(Latham -Dunn, all in favor) VOTED 9. Board met with Nick Zaharias of 27 Village Road, who noted he recently had sidewalks put in the development and that the sidewalk coming across his driveway is creating a problem as there is a bump causing the carr'to shake. He noted that he would like to have it corrected if it is possible. He noted that they apparantely had to level the sidewalk with the rest of the sidewalk as it comes around the cul-de-sac and with the sloping of the driveway it -3 - Minutes November 19, 1975 has caused a ridge. He noted that the bottom of the cawis not hitting the sidewalk. It was noted that they finished paving Village Estates III this morning, and that the situation is still the same. Planning Director Maurer notedthat with the sloped edge it is about one inch higher than what the regular berm is. It was noted that it was built in this way to comply with the Planning Board regulations. Mr. Zaharias gave the Planning, -Board permission to drive into the driveway to check the situation out. Planning Director Maurer noted that Christian and Schromm would be requesting the release of the final securities for work in Village Estates III and that the Board will be reviewing the project and can look at the driveway then. He noted, however, that he felt that they could not hold up the securities of this project for this reason. Board to review the situation. 10. Board reviewed the Board of Appeals application of Antonio R. Savini for a variance to use an existing dwelling in a Residence B Zone for the sale of gasoline and repair and sale of motorvehicles. It was noted that the original hearing scheduled was advertised wrong as it noted a GMC dealership, which is not being requested now. Planner Tighe noted that the repair and sale of motor vehicles is too general as they do not specify new vehicles and it could turn into a junk': car dealership. Motion: To recommend that the variance of Antonio R. Savini not be granted because a specific proposal was not presented to the Planning Board and they could not evaluate the effect on the surrounding property. (Tighe -Latham, all in favor) VOTED 11. Board reviewed the Board of Appeals application of Ernest J. Fillion to erect a building with non -conforming sideyards for a non -conforming use (welding business) on Mill Street. Motion: To recommend that the variance not be granted because there has been no substantial hardship demonstrated and it would derogate from the zoning by-law. (Tighe -Dunn, all in favor) VOTED 12. At 8;00 P.M. a public hearing was held on the application of RewLew Trust for the defintivie Subdivision plan for Woodland Park. (Planner Parsons entered the meeting at this time.) Transcript of that hearing is on file. 13. Board reviewed the request from RIM Engineering on behalf of Home Developers to relocate the drainage in a portion of Magna Vista II. It was noted that this would be considered as a major change in the plan and would require a new public hearing. Public Hearing to be scheduled and advertised as an amendment to the approved plan and only the immediate abuttors to the drainage to be notified. -4 - Minutes November 19, 1975 14. Board reviewed the letter from Mrs. Jellinek regarding the drainage in the circle C Estates subdivision. Planning Director Maurer noted that it slopes from Maverick Drive to the abuttors property line and they proposed to put in a drain pipe which would drain from the low point back to the central drainage system. The question that was raised in the letter from the abutter that last Saturday there was water in this area from the headwall, which appeared thatthe water was flowing in her direction. He noted that they are in the process of putting in the 30 inch drain line and that the bottom of the pipe is down about 5 or 6 feet and they are into the ground water. He noted that after they had stopped working on the system that it had filled up with water and noted that once the remainder of the line is completed that this problem will not occur again. Planner Tighe felt that they should wait until the end of next week to see how the drainage system is working. Mrs. Jellinek requested the Board to go out and see where the pipe is and where the pond is filled in and that the pipe is pitched to her. property. 15. Planner Tighe quesitoned if the Planning Director drove over Mr. Zaharias' driveway. Planning Director Maurer noted that he had not. He also noted they they will be requesting the release of securities and felt the individual members of the Board should review the area prior to the next meeting. 16. Aeting Chairman Wellington requested the Planning Director to check to see if anyone was planning to attend the public hearing regarding the closing of the Back Bay Train station. 17. Planning Director Maurer noted that in the existing Zoning By-law it reads that new business in the business zone must meet the off-street parking requirement and that this is causing problems in existing buildings in the center of Town and that perhaps the Board would like to review this prior to the Annual Town Meeting. 18. Planning Director Maurer noted that in Canoe River Acres they plan to pave the roadways within the next week or so, and that the first section of Circle "C: Estates is ready to be paved. 19. Planning Director Maurer felt it might be advisable to send out the comments on Woodland Park regarding the information required on the Back Bay Brook and to advise that other additional comments would be sent after the meeting on December 3, 1975. Board noted that comments have not been received from the Conservation Commission yet. It was the consensus of the Board to forward the comments noted in the Planning Director's memorandum. 20.
