(Wellington -Grant, all in favor) VOTED 4. Board discussed the Preliminary Subdivision Plan for Woodland Park for land off Smiley Avenue and Edgewood Street, The Board also reviewed the memorandum submitted by She Planning Director relative to the comments made by the various department heads. It was the consensus of the Board to send the Planning Directors comments on to the applicant as well as to request the status of the paper streets on the property of Shaw and MacFarlane and to review the proposal of tying the sewer into Smiley Avenue. Board met with Brad Griffith, Henry Conners, and Lou Guerriere to _5. discuss the various plans to be submitted by the Mansfield Industrial Park Realty Trust. Mr. Griffith submitted a Definitive Subidivision Plan for 3 lots to be created off of Francis Avenue. Lot 52 contains 6 acres and will be sold to Baltimore Brush. Lot 54 contains 14.75 acres and it is the developers intent to start the development of a spec. warehouse on this site containing 77,600 square feet. 'Lot 53 would contain 9.2 acres and is still for sale. This lot will not be serviced by rail. Mr. Griffith noted that the drainage from the land will flow into a pipe ,under Francis Avenue, which was approved with a prior subdivision, and there will be several <drainage 'ditches on the various lots. These ditches will be established within easements and not within right-of-ways. Portions of the easements would be public and portions would be private and established only to serve the individual lots. Minutes June 26, 1974 Mr. Griffith advised the Board that a Form A Plan for Baltimore Brush was submitted to the Town ;Clerk on June 25, 1974 and he hoped that the Planning Board would endorse the Plan since they intend to pass papers on the property on June 27, 1974, Mr. Griffith also presented a plan for the railroad tracks across Francis Avenue. He noted that this would serve lot 54 and that a fence would be provided along the property line where the railroad tracks were within 50 feet. He noted that this would be the only additional railroad crossing on Francis Avenue as it was requested by the developer. Planner Wellington noted that lots, 53 and 54 on the subdivision plan do not agree, with the From A and the Form A for lot 52 the drainage ditches are not shown properly. Question was raised concerning the ditches and Mr. Griffith explained that they had done testings on the site and found the water table quite high and that the ditching system would be the most effective way to handle the water. It was noted that the testings found .much trapped water along the site. Chairman Zaffini noted that they had had Hatch Act approval to fill in the swamp;however,'he felt that the wet area was more than just a swamp, - but more of a natural spring as it has been wet year round for many years. The ,Board advised Mr. Griffith that it was not their policy to sign a Form A Plan the first day it is received, ,Mr. Griffith advised the Board that Baltimore Brush was ready to start construction and they would appreciate prompt action. 6. Board reviewed the Preliminary Subdivision Plan for Wading River Park for land on West and Gilbert Streets. Board also reviewed the Memorandum from the Planning Director,; which stated that the pian was the same as previously approved by the Board and that the plan was filed to protect the land from zoning. It was the consensus of the Board to get an opinion from Town Counsel on this matter. 7. Board discussed the revised lot plan application for Robert Rizzo for land within the Wayside Estates Subdivision. (Clerk Grant left the room and did not participate in any discussion.) It was noted that no response had been received :from the applicant. 8. Board reviewed the site plan approval application of Karl Clemmey, for land on West Street. It was noted that the applicant had made the corrections on the plan as requested by the Planning Board. The Planning Director noted that since .the rezoning had not been approved by the Attorney General that the Planning Board should not formally approve the plan until such time as the zoning is approved by the Attorney General, Motion: To send a letter to the applicant advising him that the Planning Board will not make a formal recommendation on the site plan approval application until the rezoning of the land is approved by the Attorney General. (Wellington -Dunn, all in favor) VOTED. -4® Minutes June 26, 1974 9. Board met with attorney Ernest White, Arthur Stivaletta, John Adams, Robert Booth, and James Holland regarding the addition of dwelling units in the Twin Oaks apartments. Attorney White noted that the plan originally approved by the ,Board of Appeals_ provided for 140 dwelling units. He noted that the developer redesigned the site to meet the requirements of the new zoning, which would permit the developer to have 200 units. The new design would make a uniform development of the site. The developer had also purchased more .land which would enlarge the site. He was under the impression that the Board of Appeals was in favor of this enlargement, however.the Board of ,Appeals only gave a permit for 140 units. Arthur Stivaletta reviewed the background of the project relative to changes in the site from what they originally submitted to what the Planning Board finally recommended. Robert Booth explained the layout of the drainage of the site and noted that the drainage system was recommended to him by the previous Town Manager. There has been a question that has been raised whether or not the drainage falls, on Town, land or Private property. 'Mr. Stivaletta noted that they are working out an arrangement with the present owner of the property, Mr. Jackson. Question was raised regarding the impact of the development on the sewer system. There are presently 140 units constructed and another 60 units proposed. The Board requested the developer to obtain information on sewer flow on the impact of the ;sewer on the additional 60 units. John Adams explained that of the '140 units that! are presently constructed` 114 :units are rented. There are 22 children, 11 which attend public schools. He felt that the apartment project was more of an asset to the community than a liability and ;that many of the people living in the area are locating in the community because of the industry. It was noted that the housing is needed in Mansfield becamse, of the industrial parks. He felt that the Town of Mansfield was well balanced between residential, commercial and industrial, Arthur Stivaletta noted that a Massachusetts survey 'showed Mansfield and Attleboro as two of the most manageable Towns in the State of Massachusetts as far as apartment develop- ment was concerned. Attorney White advised the Board that he will not ,proceed with a_ building application for a building permit until the Planning Board makes a recommendation on the _'project. John Adams noted that the tennis court and swimming pool are in ;the process of being constructed and with the other60units another tennis court and club house would be constructed. He noted that of the units constructed there are 88 1 bedroom, 44 2 bedroom and 9 studio. The same ratio of bedroom units will be provided in the additional '60 units, 'Arthur Stivaletta noted that the complex is written up ,in the National Builders Magazine as the apartment complex of the month. RA Minutes June 26, 1974 10. Board met with Robert Chavaree to discuss the definitive subdivision plan for 'Riverside Park. The Board noted that the engineering discrepancies had :been corrected. The Board discussed the letter of intent for the acquisition of Cabot Pond. Mr. Chavaree noted that it was his intent to deed this to the Conservation Commission but did not 'feel that the statement of 'intent was absolutely necessary for the approval of the plan, as he still had to work out an agreement with the Conservation Commission. He also noted that there is an 18 acre swamp abutting the site, which he owns, which may also be deeded I to the Conservation Commission as he has no use for it. Chairman Zaffiniinoted that an easement had been created along the pond and the Boards concern was that if the easement was there then the pond should be in Town ownership. Mr. Chavaree noted that if the easement is a problem it can be removed. IMr. Chavaree`s letter of 'intent was read and Planner MacFarlane felt that it was satisfactory. The Board told Mr. Chavaree that they would take the matter under advisement. 11. Board met with Mr, Karl Clemmey to review the site plan approval application for land on West Street. .Mr. Clemmey advised the Board that the Board of Health approved the leaching field and septic tank were large enough to permit further extension of the building. Question was raised regarding the 30 foot radius on to West Street and Mr. Clemmey noted that it had already been corrected on the site. Board r advised Mr. Clemmey that the Board voted not to make a formal recommendation i on the plan until approval of the rezoning had been received from the Attorney General. 12. Board reviewed the sewer construction plans for the Great Woods Development. (Clerk Grant left the room and did not partidipate in any, discussion.) Board also reviewed a letter from Mr. Vazza in which the Board noted that all items in their letter of December 27, 1973 were complied with with the exception of number 9. Planner Wellington noted that because the plan was now going to be considering connecting to the sewer system that it was a whole new ball game and that they have to review it with respect to the sewer system. Motion: Towrite a letter to Mr. Vazza advising him that they will have to take a more detailed look at the subdivision now that they will be connecting to the sewer system and that the Board considers the whole subdivision once again open for complete review since a major change is being considered.
