The Planning Director noted that he had 'reviewed the site on three different occasions since November '30th and that one of those times was at 10:00 A.M. this date. He also reviewed the points noted in the Board of Appeal's decision dated September 15, 1971 and noted .that fhere:were provisions in the permit for 'another removalsubject to satisfactory performance and he noted the following: (9) that the Olan subuiltited, wfththe: bppl;ieation adoes not contain all of the information as required in the permit, (b) that the original plan showed the excavation to be done across the property of W. H. Riley which is now owned by the Commonwealth of Mass. and developed as a rest area, (c) that as of November 30, 1973 the angle of the slope 25 feet from the property line of the state property was left in such.a manner that it would create a hazard. However, the Planting Director noted that on a field inspection this morning that the applicant is in the process of regrading this area back to an acceptable slope, (d) that the applicant proposes to remove gravel from the -3 - property formerly owned by Vincent Sasso where a dwelling was removed and the extent of this excavation is not shown, (e) that all of the excavation is not complete and this is why the site may look messy and that the plan submitted does not depict what actually exists, (f) that ,the original, permit provided for the removal of the gravel up to Brown Avenue provided that at least 25 feet was removed at the end of the pperation, (g) the Planning Director recommended that the renewal permit be ,granted because that is the only way the site can be brought back to an acceptable condition. However, certain conditions should be put on the applicant which are as follows: (1) that the plan be amended to show the revision in ownership with respect to the Commonwealth of Mass., (2) that a 25 foot buffer zone be provided for along ,the Commonwealth of Mass, property, (3) that the plan also show the existing and proposed contours, (4) that the plan should also show the definitiveinformation relative to removal of gravel - formerly owned by Sasso, (5) that prior to commencing with removal of additional material, the applicaht restore the 'buffer zone area to the required 2 to I slope., It was the consensus of the Board to have the Planning Director draft a letter to the Board of Appeals IneorporatIngrthe::eonditIons as noted above. 16.
