a letter

that either.

11. Planning Director noted that the 20 day appeal period was up on the definitive
subdivision plan for Canoe River Acres and that no appeal had been filed and
the plans were ready to be signed. Planner Wellington noted that of the 5
members that had originally voted for the endorsement of the plan, only three
were present and he suggested that the signing of the plan be put off.
12. Board rev$ewed the railroad plan for Mansfield Industrial Park Realty Trust.
Planner Wellington stated that he had called the Penn Central Railroad,
Engineering Department, and that he was informed that the required radii on
spur tracks is 120-30'. He sdggested that the Planning Director write
Mr. Griffith a letter asking him to get a letter from the railroad on what
their standards for minimum radius are on spur tracks.

that hearing is on file.
14. Board met with Carl Nelson and Attorney Ernest White regarding the de-fin,i.t:i;ve;
subdivision plan for Capt. John Williams Estates. Mr. Nelson referred to the
Planning Board's letter of October 4, 1972 and noted that he would comply with
the 5 points listed in the letter and that in fact, the borings on the road
had already been taken as requested. He stated that he would provide the
required drain easement although he felt that the Board was exceeding its
authority in requesting them. He further noted that he did not want to show
the contours going onto adjacent property owned by him because ha felt it was
not necessary.

Planner Wellington felt that Mr. Nelson should put a note on the Form A
plans on the street frontage lots cross referencing them back to the
subdivision in order that it is understood that grading has to be done on
the back bf the Form A lots at a slope of not more than 1 vertical and
4 horizontal which relate to the development of the subdivision. Mr. Nelson
stated that he would add the note to the Form A plans.
15. Board reviewed the Amendment to Covenant regarding the Circle C Estates.
Acting Clerk Latham read the letter from Town Counsel stating that the
covenant was proper as to form. It was noted that the Board had voted on
November 14, 1973 to approve the amendment, but that the Board was waiting
for the original to be returned to them. The Board signed the covenant as
previously voted.
16. Board reviewed the bond release for Mansfield Industrial Park Realty Trust,
who was requesting the release of $30,983. It was noted that $20,000 had
already been released for a portion of the electrical work based on a prior
estimate received from the electrical contractor. A more recent estimate
was substantially higher. Aside from the fact that the Board was short on
the electrical work it was noted that all the other figures were reasonable.
Planning Director noted that we had $27,000 plus contingency that would be
held for one year.
Motion: To release only $3,000 in order to bring the figure back to what it
sheuld be with electrical work.
(Wellington -Dunn, Latham, MacFarlane, Zaffini, in favor)VOTED
17. Planner MacFarlane stated that he would like to request that the Planning
Director give the Board an up-to-date report on the wells situation and on
Penetryn.
18. Planngr Ma arlane noted that he thought the Planning Board attendance was
CUf p [ r11 / Y
pooryarf t at he iI' ht that moving the meeting bight to Wednesdays was
part of the reason. He made a rmtion that the meeting night go back to
Mondays. Chairman Zaffini noted that he did not think the attendance was
poor, rand it was the consensus of the Board to keep the meeting night on
Wednesdays.
19. Planner Wellington n6ted that he thought that at one time Olvidi.o Scarpellini
had come to the Planning Board to ask what route he should take in getting
his two lots approved for single family homes and that the Planning Board had
suggested he go to the Board of Appeals. Planning Director noted that he would
check to see what the Board told him.
20. Planner Dunn noted that he had spoken with Tippy Giovino who told Planner Dunn
that he had no recollection of an easement on his property regarding the
Mansfield Housing Authority. Planning Director noted that he would check this
out.
21. Planner Dunn asked that if Cluster was set up with cul-de-sacs and so-called
collector streets, if there would be any consideration for increasing the
frontage requirements only to try to limit the amount of driveways that access
onto the collector streets.
