Board met with Guido Scarpellini and Ed Gonsalves regarding the bond estimate for Casa Drive within the Walnut Park subdivision. 'Mr. Scarpellini stated that he felt that the bond estimate he received from the Planning Board in the amount of $59,332 was too high. He produced a copy of a contract with Bella Construction with $28,500 remaining for the work to be completed. Chairman Zaffini told Mr. Scarpellini that the Board woulddiscuss 'this 'getter and get back to him. Planner Wellington noted that the proposal from Bella was very favorable but that according to today's prices, the Town could not have the work done for that amount. Motion: To leave the bond estimate figure as is. (Grant-Wellington) Planning Director Maurer noted that the developer had been very cooperative with the Town and that he had installed storm drainage to Walnut Street, which he was not required to do, to help solve the drainage problem in that area. Planner Wellington noted that the date of the contract was April 20,'1973 and that the date of acceptance of the contract by Casa Realty, Inc. was never recorded and, therefore, was not legal contract and would not hold up in court. Planner MacFarlanenotedthat the loam and seeding was not even mentioned in the contract. Planning Director suggested that perhaps the Board could ask Mr. Scarpellini to get an up-to-date contract from Bella Construction and then 'reconsider it. Planner MacFarlane suggested that "completion of roadway" on the contract be spelled out as to exactly what it means. Amended Motion: To inform Mr. Scarpellini that the bond estimate figure remain as is, but suggest that if he wishes to present to the Planning Board a signed, sealed and approved contract from Bella Construction`' on whatever remains to be completed as per the requirements of our letter of April Z, 1974 based on today's prices, the Board would reconsider the bond 'estimate figure. (Wellington-MacFarlane, all in favor) VOTED 5. Board signed the Form A plan for Forest Realty for land on Gilbert Street as voted last week. 6. Board signed the Form A plan for Lois Thomas for land on Hall Street as voted g last week. 7. Board met with Margot Jellinek regarding the Form A plan for Russell Taylor for land on Brown Avenue. The Board noted that the hformation she presented did not even apply to this project and that the lots in question were several thousand feet away from it. Board signed the Form A plan for Russell 'Taylor for land on Brown Avenue as voted 3 last week. -3 - Mi nu tes April 10, 1974 Planner Dunn suggested that the Board send a letter to Town Counsel for an interpretation on Section 1-C-2 of the Zoning By -Law. He noted that they had taken some additional test holes but that no results were available as yet. 9. Mr. Maloon informed Chairman Zaffini that it was he who issued the invitations to the Commission and the Board and that any blame for the misunderstanding rested,,. with him._ Motion: That the Chairman of the Conservation Commission be sent a letter of apology with copies to the Town Manager and the Board of Selectmen. (MacFarlane -Wellington, all in favor) VOTED 10. Planning Director noted that the hearing for Riverside Park was scheduled for next week at 8:00 P.M. 11. Planning Director noted that no comments had been received back yet from the department heads regarding Camelot at Mansfield. (Planners MacFarlane and Grant left to attend the Selectmen's meeting) 'Planning Director noted that he had spoken with Ralph Maloon who indicated that Mr. Antosca and Mr. Morrisson had dug a lot of test holes on the site on their own and that had the Board asked Mr. Maloon, he would have gone out there and marked the holes accordingly. 13. (Parsons -Dunn, Wellingfoni>,Zaff rllt in favor) VOTED 14. Planner Parsons asked if Cabot, Cabot & Forbes was concerned about the drainage from the Camelot at Mansfield subdivision. Planning Director noted that he had spoken with Jerry Diamond who asked what concerns the Planning Board might have. Planning Director noted that one of the concerns was the drainage from this property into the Hodges Brook. Mrs. Margot Jellinek presented the Board with a copy of the deed from John Prescott to the Town of Mansfield. 18. Planning Director informed the Board that the reason the letter was not sent regarding the bonds being held as securities on Oakleaf Drive, was that the bond does not expire until next year, rather than this year. 19.
