that the correspondence listed be referenced to indicate the name;of the
area or developer concerned. It was noted that the letter from Margot
Jellinek to the tPlanning Board be referenced to Russell Taylor.
Motion: To approve the minutes of April 17, 1974 as amended.
(Latham -MacFarlane, all in favor) VOTED
3. Chairman Zaffini noted that there was a meeting scheduled for 9:00 P.M.
with the Board of Selectmen.
4. Planning Director noted that a letter had been sent to Home Developers, Inc.
last week concerning the drainage from Green Acres Subdivision and that Ralph
Maloon had called this week and noted that he was in the process of reviewing
the plan and talking to the people south of Maple Street trying to get some
type of agreement between them and Home Developers regarding drainage from
the site. He noted that he should be in with a proposal next week.
5. Board reviewed the definitive subdivision plan for Riverside Park. Planning
Director noted that the Boar& had walked the property Saturday morning and
felt that the developer should be advised as to some of the concerns of the
Board, such as the handling of the storm water and the drain easement between
lots 26 and 27. Planner Wellington asked if the developer had complied with
the requests of the Board as noted in 'a letter to Mr. Chavaree dated April 2,
1974. Planning Director indicated that he had not. Planner Wellington
suggested that the applicant be reminded that he has had 3 or 4 weeks to
comply with these requests and he felt that the Board should not even consider
the definitive plan, as they were not submitted properly with all the information.

Planner Latham noted that there may not be adequate water or sewer facilities
to serve this site. It was the consensus of the Board to get an opinion from
Town Counsel as to what action the Planning Board could take on a plan that
was not adequately served by municipal utilities and is it the Town's
obligation to provide adequate utilties to service property. Planner Wellington
noted that the Board should get an answer from Town Counsel but that the
Board could not legally use that as a crutch to turn a plan down. It was also
the consensus of the Board to note that if the plan is approved, that it be
approved as shown and if the applicant does not or cannot tie into the sewer
that the applicant re -submit his plans in total, and that that be a condition
of approval. It was also agreed to send a letter to Robert Chavaree informing
him that the Board will not consider any further review of this plan until the
preliminary comments have been complied with in addition to the comments of
the department heads and the comments noted at the public' -hearing.
6. Planning Director noted that no comments had been received back yet from the
department heads regarding Camelot at Mansfield, and that Ralph Maloon had not
been in touch with him:yet to go over the drainage information from C. C. & F.
7. Board reviewed the railroad plan for Mansfield Industrial Park Realty Trust.
Planner Wellington noted that he felt that the additional rail crossing world
not present a problem as the street is not a through street but an industrial
road. It was also noted that the piece of property in question be submitted
as a whole plan, not three different parcels.
Motion: To send a letter to Ryan -Elliott Indicating that because the
development of any portion of the property was dependent upon decisions
made relative to the entire parcel, that the Planning Board would not
approverany one item unless all information has been submitted; that
the crossing of the railroad at the point propose&& s.ten.tative.jy
acceptable and that no formal approval would be granted until a
completely engineered plan was submitted to the Planning Board relative
to the following:
1. The definitive subdivision plan serving allthe land area south of
Francis Avenue. This plan will include all the information relative
to storm drainage, sewer, water and the respective connections to
the utilities in Francis Avenue.
2. The pipe system for the drainage on the northerly side of Francis
Avenue to handle the water from the proposed subdivision street.
3. The removal from the Francis Avenue right-of-way land that abuts
the Hoerner -Waldorf property on which the railroad Line will run.
The Board feels that since the railroad track will be on this
property that the property should not be owned by the Town, but
rather by either the developer or the railroad. The width of
the right-of-way along this section of Francis Avenue will be as
per the subdivision requirements of 60 feet.
4. The detail design of the railroad plan showing the crossing of
Francis Avenue as well as all of the proposed future extensions
within the area south of Francis Avenue. Thegrades and elevations
of the railroad should be shown with all appropriate drainage
facilities.
5. The Planning Board will require a buffer zone along the easterly
property line in order to screen the railroad from abutting land
owners. The buffer can be in the form of either a natural buffer
of trees between the residential area of 50 feet or a 6 foot high
fence.

8. Planning Director noted that he spoke with representatives of Ovens -Illinois
Yesterday relative to the retention area, and that Owens-Illinois noted that
they did not intend to bring the peninsula in the retention area down to a
grade equivalent to the floor of the retention area because ledge was
encountered during the gravel removal operation. He also noted that Owens-
Illinois stated that if the Town wanted the rocks out of there they could
get them out themselves. The Board referred to the letter of December 6, 1973
where they approved the enlargement of the retention area. Planner MacFarlane
noted that Owens-Illinois never signed that letter. Planning Director Maurer
felt that when Owens-Illinois removed material, that they agreed with theterms
of the letter and that if they had any objections, the time to make them were
prior to the beginning of the operation.
Motion: To advise Owens-Illinois that they either enlarge the retention area
and remove the material in conformance with the letter of December 6,
1973 through the entire elimination of the peninsula along the westerly
side of the retention area or that they restore the contours of the
ground and vegetation in accordance with the plan formally approved by
the Mansfield Planning Board on September 13, 1973 as shown on sheet 9
of 10 entitled Plan and Cross Section Showing Proposed Elevations of
Retention Area In Mansfield, Mass.

9. Board reviewed the bond estimate for Walnut Park. Planning Director noted that
he had called Campanella Corp., Bella Construction and Simeone as requested by
the Board last week, and that Bella noted that they get $18 per ton for a 2 inch
binder and Simeone charges $17.50 per ton. Planner Wellington noted that the
contract from Bella Construction for $28,500 to complete the work minus the
loam and seeding and setting of the bounds was very favorable, but should the
developer default and the Town would have to get the work done, they could never
get it done for that price.
Motion: To inform Casa Realty that the Board will require the following amounts
of securities to be posted to guarantee construction on Casa Drive
within the Walnut Park subdivision:
Value .of Construction $40,000
Contingency 000
TOTAL $45,000
Also, that the applicant be advised of the purpose of performance bonds.
