Motion: To sign the warrant of August 27, 1974 in the amount of $116.09. (Parsons -MacFarlane, all in favor) VOTED -3 -- Minutes August 21, 1974 8. Board met with James Antosca and Engineer Ralph Maloon to discuss the proposed definitive plan for Camelot at Mansfield. Engineer Maloon stated that they wished to meet with the Board to see where the plan stands as far as the drainage is concerned. Planning Director Maurer noted that they are still waiting for an easement from the Smith property. Engineer Maloon stated that this is being worked out and that plans will be ready tomorrow. Planning Director Maurer noted that the second item of concern was the ;proposed retention area, and that Mr. Antosca was to check into a solution to the problem that would be long ranged. Mr. Antosca noted that initally the Board had asked him to do a drainage study on volocity of water in the Hodges Brook, and if there was a large increase, which there was, to put in a retention area. The reason for this request being a communication with Cabot, Cabot and Forbes as they could not be responsible for water in the brook caused by other development. Mr. Antosca noted that the Board mentioned a solution to do with the land the Town acquired around the Hodges Brook and noted that he would go whichever, -way the Board suggested. Mr. Antosca stated that he did not feel it was his responsibility to make a comprehensive drainage study down stream and did not feel it was his responsibility to make an agreement with Cabot, Cabot and Forbes, however he would like to do whatever is acceptable. Mr. Antosca stated that if the Board would tell him what they are looking for he will do it. Planning Director Maurer informed Mr. Antosca that there has been much concern about the ditch dug to the pond and requested him to fill it. Mr. Antosca noted that he has had no machine activity in the area because of the stump dump situation and that he had been to the Board of Health the evening before to resolve this. He noted that the Board of Health gave approval of the additional stump dump in the vicinity of the old one and requested that it be shown on the plans so he would now instruct his workers to fill the brook by the first of next week. Mr. Antosca stated that he would ;hike to find out where to go on the drainage and suggested that they continue with the plans for the retention area until they come up with a conclusion down stream. Planning Director Maurer questioned if it was possible to build a drainage system and then review it to see if the retention area is necessary. Engineer Maloon noted that the drainage design would be the same with or without the retention area, so that the drainage could be put in and then cut in the retention area later. Mr. Antosca stated that he could post some kind of a bond for that in the event that the land is sold or if they back out. Board questioned the easement from Smith. Mr. Maloon noted that it would be a 50 foot easement for a right of way in return Mr. Smith would give them the drainage easement necessary. Planning Director Maurer noted that in the Planning Board's letter of May 2nd the only two items in question is the easement from smith and the one on the Hodges Brook. Mr. Antosca stated that he felt they should provide the drainage area and then by-pass it until it is necessary and bond it so that if the developer doesn't do it funds will be available. Chairman Zaffini stated that the Board would have to discuss this amongst themselves. 9. Board met with Ernest White, Attorney, Ralph Maloon, Engineer and Robert Eames, Applicant, to discuss the preliminary plans for Woodland Park. It was noted that an extension had been granted until September 1, 1974 and that there were only three^items which remained to be complied with as of the last meeting, it was noted that the zone classification line was corrected. Attorney White presented proposed plan for a new layout of the road in the vicinity of the Shaw property so that he would not be affected by elimination Minutes August 21, 1974 of the paper streets. Mr. White noted that they propose an island or other means of slowing traffic at the large entrance to the development from Fruit Street, which would also make the entrance attractive. It was noted that lot- 25 was eliminated and the lot Lines straightand out. Clerk Grant felt that there should be a detailed Jr on the entrance when the defintive plans are submitted, and an enlargement of this should be submitted with the definitive plans. 10. Board discussed the plans for the Great Woods Development. (Clerk Grant left the room and did not participate in any discussion.) Planning Director Maurer presented the Board with a plan outlined in red of which the state had taken the land. it was noted that there is still one entrance way into the ,proposed development from So. Main Street. The State has taken 41 acres of land. Planning Director Maurer informed the Board that he talked with Town Counsel and Town Counsel suggested that the Planning Board write a letter to the applicant advising him that the Board is aware that the State has taken the 41 acres, referring to the Book and Page number on the deed, and that before further consideration to the subdivision the Board will require the applicant to make the changes that are necessary on the plan. Motion: To write a formal letter to Town Counsel and get his written opinion before writing to the applicant on this matter. (MacFarlane -Parsons, all in favor) VOTED 11. Board reviewed the Form A Plan for Benjamin Boynton for land on Essex Street. (Clerk Grant leftthe room and did not participate in any discussion.) It was the consensus of the Board to sign the plan at the next meeting. 12. Board reviewed the site plan for U.S. Plywood for land on Hampden Road submitted in accordance with site plan approval requirements. Planning Director noted that this lot did not legally need site plan approval, however, the Building Inspector forwarded them to the Planning Board for any comments. Planning Director Maurer noted that they do not have a,,requirement with Cabot, Cabot and Forbes for grease traps however, in this instance, there should be a requirement as they have their own gas pumps and such. It was noted that the setback requirements comply with the zoning. It was the consensus of the Board to write to the Building Inspector and recommend that grease traps be installed in the catchbasins. It was the consensus of the Board to write to Cabot, Cabot and Forbes and advise them that the Board is now requesting grease traps on all catchbasins in the vicinity of manufapturing buildings. (Clerk Grant left the room and did not participate in any of this discussion.) 13. Board reviewed the letter from the Mansfield Industrial Development Finance Committee regarding the increase in size of the building from 50,000 square feet to 125,000 square feet and the increasethe estimated cost of the project from "not more than $3,000,000" to"not more than $4,000,000," for the Codex Corporation. Motion: To send a letter to the Mansfield Industrial Development Finance Authority with favorable recommendation for the amendment to the Mansfield Industrial Development Finance Authority vote for increase from "not more than $3,000,000 to "not more than $4,000,000. (Grant -MacFarlane, all in favor) VOTED (Planner MacFarlane left the meeting at this time.) -5 - Minutes August 21, 1974 14. ,Board discussed the Board of Appeals notices for Public Hearing for George H. Genereux and Nelson R. Doore. It was the consensus of the Board to hold these applications until the next meeting and have the Planning Director obtain copies of the assessors maps for these parcels in question. 15. Board discussed the drainage situation for the proposed Camelot at Mansfield subdivision. Planning Director Maurer felt that the Board should spend some time next week and really look into it so that a recommendation can be made to Mr. Antosca. Planning Director Maurer noted that now that the Town has taken the step to purchase the land along the Hodges Brook that they might want to take a different look at the drainage and that the corp, of Engineers will be doing a flood:ana.lysjs study, which will include the southern part of the Hodges Brook, from School Street to the Norton Line, which will determine the 100 year flood. Planner Parsons felt that Mr. Antosca has been reasonable and has offered to post a bond on the retention area on his own property or down near the stream, and felt that they should give him some kind of consideration. Planning Director Maurer pointed out that if it is going to cost him $5,000 for a retention area, it would be better to put the $5,000 towards the culvert Planning Director Maurer to obtain maps and related material for this discussion at the next meeting. 16. Board discussed the defintive subdivision plans for Mansfield Industrial Park Realty Trust for which the Public Hearing was conducted. Chairman Zaffini noted that question was raised at the Public Hearing regarding the use of salts on the parking lots and noted that the restriction for salt calls for a minimum amount and noted that there is no way of determining what a minimum amount would be. It was noted that it is recorded at the registry of deedsthat a minimum amount of salt or related products be used. Planner Dunn questioned if there was some way to insure a buffer for the railroad tracks. Planning Director Maurer noted that as long as they conform to the regulations there is nothing to control in the location of the tracks. Chairman Zaffini stated that it was his understanding that Ryan, Elliot and Company has waivered the requirement for screening for Owens-Illinois from their Rules and Regulations and did not see how they could do this when the Town requires screening. Planning Director Maurer noted that even if Ryan, Elliot & Company had waivered it they would stili be required to screen because the Town by-laws take presidence over they parks rules. Chairman Zaffini then noted that Corrafab and Horner Waldorf do not have the proper sc'reeni,hg;; and if Owen -Illinois has unsltely views from Francis Avenue they should be made to screen. Planning Director Maurer noted that the Big It Outlet should be made to screen the new section. It was the consensus of the Board to write a letter to the Building Inspector regarding the enforce- ment of proper screening for Corrafab, Horner Waldorf, and the new section of the Big 4 Outlet, The Board noted that the Plan for Mansfield Industrial Park Realty Trust has not complied with the following: a) public easement not shown on lot 52 in the vicinity of Francis Avenue b) Other lateral connections should be shown for the installation of the sewer line. The Board noted that the following should be requested on the plan as per the Public Hearing: a) Extend the fence to the property of Certuse and down to the end -6m Minutes August 21, 1974 of the tracks. This is to be a stockade fence. b) Note be put on the plan that this is the last plan and only crossing of the railroad and it be a single track only. C) Cross reference be put on for the covenant d) Minimum amount of disturbance of foliage on the buffer zone to the railroad tracks. Motion: To disapprove the definitive subdivision plan forMansfield Industrial Park Realty Trust until the above information is received. (Parsons -Dunn, all in favor) VOTED 17. Planner Dunn noted that hb would not be able to attend the Capital Improvement meeting on August 22, 1974. Clerk Grant stated he would also be unable to attend. Planning Director Maurer noted that after they review the sewer plant that they will discuss the funds for the Dustin Well so that they will be able to have all information ready for the Special Town Meeting on September 17th. 18. Planning Director Maurer noted that the Mass. Federation of Planning Boards will be hold a conference on October 19th, a Saturday, and that they will be discussing an engineers and planners point of view on the subdivision control and felt that it was something the Planning Board should think about attending. 19. Clerk Grant informed the Board he had spoken to Joseph Magaldi, secretary for The Mass. Federation of Planning Boards, who is also an attorney, and in his opinion on the Plan for West Street for Michael Cook, the only decision the Planning Board could have made is whether or not it is a subdivision. If it is not a subdivision the Planning Board has to sign the plan. If the reply had come in from Town Counsel sooner, then they could have noted on the plan that it is not a buildable lot, however, by law, they would have had to sign the pian because it is not a subdivision. 20. Planning Director Maurer informed the Board that he had spoken to Town Counsel and that Town Counsel would be sending a letter out on the status of the Wading River Park preliminary subdivision plan. 21. Meeting adjourned at 11:30 p.m. 22. Mr. Harry E. Connors, Agent for the Mansfield Industrial Park Realty Trust, then appeared before the Board with a request for extension of 14 days from August 21, 1974 for the Planning Board to act on their plan dated June 26, 1974, revised July 22, 1974 and August 21, 1974 by Guerriere & Halnon, Inc. Plan #G552. Planning Director Maurer witnessed the conversation between Mr. Connors and Brad Griffith in which Mr. Griffith gave Mr. Connors the authority to act as an agent for the Mansfield Industrial Park Realty Trust. It was the consensus of the Board to open the meeting for discussion on this matter, Motion: To rescind the motion to disapprove the definitive subdivision plan for Mansfield Industrial Park Realty Trust. (See item 16.) (Parsons -Grant, all in favor) VOTED Motion: To grant the 14 day extension of time before making a decision on the definitive plan for the Mansfield Industrial Park Realty Trust.
