Tighe (Latham -Wellington, all in favor) VOTED 5. Board reviewed the "as built" plans for Saddle Ridge Road along with the memorandum prepared by the Planning Director. It was noted that all the work requested to be completed by the Planning Board in July had now been completed. 6. Acting Chairman Wellington advised the Board that regarding the definitive subdivision plan for Woodland Park that a member of the Conservation Commission mentioned that the entire area was swamp and questioned if the Board wanted to take a field trip to review the area. 7. Acting Chairman Wellington noted he had reviewed the Village Estates area with respect to the headwalls as questioned by Norman Mahana and felt there is nothing wrong with them. He noted that the water would never get across the brook, however, they could use some rip rap to divertthe water down stream without any relocation of the headwalls. Minutes Novmeber 5, 1975 Page 3 Board met with Robert L. Rizzo, who requested the release of securities being held for Saddle Ridge Road. Board advised Mr. Rizzo that they would be reviewing the site prior to the release of any securities. Board met with the Board of Health to discuss the procedure for the Planning Board and Board of Health review of subdivision plans. Planning Director Muarer noted that during the review of Camelot -at -Mansfield several problems in the review procedure had been encountered, and that the Planning Board would like to try and have an understanding of the procedure between the two boards so that they would not run into the same thingin the future. It was noted that when the subdivision regulations were amended all the Board did was adopt the section which pertains to the Board of Health from the General Laws. Planning Director Maurer noted that in the old subdivision regulations there was a one page procedure of the Board of Health and that now that the Board is in the process of reprinting the subdivision regulations felt there might be a statement from the Board of Health on their regulations. Chairman Folan of the Board of Health noted that the only question the Board of Health had is on subdivisions which are tying into the sewer and are approved as such and then they can not get approval from the State for the hookup. Questioned what recourse the Board of Health would have on the approval of the plan. It was noted that if a subdivision plan is submitted with the entrance within 400 feet of an existing sewer main that the subdivision has to tie into the sewer and if he cannot get state approval he can not build until this approval is obtained. Board of Health Subdivision Regulations and Stump Dump Regulations to be added to the Planning Board Subdivision Regulations as an Appendix. The Boards discussed the problems which have arisen on subdivisions when they are not tying into the sewer and have on-site sewerage when the Planning Board has to act within 60 days and the Board of Health has no time limit. It was the consensus of the Board of Health that they will advise the Board of their action within 45 days on municipal sewer plans and the status of on-site sewerage plans within 45 days to give the applicant a chance to request an extension of time for the Planning Boards consideration. It was noted that the Planning Board does not receive.' much correspondence on the subdivision plans and the Board of Health noted that this could be corrected in the future. 10. Board reviewed the Form A Plan for Mansfield Trust for land on Hampden Road. Motion: To approve the Form A Plan for Mansfield Trust for land on Hampden Road. (Latham -Tighe, all in favor) VOTED 11. Board reviewed the request from Christian and Schromm, Inc. for the release of securities for work completed in Village Estates Section I. Minutes November 5, 1975 Page 4 Motion: To release $10,417 of Bank Passbook #009408. (Latham -Tighe, all in the $12,667 from the Mansfield Cooperative favor) VOTED 12. Board reviewed the performance bond and the lot release request from the Mansfield Cooperative Bank for Village Estates Section II. Board reviewed the Planning Directors memorandum and noted the work which remained to be completed, plus the 10% contingency for VillageEstates II amounted to $69,330.92 and that a bond had been posted with the Mansfield Cooperative Bank in the amount of $70,040. Clerk Dunn questioned if the amount for the sidewalk included the loam and seeding of the grass strips. It was noted that the loam and seeding had been ommited from the original estimate. Bond estimate to be revised to include the loam and seeding and Christian and Schromm to be advised of the corrected bond amount. 13. Board reviewed the request from the Mansfield Cooperative Bank for Christian and Schromm to transfer the funds from the letter of Credit to a passbook account for the performance guarantee for Village Estates III. Board also reviewed the memorandum prepared by the Planning Director. It was the consensus of the Board to void the Letter of Credit upon the receipt of the passbook. Motion: To approve the transfer of the funds for the work to be completed in Village Estates III from the letter of credit to a passbook upon receipt of the passbook the letter of credit will be voided provided that the same restrictions are on the passbook as are on the letter of credit. (Latham -Dunn, all in favor) VOTED 14. Board reviewed the Zoning Board of Appeals notice of Public Hearing for Antonio R. Savini to use an existing building on 95 South Main Street as a gasoline station, the sale, service and repair of motor vehicles and for the sale of motor vehicle parts and accessories at wholesale and retail, including the operation of a Pontiac and GMC dealership, in a Residence "B" Zone. Planner Tighe noted that Mr. Savini has run a good business there in the past and felt he was an asset to the Town. Motion: To recommend to the Board of Appeals that the variance for Antonio R. Savini be granted. (Tighe -Driscoll, all in favor) VOTED 15. Board reviewed the 208 Federal Grant Program Questionnare from SRPEDD. He noted that on the last section with the map that the Selectmen, himself, and the Conservation Commission submitted the Planning Development Policy of the Comprehensive Planning Program. The questionnare was completed as attached and a cover letter to be sent with the questionnare noting that the answers are the consensus of the Planning Board. November 5, 1975 Minutes Page 5 16. Board reviewed the definitive subdivision plan for Woodland Park. Planning Director Maurer noted that the preliminary plan was approved by the Board over a year ago. He noted that for the drainage work they are proposing to go off-site and lower the Back Bay Brook . Planning Director Maurer noted that this should be put in an easement or permission from the owners for the work to be done should be obtained. Planning Director Maurer noted that the Conservation Commission looked at the property and felt that it was all swamp and have requested the engineer to stake the existing brook across the property. Planning Director Maurer noted that in the drainage master plan that it is recommended that the brook be dredged and that this is what the developer will be doing. He noted that engineer, Ralph Maloon, will be available to review the site this weekend and that the Conservation Commission would like to join the Planning Board for the site review. Planning Director Maurer noted that lots 9 and 48 are in the industrial zone. He noted that the Conservation Commission questioned ff the relocation of the brook would make the stream flow faster or slow it down. It was noted that the detail for the rip rap on the brook was not shown on the plan, easements need to be acquired, and elevations of the brook need to be shown. Board to meet Sunday, November 9, 1975 at 7:00 A.M. at the Old Colony Diner to review this site with the engineer and the Conservation Commission. After the review of this site the Board will review Saddle Ridge Road and Village Estates, Section I, drainage headwalls. 17. Clerk Dunn noted that the Capital Improvement Committee is assigning priorities and felt that the Planning Board should review the projects and assign priorities as a Board. Board to review the projects at a workshop meeting on November 12, 1975 to assign priorities. Acting Chairman Wellington noted that he would not be able to make this meeting but would vote by proxy on the submitted forms. 18. Acting Chairman Wellington felt that the Board 'thould meet at 7:00 on November 19, 1975 due to the Public Hearing for Woodland Park. Board in agreement with this. 19. Planning Director Maurer noted that last week a letter was sent to Casa Realty regarding the drainage ditch in Walnut Park and that Casa Realty has advised that they are going to make the correction and dig out behind the headwall sometime next week. 20.
