Acting Chairman Wellington noted that, regarding the budget, he had met with the Town Manager and they are going to cut the budget by $100 from the 'Printing Account. 5. Board met 'With Nick Zaharias and Thomas Scarpellini from Village Estates Section Iii. Mr. Zaharias noted that they had requested the appointment to submit a few more facts which he failed to bring before the Board at his prdVious meeting with the Board to discuss his driveway. He noted that his wife lost control of the car coming into the driveway during the snow storm last week and did damage to the lawn. He also submitted an estimate from Foxborough Sunoco for damage done to the exhaust system. Mr. Zaharias noted that the Pickle family and the Wallace family also had problems with their driveways but could not make the meeting this evening. Mr. Scarpellini of 35 Village Road noted that he is aware of the drive- way situation but you can't be responsible when company comes and did not feel it was a fair situation. Planner Parsons questioned if they had any thoughts as to how to remedy the situation. Mr. Zahariasnotedthat they could cut down the height of the sidewalk at the driveway and another was to cut back the apron, ( however did not know if this would cause a drainage problem. Board advised them that they would discuss it and get back to them. Mr. Scarpellin noted that he had talked to Russell Christian and he said they would be able to correct the situation provided it was alright with the Board. Mr. Zaharias questioned if the Town was responsible for the damage done to his car. The Board advised that this is privatepropertyuntil it is accepted by, the Town. Mr. Zaharias noted that it was built to Town specifications. Board advised that they were not lawyers and could not make such a determination. Mr. Zaharias noted that he would like to have some kind of contact with the Board regarding the action being taken on this situation. 6. Board-di'scussed the driveway situation in the Village Estates Section III. Acting Chai•tman Wellington noted that, in reviewing the site, he did not feel there was 3 feet between the curb line and the sidewalk on the right hand side of the driveway. He noted that this would increase the slope on the apron. He further noted that no matter what is done out there there is going to be a rocking motion in the car because it is on the cul-de-sac. Acting Chairman Wellington noted that on Section I of the development there does not seem to be any problems at all with the driveways, however, section III looks to be three times as high. He noted that he advised the Planning Director that when this situation comes up that they should not stick to the typical cross section but blend the sidewalk in. Acting Chairman Wellington noted that he would like to see the back dropped down so that instead of coming up 6 inches in 3 feet you will be coming up 4 inches in 3 feet, and have the back of sidewalks 8" above the gutter line. ms Minutes December 3, 1975 It was noted that any adjustments in the driveways would have to be the option of Christian and Schromm as they have been built to standard. Planner Tighe noted that the Planning Board cannot do anything until Christian and Schromm decides if they want to make changes and what their changes will be, then the Board would have to review the adjustments. Acting Chairman Wellington noted that construction season has ended and that if they wait until two weeks to review any proposed changes that the developer will not be able to find blacktop to correct the situation. It was the consensus of the Board.to have the Planning Director find out if Christian and Schromm want s.to correct the driveways and if so, what their proposal would be and then have the Planning Director contact the Planning Board members for their opinions. 7. Planning Director Maurer noted that Karl Clemmey met with the Board of Selectmen last Wednesday to request them to put on the warrant for the special Town Meeting the rezohingcof land on Route 106 near the Easton Town Line toga Business Zone. Planning Director Maurer noted that there was a time factor involved regarding holding the required Public Hearing prior to the Town Meeting vote so he is now going to wait until the Annual Town Meeting. 8. Board discussedcthe definitive subdivision plan for Woodland Park. It was noted that the comments requested by the Planning Board were forwarded to the applicant and no answers have been received. Planning Director Maurer advised that the abbutter Morse felt that the altering of the brook would help the situation however they were not sure they wanted to ,give an easement. Planning Director Maurer advised them that the easement will be required by the Planning Board. It was noted that the comments from the Conservation Commission had not been received as of yet. It was noted that if the brook was not relocated they would lose 3 or 4 lots and if they did not lower the brook they would lose_ a good portion of the subdivision. Planning Director Maurer noted that the Camp Dresser McKee Master Drainage Plan recommended lowering the brook 3 to 4 feet. Planner Latham noted that they would need a detail of the rip rap where the brook is proposed to be relocated. Planner Parsons questioned if the relocation and the speeding up of the brook would cause backing up of the brook down stream. It was noted that the Board has already requested further information on the brook down at Fruit Street. It was noted that on the Shaw property they had provided a catchbasin and that after discussion ._ it might be better to have just an inlet, otherwise they would need an easement to maintain the catchbasin, It was the consensus of the Board to advise the applicant to investiage the possibility of picking up the water at the low point with a pipe to the first manhole and keep it on the right-of-way. Planning Director Maurer noted that the Water Superintendent suggested thati, the specifications for the lift station be reviewed by Camp Dresser McKee to make sure that the capacity of the pump is acceptable. Acting Chairman Wellington felt that it was up to the Sewer Department to have them reviewed by their consultant as it is not up to the Planning Board to deal with the consultants. Acting Chairman Wellington noted that on standard pump curve charts that if he know the number of gallons andthe elevation it was being lifted he could get the size of the pump from the chart. Planner Parsons noted that Item D on page 4 was not filled in. -4 - Minutes December 3, 1975 Planning Director Maurer noted the comment in the memorandum prepared by him on .November 19,1975 regarding a detailed wiring plan being required with this plan, or the plans submitted in the future. It was the consensus of the Board to advise the applicant of the comments raised at this meeting and advise that the reply must be to the Board prior to their meeting of December 17,1975. (Planner Mahana left the meeting at this time) 9. Board reviewed the Form A Plan for Virginia Dunn for land on East Street:, Motion: To,sign the Form A Plan for Virginia Dunn for land on East Street. (Parsons -Tighe, all in favor) VOTED 10. Board met with Douglas King to discuss a request for a reduction in the Bond Estimate for Canoe River Acres. Mr. King noted that the gravel and 21nches of binder had been installed on all three roads within the subdivision. It was the consensus of the Board to require a bond in the amount of $29,725.20 for the work which remains to be completed in Canoe River Acres. .. 11. Board reviewed the request from Christian and Schromm for the release of securities in .the Village Estates Section I subdivision Planning Director Maurer noted that they solved the water problem in 2 of the low areas, however, in -the small one they just moved the water around. It was noted that there was enough in the contingency to take care of this. Motion: To release $2,250.00 from Village Estates Section I from Mansfield Cooperative Bank Passbook #009408. (Tighe -Parsons, all in favor) VOTED It was noted that the 10% contingency is still being held. Board reviewed the request from Christian and Schromm for the release of securities in the Village Estates Section III subdivision. Motion: To release $11,075.41 from the letter of credit held by the Mansfield Cooperative Bank for work completed in Village Estates Section III. (Tighe -Dunn, all in favor) VOTED (Planner Mahana re=entered the meeting at this time.) 12. Planner Mahana apologized to the Board for leaving themeeting and noted that he has not resigned from the Municipal Building Committee as of yet but would be doing so after the Special Town Meeting. He noted that there are two options coming up at the Special Town Meeting on which he had to vote on. =5 - Minutes December 3, 1975 13. Board discussed the bond reduction request from Cabot, Cabot and Forbes along with the memorandum prepared by the Planning Director. Planning Director Maurer noted that on Oxford Road they are requesting the release of the contingency as the work has been completed for over one year. Clerk Dunn questioned what it would cost to raisethe manholes when the pavement is done. It was noted it would cost approximately $50.00 each and that there are approximately 6 manholes and catchbasins on that road. Clerk Dunn questioned if the amount being held to cover the final pavement would cover the cost of raising the covers. Acting Chairman Wellington felt that it would. It was the consensus of the Board to advise Cabot, Cabot and Forbes that the amount being held will be reviewed as inflation increases and may have to be increased. Motion: To,release-$5,051 from AetnaCasualty Company performance; Bond #06SB--025272 for the contingency on Oxford Road. (Tighe -Dunn, all in favor) VOTED On Hampden Street it was noted that they have completed the installatien of 2 inches of binder, granite curbing for 700 feet and Loam and seed for 4,160 sq. Y.ds. amount to $39,146. Motion: To reduce the bond amount of the Aetna Casualty Company to $191,194.70 for work to be completed on Hampden Road. (Tighe -Dunn, all in favor) VOTED It wasnoted that this bond also included the work to be completed on Norfolk Street. 14. Board reviewed the notice from the Board of Appeals for a public hearing on the application<of James R. Dunleavey for an appeal of the decision of the Building Inspector. Planning Director Maurer noted that the decision of the Building Inspector was upheld by the court and did not feel it was right for''a local board to appeal the decision. Motion: To recommend to the Board of Appeals that the appeal of James R. Dunleavey not be granted as the decision of the Building Inspector has been upheld in a higher court and the Board does not feel that it would be appropriate for a local board to reverse the decision of the court. (Tighe -Dunn, all in favor) VOTED 15. Board reviewed the letter received from Mrs. Jellinek regarding the Circle "C" Estates subdivision. It was noted that the drainage has not been completed yet.- Acting Chairman Wellington felt that they should wait until the drain line is completed. Planning Director Maurer toobtain a copy of the elevations from RIM and makk them on the Planning Board set of plans to varify that the pipes are being put in at the proper elevations. Board questioned the comment of gravel and loam being removed from the property. Planning Director Maurer that there are trucks moving the gravel around within the subdivision but he has seen no trucks leaving the area. Minutes December 3, 1975 16. Planner Latham noted that on the zoning they should talk about the parking in the business district on No. Main Street and also in the subdivision regulations they should discuss the sidewalks and driveways and utility plans for the electrical wiring to be supplied when the plan is submitted, and possibly have a separate sheet just for utilities. 17. Clerk Dunn noted that he would be unable to attend the Capital Improvement Program Meeting on December 4, 1975 in case another member of the Board wanted to attend in his place and that he would be unable to attend the meeting of December 17, 1975. 18. Clerk Dunn presented anloyerl.ay plan done on.a diazo machine, which, he noted, is an inexpensive machine. He noted that it can show how the wetlandimpacts on the "various zones and how the zones relate to another zone. Can also be used to have an overlay that would have the water master plan. Planning Director Maurer noted that utility plans are being prepared on a standard scale through a SRPEDD program. 19. Planner Parsons noted that he is concerned with what Carl Nelson is doing to the gravel pit. He noted that this is under the grandfather clause and questioned if there was any way the planning Board could get a plan .on this. Planning Director Maurer noted that in Town Counsels opinion on Grandfather Clause Gravel Pits they have to stay within the standards and noted that Nelson's pit is below the water table now. 20. Planning Director Maurer noted that he has a memorandum from the Building Inspector to the Town Manager regarding lots on King Street. It was noted that it is used as a street but is not an accepted street. It was noted that building permission is being requested on this street. Planning Director Maurer to comprise more information on this for the Board's review. Noted that on James Street a variance was denied twice and it was a passable street. 21 Planning Director. Maurer advised that on Case Drive a letter was sent a few weeks ago to have them clean out the drainage ditch by December 1, 1975 and this work has been done. 22. Meeting adjourned at 10:20 P.M. %%'
