on this it would be advisable
to obtain an opinion on this matter from Town Counsel.

Minutes
September 4, 1974.
8) Board discussed the letter from Richard Steinert of Owens-Illinois relative
to grease traps. Planner Wellington noted that the design was prproper
design. Question was raised as to whether the construction would be
concrete or steel. Planner Wellington felt it would be concrete because
of its thickness. It was the consensus of the Board that this should be
constructed of concrete.
Motion: To approve the design of the grease traps provided the construction
is concrete.
(Latham -Parsons, all in favor) VOTED
9) Board endorsed the zoning recommendation of Gelino G. Repucci as voted
under item #9 of the minutes of August 28, 1974.
10) Board met with John Adams of Dedham Construction regarding a Form A for
Debra Ann Realty to divide a parcel of land on Oakland, Swett, and Shield
Streets into two lots. Mr. Adams noted that the property in question
%las approved by the Board of Appeals for 145 units of which 142 units
have been constructed. Of the 142 units 130 are presently rented. Mr.
Adams noted it was the€i intent of the developer to divide the parcel and
sell the 142 units and keep the land and at a future date submit plans
for an additional 56 units. Mr. Adams requested that the Board sign the
plan. The Board advised him that it was not their policy to sign a plan
the first time that they see it as they have to review the plan before
endorsing it.
Planning Director Maurer advised Mr. Adams of his concern on the legality
of dividing the lot and that he recommended to the Planning Board to obtain
a legal opinion on dividing the land.
The Board discussed writing the letter to the Town Counsel regarding this
application. Planner Wellington noted that the Planning Director should
review the plan in detail as to dimensional requirements with previous
plans submitted.
Motion: To send a letter to Town Counsel regarding Debra Ann Realty.
(Latham -Dunn, all in favor) VOTED
11) Board reviewed the notice of hearing on the application of Benjamin J.
Grudinskas to convert a two family dwelling to a three family dwelling
at 58-60 Shawmut Avenue. It was noted that the lot contains ).1,400 square
feet. Planning Director Maurer to obtain more information for the Board's
review at the next meeting.
12) Board discussed the 1974 Fall Conference of the Massachusetts Federation
of Planning Boards. No members of the Board $ndicated their desire to
attend the conference. However, they will wait for the official notice
before making a final decision.
13) Board discussed the letter from Margot Jellinek regarding the earth removal
for pond excavation. Planning Director Maurer advised the Board that the
Conservation Commission had sent a letter to Town Counsel requesting an
opinion regarding the interpretation of the Zoning By-law, which gives the
Building Inspector the authority to issue permits for excavation of earth
removal for landscaping. it was the Town Counsel's opinion that, with
respect to Kingman Pond, the Building Inspector could issue a permit as the

earth removal operation is incidental to the intent of the entire project,
which is pond restoration. Mrs. Jellinek noted that her ;intent for writing
the letter was not with respect to Kingman Pond but to prevent others
from utilizing that opinion as a way out of getting a formal gravel permit.
The Board advised Mrs. Jellinek that it would be impossible to advertise for
a zoning amendment on such short notice and that the matter should be studied
more.
14) Board discussed the Planning Director work program. The zoning and subdivision
parts of the program will be on going Planning Board Projects. It was
suggested to add to the zoning amendments the possibility of amending the
earth removal regulations and the subdivision requirements add the requirement
to show bench marksof: the hydrants on_`"as built" pland."
Capital Improvement Program will also be an on going program and it was suggested
that the Planning Board work out a priority system for projects. Planning
Director Maurer noted that the street improvement projects which were com-
pleted this year were not consistent with what the Capital Improvement
Committee had recommended and felt that the Planning Board should make
detailed recommendations on specific projects.
Comprehensive Planning P=rogram - Planner Wellington fait that much of
this information was contained in the Town Report and should be up dated
as a matter of procedure.
Street Acce av, Pro ram.- Discussed the acceptance of streets in Magna
( Vista and .` `t was noted that the Planning Board had plans of
the streets inVis a these could possibly be used for street
acceptance. In `"' ;PSta they may.have to be resurveyed. Planning Director
Maurer to obtain this information for the next meeting, it was noted
that Brookside Drive, Leonard Street, Leonard Circle, and a portion of
Bonney Lane would be ready for acceptance at the next town meeting.
Fire Department Needs - Planning Director Maurer felt that a evaluation
should be made on Fire Deparmen.ts`needs because the question of the fire
station would be coming up in the near future and, in accordance with the
Charter, the Planning Board would have to make a recommendation on this.
Planning Board should have detailed information on this to make a proposal:.
Airport - Discussion was held on the airport expansion.
Vertical Control and ObtainingEleaations on Culverts - Planner Wellington
noted that if the culverts are going to be tied in to make sure the Town
Engineer closes the loop on the elevations to be established.
Hodges Brook Evaluation - Planning Director Maurer advised the Board that
clerk Grant is preparing a map which shows Hodges Brook from West Street
to the Norton line and the maps are 200 scale and shows all of the
property lines, as well as the Camelot at Mansfield subdivision. Planning
Board can use the plans with 'respect to a decision on Hodges Brook. Chairman
Zaffini noted they walked the site and noted the two culvertsand that the
water at the culverts were standing and that one culvert was dried.
Planning Director to get addtional information on this for discussion next
week.
It was the consensus of the Board to have the Zoning, subdivision and Capital
Improvement Program priority items, along with Street Acceptance, Hodges Brook

Evaluation and that the Planning Board obtain the information with
respect to Fire Department standards.
15) Planner Latham questioned if the Town had made their formal accounting
of Revenue Sharing Funds.
16) Planner Latham questioned the status of the Fulton Pond project and it
was noted that the Conservation Commission gave the contractor an extension
and the Town has received a portion of their gravel and that a partial
payment had been made.
17) Planner Latham questioned the status of the Witch Pond Well. It was noted
that the bidg had been received on the last section of the water main
installation along Williams Street and Plain Street and that now the
project was approximately$100,000 short and they would have to go to
Town Meeting to appoopriate the balance. It was also noted that the
building is almost complete and they are waiting for the pumps and the
control panel. Chairman Zaffini+ said that they should find out why it
took so long for the control panel.
18) Planner Latham questioned the status of the South Main Street project.
Planning Director Maurer noted that the bid had been let but was not
certain when it would start.
19)
Planner Dunn asked the Boards opinion as to how the money should be spent
at the Special Town Meeting. Planning Director Maurer noted that approximately
$825,000 in free cash was available and that he thought the recommendations
of the Town Manager and Selectmen would be to appropriate $100,000 for the
completion of Witch Pond Well and $400,000 for the intial;planning of the
Dustin Well and $25,000 for the Street Sweeper. The balance would be used
for the deduction of the tax rate. Whitmand and Howard has advised that,
f
at todays prices, the cost oDustin Well would be $7 5,000, which would
connect to North Main Street to the Central System. The$400,000 suggested
by the Town Manager for appropriation takes the water main only to East
Street. Planner Wellington felt that it was a mistake to lower the tax
rate the gust three years with so many projects facing them and that if they
has used the money properly they could have had major projects under way
with Federal funding. Planning Director Maurer noted that the balance'of
the money for the Dustin Well project would be put on for the Annual Town
Meeting, it was noted that there would be a substantial increase in cost
from waiting to do the project.
Planner Dunn asked for a consensus of the Board as to how they felt the
free cash should be spent. It was the consensus that they were in favor
of the Witch Pond Well, the Street Sweeper, and as far as possible with
the Dustin Well.
20) Planner Wellington questioned the letter sent to the Town Manager regarding
catch basin cleaning and he was advised that a letter had been received from
the Town Manager stating that the contract was not let yet,
21) Planner Wellington noted that a meeting was proposed with Edgar Vernon on
Leonard Street, Chairman Zaffini to notify Mr. Vernon that they Board will
meet atthe site at 7:00 p.m. Wednesday Night prior to the regualr meeting.
Minutes
September 4, 1974
22) Planning Director Maurer noted that Ryan, Elliott and Company had requested
E a release of additional funds and the Planning Director will prepare a detail of
funds for the next meeting,

(Wellington -Latham all in favor) VOTED
4. Board discussed the warrant of September 17, 1974 in the amount of $124.94.
Planner Latham questioned why the Planning Board was being charged for
gasoline for the Town Managers vehicle. Planning Director Maurer noted
that he has not used his car for town purposes 'since the first of the year
and that he was using the Town Managers car on occasion so the Planning
Board would be billed once in a While for the gasoline, which would be
cheaper for the Board as the current rate for using their own veh1cle is
presently 12t a mile. Planner Wellington noted that the Plenn'ng Director
had been advised to purchase the gasoline at the Highway Department and
not the Electtic Light Plant. Planning Director Maurer noted that each
vehicle is assigned to a place to acquire their gasoline and the Town
Managers vehicle is assigned to the Electric Light Plant.
Motion: To approve the warrant of September 17, 1974 in the amount of $124.94.
(Grant -Latham, all in favor) VOTED
5.. Planning Director Maurer advised the Board that the Form A Plan for
Mansfield Industrial Park Realty Trust had not been returned with the
( required corrections.
6. Board reviewed the Form A Plan for Debra Ann Realty Corp, for land on
Oakland Street. Planning Director Maurer noted that he had sent a letter
to Town Counsel for an opinion on this and had not received a reply on
this as Town Counsel was on vacation. However, a verbal reply has been
obtained and Town Counsel advises that the plan ;be cross-referenced for
both lots 43 and 44 to the Special Permit and that this is a requirement
of the Subdivision Regulations with respect to a Form A Plan. The effects
of this would be that lots 43 and 44 would be subject to the Special
Permit that was granted by the Board of Appeals. Planning Director has
noted to Town Counsel that the density is lower than was allowed by the
Special Permit. and Town Counsel advised that this would not matter.
Planning Director Maurer advised the Board that he has reviewed the
dimensional requirements with respect to the plan that was submitted
to the Board of Appeals and noted that the buildings are fairly close
to what was proposed and that the lot conforms to the zoning by-law.
It was noted that Town Counsel would be back from vacation in time to
submit a letter for the next Planning Board Meeting.
Mr. Adams, representative of Debra Ann Realty, came before the Board and
explained that the two parcels would be sold to the same _person and that
the dividing of the parcel is to describe the property when recordingit.
Then, when and ,tf+:;the special permit for the additional 60 units is
granted the applicant would have the right to build the 60 units on the
second parcel. Mr. Adams noted that the Board of Appeals did not
advertise the hearing correctly and that it will have to be advertised
again. Mr. Adams stated that he had no objection to noting the reference
to the Special Permit previously granted on the plan. Plan to be returned
to have this note added.

7. Planning Director Maurer advised the Board that the definitive plan for
Camelot at Mansfield was submitted wednesday afternoon and that he had
not had the opportunity to look them over. However, he noted that the
written letter granting the easement from Smith had not been submitted
with the plans. Planner Wellington noted that a date should be set for
the Public Hearing so that the decision will not have to be made at
the same meeting as the Public Hearing.
8. Board discussed the Street Acceptance Program. Planning Director Maurer
advised the Board that the streets that will be ready for acceptance this
year for which they have plans for will be Bonney Lane, Leonard Street
and :Brookside Drive, Board reviewed the lines for the streets within
the Magna Vista Subdivision. Planning Director Maurer noted that the
linen could not be recorded as there was no surveyors stamp on them.
Planner Latham questioned if the hearings for these were going to be
joint or separate and it was noted that they would be joint. Planner
Wellington noted that the name of Laurie Lane had been changed.
Planning Director Maurer questioned if the Board could go back to the
original engineer and have him stamp the plans and check the bounds.
Ittwas noted that there was only $1600 in theaccount for this work.
It was noted that the engineer had changed during the construction and that
Mr. Freeman was the engineer who did the actuali work and set the bounds
and questioned if Mr. Freeman could be approached for this purpose.
Board reviewed the plans for Bellview Manor and it was noted that there
( - was no linen for this plan. It was further noted that there was no
engineering stamp on these plans and the original surveyor was deceased.
Planner Latham questioned why they were accepting the old streets as long
as the Town is maintaining them anyway. it was noted that the intent of
the program was to start with the newer streets in Town and work their
way back so that all Todds in Town are acdepted. Planner Wellington noted
that there should be a plot plan on record at the Registry of Deeds and
questioned if the street layout plan could be eliminated and record a
reference on paper to the plot pian on file. It was the consensus of the
Board to check with Town Counsel and the Registry of Deeds on this matter.
9. Board met with Margot Jellinek who advised the Board that Article 41 Section
81 BB gives the Planning Board the ,authority to disapprove a proposed
subdivision plan as being inconsistant with the Zoning By-law which has
been adopted by the Town not yet approved by the Attorney General.
Mrs. Jellinek noted that the Board had received a letter from Town Counsel
stating that it can only be disapproved underthe old regulations for
Vazza Property and Wading River Park and noted that the;; plans for these
two subdivision should have been disapproved under the amendment regarding
water setback, and instead of the Board asking for amended plans they
should have asked for new plans for the good of the Town.
10. Board discussed the Hodges Brook evaluation. Clerk Grant presented a plan
showing the brook and noted that the assessors mapsare fairly close in the
location of the Brook. Clerk Grant noted that if the Camelot subdivision
does get an easement from Smith that they would still have to get through:
the Cabot, Cabot and Forbes property to enter the Hodges Brook unless there
is an old location of the Brook that does not show on this plan. Clerk
Grant noted that he has a plan done by George Poor which shows 3 culverts
in the School Street section instead of 2. Chairman Zaffini stated that
the drainage master plan shows two 4 ft. culverts and a 5 x 8 arch. It

was the consensus of the Board to walk the area of the Smith property
to try and locate any section of the old brook on Sunday, September 22,
1974 at 7:00 a.m.
11. Board discussed the Zoning Amendments. Planning Director Maurer presented
a proposal to the Bo rd on the elimination of the cumulative effect and
advised the Board that other proposals for different sections would be
submitted later for their review.
12. Board raviewed.the memorandum from the Planning Director regarding the
Mansfield Industrial Park Realty Trust bond release.
Motion: That no monies be released to Mansfield Industrial Park Realty Trust
until more work is completed.
(Wellington -Dunn, all in favor) VOTED
Planning Director Maurer advised the Board that the figures for the bond
compared to the work to be completed is close as the price has increased
considerably since the bond was posted. Chairman Zaffini noted that the
10% contingency should be increased as the bond has been held for a period
of one year. Planner Latham noted that this should be put into the
subdivision control regulations to make this increase automatic.
13. Board reviewed the Board of Appeals notice of hearing for Benjamin J.
Grudinskas to convert a two family dwelling to a three family dwelling
at 58-60 Shawmut Avenue. Planning Director Maurer noted that the
applicant did not reside there and it is an income so no hardship could
be claimed.
Motion: To recommend that the variance not be granted as two family
houses should remain two family and single family houses
should remain single family homes.
(Latham -Dunn, Wellington Grant Zaffini in favor, MacFarlane opposed)
VOTED
Planner MacFarlane stated he was opposed because he did not like the
statement.
14. Board reviewed the articles for the September 16, 1974 Special Town
Meeting.
Article 1
- The wording was not approved by the director of accounts
after the previous Town Meeting so it is being amended.
Article 2
- requesting monies for the completion of the Witch Pond Well

Article 3
- This is to transfer the money from the surplus revenue account
to stabilize or lower the tax rate. -Planning Board felt this
Article was not in the proper order.
Article 4
- This is for the Dustin Well project and there was a handout
presented to the Board from the Town Manager on this regarding
the alternatives the Town can take on this item. It was noted
that it was the unanimous opinion of the Capital Improvement
Committee that the whole project be finance this year either

opportunities. Planning Director noted that this is for

the Town of Mansfield to lease Town property. Planner
Latham noted that they would need a variance to construct
such a sign.

has previously submitted a recommendation on.
Article 1 - Board in favor
Article 2 - Board .in favor
Article 3 - Board felt should come after Article 7 and that no monies
should be used to lower the tak rate, Planner Wellington
noted that they are asking for budgets to be submitted and H
they have only used two months of the -;new -budget and that
the>Selectmens:Association -should be-;petitioned:to bring ,the
Towns back to closing the budget at the end of the year instead,
of the middle of the year so that they would know how much money
was left at the Annual Town Meeting instead of holding a Special
Town Meeting for this purpose. Planner Wellington noted that
the Town Manager is, requesting the 1975-76 budget too early.
Planning Director Maurer, noted that the; Charter: gives the Town
Manager a deadline for the submission of his budget. Planner
Wellington felt that the Charter should be amended, if that is
the case.

Article 9 - Beard opposed due to sign regulations and the Town leasing
the land.
Article 10 - Planning Board has already submitted their recommendation.
15. Board reviewed the Memorandum prepared by the Planning Director for a
bond estimate on the remainder of work for Brookside Estates, after the
Tn:i:t;i.al.'" coat of black top. it was noted that the only bond issued in
Brookside estates was for Brookside Drive and all has been release except
the 10% contingency. It was noted that the water and drainage and utilities
had been installed without a bond. Planner Wellington felt that the 10%
contingency should be on the whole package to guarantee the drainage and
water. Planning Director Maurer felt that provisions should be made for
this in the regulations. Planning Director Maurer to check to see if this
can be done. Planning Director Maurer noted that on Brookside Drive
there is a piece of sidewalk that was broken when an individual drove
over it and felt that the developer could not be responsible and that
the board should advise the individual that he is responsible for this.
It was the consensus of the Board that the developer who posted the bond
is responsible as he owns the property until it is accepted at Town Meeting
and that the developer will have to work things out with the individual
Motion: To send ,a letter out to the developer informing him that he is
responsible for the repair of the sidewalkand that this would
have to be corrected before the 10% contingency is released.
(MacFarlane -Dunn, all in favor -VOTED
planning Director Maurer noted that in.other subdivision, such as
Millettes, the bonds have been released ;including the 10% and the Town
has not accepted the street yet and questioned who would be responsible
in this area. The Board felt the developer would still be responsible
as it is private owned property until the Town accepts it. Board
considered the possiblity of hold the 10% until the first annu4I Town
meeting after the year was up and if the street is not accepted by the
Town at that time then release the 1;0%. Board felt that the 10% contingency
for the entire subdivision should be put on the list of changes in the
Subdivision Regulations and felt that it could not be incorporated into
this bond. Planner Dunn noted that if the Regulations did not state 10%
that they could increase the percentage of contingency. Planning Director
Maurer advised the Board that this subdivision falls under the old Subdivision
Regulations.
Motion: To advise the developer that the amount of the bond will be
$35,536.05 for the two sections with separate 10% contingencies
for each section and to advise the developer that the bond will

if too high on a $600,000 project. Planner Latham questioned why this could
not be put out to bid. Planner Wellington noted that engineers are not
