Board members Dunn, Wellington, Parsons, Zaffini, Latham and Planning Director Maurer met with David Wisniewski and Dick Steinert of Owens- Illinois at the Owens-Illinois site to discuss several items relating to the project: a. Mr. Wisniewski noted that Owens-Illinois had contacted the Housing Authority with respect to the possibility of swapping land between Owens-Illinois and the Housing Authority in order to square off the Owens-Illinois property line. They felt that by doing this better access would be provided to the conservation land from the Housing Authority land. He noted that restrictions on setback as set forth in the variance would apply to the amended property line. b. Mr. Wisniewski noted that the drainage ditch going into the retention pond from the property had been changed and now goes directly into the retention pond as opposed to paralleling it as was originally proposed. c. Mr. Wisniewski discussed the location of the, fence around the oil storage area and requested that theBoardpermit them ,to cross the ditch directly as ,opposed to following the ditch as was required by the Planning Board. He felt that a maintenance problem would be created for the Town to maintain the ditch with the fence as the Planning Board had ;proposed. Mr. Steinert noted that the grassy within the ditch would have to be cut because it would create a fire hazard and that their insurance people would demand that the grass be maintained. Planner Dunn suggested the possibility of putting a culvert through the entire length of the ditch and Mr. Wisniewski noted this would be an expensive alternative and that they had considered putting a pipe at either end of the ditch but that this would require trash screens to keep people from entering the property. d. Mr. Wisniewski discussed the Planning Board's request to remove the ledge from the floor of the retention area and he ,noted that they would request that the ledge be permitted to remain and that they would loam and seed it. It was noted that they felt there was no advantage to removing the material to the proper functioning of the area. They estimated that it would cost them $35,000 to remove the ledge as requested by the Planning Board. Mr. Steinert noted that if they had found ledge in other areas of the retention area during construction, they would not have taken it out. Board reviewed the site and advised Owens-Illinois they were taking the 4 matters under advisement. -2 - Minutes June 12, 1974 2. Board held their re -organization meeting. Planning Director noted that the drainage and water lines have been installed on Erick Road for the entire length, and that the new bond estimate for the completion of work amounted to $40,065.46, including the 10% contingency. Mr. Stivaletta provided a new Letter of Credit in the same amount as the one being held previously for $41,161.12 and also requested the release of lots 1 to 7 within the Elmwood Park Subdivision. Chairman Zaffini advised Mr. Morley that the Board would discuss this matter and get back to him. 5. Board discussed the bond estimate and lot release for Elmwood Park Subdivision, Motion: To accept the new letter of credit in the amount of $41,161.12 for work that remains to be completed on Erick Road and to release lots 1 to 7 within the Elmwood Park Subdivision, as requested. (MacFarlane -Wellington, all in favor) VOTED 6. Board reviewed the letter from Ryan -Elliott requesting release of $8,897 being held as a performance bond on behalf of Mansfield Industrial Park Realty Trust. Planner Wellington noted that on several trips through the park he noted that the road is horrendous and that the manholes are 5 to 7 inches below grade, and he suggested that the $8,000 being requested be used to do some much needed repair work on the road. Motion: To deny the release of the $8,897 as requested until the road is passable and until a full accounting of the status of the funds -3 - Minutes` June 12, 1974 being held is given to the Board. (Wellington -Grant, all in favor) VOTED 7. Board reviewed the letter from Attorney Ernest White representing Debra Ann Realty Corp. regarding the application to the Board of Appeals for a special permit. It was noted that a letter had been sent to the Board of Appeals on May 29, 1974 recommending that no action be taken on this application as they did not follow the proper procedure in accordance with the Zoning By -Law. A copy of the application has now been filed with the Planning Board. It was suggested that a meeting with Mr. White be scheduled for the Board's next regular meeting. 8. Board discussed holding a workshop meeting for the week of June 19, 1974. Planner Wellington suggested that the correspondence be read at the workshop meetings to keep that up to date and that any Form A's that come in should be reviewed along with any Board of Appeal Applications. He suggested that any subdivision plans could be held off until a regular meeting unless there was a time factor involved, and that visitors be eliminated from the agenda. Planner Latham suggested that the sewer pumps and the Board of Health Regulations be discussed next week at the workshop meeting. It was the consensus of the Board to hold the workshop meeting next Wednesday evening. 9. Clerk Grant read a letter from Anthony Sarro regarding his property at #31 Darby Drive in which he expressed a grievance relative to the condition which d' exists at the perimeter of the lot adjacent to Darby Drive and Lawndale Road. Planner Wellington noted that at one time Bristol Equipment had indicated their willingness to remove the boulders, but that in order to do so, they would have to disturb some trees, which the Sarros did not want done. It was also noted that the radius had changed on the intersection and that the Board should ask Bristol Equipment to reloam for the full size of the radius out to the property line. 10. Planning Director noted that on the Form A plan for Patrick Walsh submitted last week, that the attorney for Mr. Walsh stopped in the, office to say that the original plan had been found and that it had been recorded at the registry. 11. Board signed the Form A plan for Louis Tarsa for land on Williams Street as voted last week. iZ. Board signed the Form A plan for Donald Ranieri for land on East Street as voted last week. 13. Board met with Karl Clemmey regarding his site plan approval. Mr. Clemmey indicated that the corrections had been made on the plan as requested by the Board last week. Clerk Grant read a letter to Mr. Clemmey from the Board of Health indicating their approval. Chairman Zaffini indicated that everything seemed to be in order. 14. Board reviewed the Form A plan for David Clemmey for land on Essex Street. It was noted that the zoning classification was missing from the plan, and that th il book, page and assessors plat should be added to the Form A application. 4 -4 - Minutes June 12, 1974 15. Board met with Ernest White who presented a Form A plan for land on Tremont Street for Albert Bruun. Mr. White asked the Board to waive their usual waiting period on this Form A application if everything was in order and to sign the plan this evening. Motion: To sign the plan in accordance with the Board's rules at their next meeting if the Form A application is properly filled out. (Wellington -Latham, all in favor) VOTED 16. Board met with Ralph Maloon and Mr.-Boutas regarding Green Acres Subdivision on Maple and Franklin Streets. Mr. Maloon presented a plan showing twin 36 x 22 corrugated steel pipe arch which he is proposing to install under Winter Street. He noted that he would be left with 1 foot of cover and that he had 2 alternatives - to leave it with 1 foot of cover and concrete the pipes or repave the road and put down 22 feet of cover. The new pavement would have to go over 225 feet of road. He also noted that the low areas would still shed toward the brook, and that by putting in the ditch, he could get the ponding area on only 1 lot. Several questions were raised by Board members concerning the Westhaver property. Chairman Zaffini indicated that in a letter to the applicant dated April 18, 1974, the Board had asked to see the storm drainage system designed in a manner to keep the water free flowing from the site to Whiteville Pond. Mr. Maloon indicated that he would come back with the information. 17. Ralph Maloon presented the layout for the sewer for Mansfield Great Woods Subdivision (Clerk Grant left the room and did not participate in any discussion( He noted that the layout included two pumping stations. 18. Board reviewed the definitive subdivision plan for Riverside Park. Planner Wellington noted that the contours which were commented on the first time the Board reviewed the plan still had not been corrected. Planning Director noted that the covenant had been submitted, that they had amended lot 7 and made it 7 A, and that he supplied the information on the size of the pipe under Willow Street. it was also noted that Mr. Chavaree had stated that if the plan was approved, that he would deed his rights to Cabot Pond, with the exception of the gravel, to the Town, and that this should be put in writing. Motion: To send the applicant a letter requesting that he;put ''in writing his intentions to deed his rights to Cabot Pond with the exception of the gravel to the Town if the plan is approved; that anote be added to the plan indicating that the plan is being approved only for municipal sewerage and that if any of the lots are developed with on-site sewerage systems, that the plan will have to be re -submitted and re- approved by the Planning Board and the Board of Health; that the engineering discrepancies relating to the contours be corrected; that the trees be removed from the raodway on Basin Street; that any reference to the Smith and Loveless lift station be removed from the plan; and that a note be put on sheet 3 of 3 that the specifications of the sewer lift station shall conform to those approved by the Board of Selectmen. (Grant -Latham, all in favor) VOTED ( 19. Board reviewed the preliminary lot plan for Robert Rizzo for Carriage Lane and Saddle Ridge Lane (Clerk Grant left the room and did not participate in any discussion). Planning Director indicated that Mr. Rizzo would like a letter from the Planning Board voicing any concerns they might have. Planner MacFarlane suggested looping the water line with valves. Planning Director noted that the method or description of the legal documents on the sewer system should be received to see how this sewer district was going to be set up, and that Mr. Rizzo should declare whether this was going to be treated as one lot or a subdivision. It was the consensus of the Board to find out exactly what Mr. Rizzo is going to do, then after the proposal is explained, the Board will make any comments they may have. 22. Board reviewed the application to the Board of Appeals for The Connor Store, Inc. Motion To recommend that the special permit be granted provided that the applicant be required to provide off-street parking in conformance with the:parki.ng requirements of the Zoning By -Law and that the percentage of the lot coverage be in conformance with the requirements of the Agriculture District of the Zoning By -Law; and that the rear yard setback remain as it is because there is insufficient information on what affect this new addition will have on the surrounding property. (Wellington -Dunn, all in favor) VOTED 4 23. Board reviewed the application to the Board of Appeals for William Couture. Motion: To recommend that the variance not be granted because the lot now conforms to the requirements of the agriculture zone. (Grant -Dunn, all in favor) VOTED 24. Planner Parsons indicated that on the field inspection of Owens-Illinois he was disturbed with the poor attitude on the part of the Owens-Illinois representatives. 25. Planner Wellington agreed with Planner Parsons about the poor attitude on behalf of theOwens-Illinois representatives. He also felt that the Board should obtain in writing that if the location of the fence is approved, that the ditch that is within the fence line should be maintained by Owens-Illinois. He further noted that the cleanest way to handle it;would be to pipe it through the 800 feet, then have Owens-Illinois fill the ditch and fence it.; Motion: That the solution for the fencing around the petroleum area be solved by one of the three following alternatives: 1) Fence it the way the Planning Board originally requested. 2) Pipe it for the complete length of the easement and place trash racks at either end. The responsibility for maintenance of the trash racks would be for Owens-Illinois. 3) Three pieces of pipe in as you suggested with trash racks located in the upstream and downstream side and that Owens- 1111„etc would be required to maintain the trash racks as i Minutes June 12, 1974 27. Planning Director noted that he had spoken with the Town Manager about the Penetryn report and that he had been informed that the final report has not come back yet, but should be coming out in a couple of weeks and the Town Manager will get a copy of it for everyone. 28. Planner Latham asked if any word had been received from either the Electric Department or the Brock ton -Ta unton Gas on the gas line installation in Francis Avenue. Planning Director advised the Board that as of this date, no letters had been received back. 29, Clerk Grant noted that he had read where the North Attleboro Planning Board had rescinded approval of some 'subbidivisions which had not begun con4truction within a certain time limit, and suggested that perhaps the Mansfield Planning Board should check into this. 30. Planner Wellington indicated that he had given Chairman Zaffini a copy of the revisions of Chapter 40-A. Chairman Zaffini did not have the report with him but would drop it off to the Planning Director tomorrow so that he could review these revisions. 31.
