5. Board met with Norman Mahana to discuss the drainagefrom the Village
Estates subdivision. Mr. Mahana noted that one drain is flowing
with the brook and the other is shooting directly across and causing
erosion on the other side. He wanted the Planning Board's assurance
that this would be corrected. Planning Director Maurer noted that at
the time of the hearing that it was stated they were going to turn
the headwall to meet the flow. PlanningcrDirector Maurer noted that
in the last headwall installed the last two lengths of pipe flow
with the stream. He noted that the first one the pipe was cocked
but it doesn't send it down stream. He noted the headwall is at an
angle and the pipe is cocked but it still doesn't come at the angle
to flow with the stream. He noted that the one furthest down
has not been constructed. Planning Director Maurer noted that in
the present easement that exists it would be difficult to cock the
pipe any further.
Planning Director Maurer noted that upon his inspection on Monday
he did not see any problem with washouts in Mr. Mahana's area but
noted that unless they put more rip rap under the headwall that area
will be washed out. Mr. Mahaha noted the problem began when they
dredged the brook and put the dirt on one side and made it higher
than on his side. He noted he raised concern when the plan was
first submitted and voiced his concern at the hearings. It was
the consensus of the Board to review the site and contact the
developer and Mr. Mahana with their decision.
Planner Tighe questioned the way it was shown on the plan and what
recourse the Board had if it was not constructed as shown. It was
noted that if it was not constructed as shown the Town could take the
funds which the developer has posted and use this to hire someone to
install it as shown.
Board reviewed the subdivisions amendments as prepared from the
last meeting.
Motion: To approve the subdivision amendments as presented.

7. Board discussed the resolution from the Town of Sharon regarding the
closing of the Back Bay Station in Boston. It was noted that there are
sevdral rumors going around as to why the station is being closed.
Acting Chafrman Wellington to obtain a blank petition which is being
ciruclated in the Back Bay Station and to obtain further information as
to why the station is being closed prior to the Planning Board taking
any action on this.
8. Planner Tighe noted that he has been attending the Capital Improvement
Program Committee meetings and noted that he has not been appointed as
the Planning Board representative. He noted that they will be voting
on priorities shortly and felt he should not vote as he is not an
elected member.
Motion: Toappoint Planner Tighe as the Planning Board representative
of the Capital Improvement Program Committee.
(Latham -Dunn, all in favor) VOTED
9. Planner Tighe questioned the status on the stump dump as questioned at
the last meeting. Planning Director Mauler noted the handout with the
Board of Health regulations for stump dumps and noted that the Board of
Health has a plan with the stumps shown on it for the Circle C Estates.
10. Planner Latham noted that on the Capital Improvements that if the Town
is going to have a sewer that they should be setting money aside for
this. Planning Director Maurer noted that the land acquisition is not
reimbursable and that this is what they should start an account for.
11. Planner Latham questioned the status of the Cabot, Cabot and Forbes
water tank. Planning Director Maurer noted that they are awaiting
State approvallon the tank before they consider putting it on the
line.
12. Board met with Richard Silva to review a Form A Plan for land on
Fowler Street for Frank Vaz. It was noted that all that is recorded
in the Registry of Deeds for Fowler Street is the first 200 feet.
However, the Town Hall has Fowler Street listed as beeing accepted
for its entire length. The Board advised Mr. Silva that he would have
to get the legal status on the street before the Board could accept
the plan as being a Form A Plan. Mr. Silva noted the General Laws
Chapter 41, Section 81L. The Board noted that this referred to
improvements already installed and that it made the legality of the
plan even more questionable.
13. Planning Director Maurer noted that the one year time period on Walnut
Park improvement installation would be up on December 1st and that the
Bond expires on December 1st. He noted that he drove down there after
the rains and noted that there is a drainage problem and that the
drainage ditch needs to be cleaned out.
Motion: To advise Mr. Scarpellini that the drainage Ditch in Walnut
Park will have to be cleaned prior to the release of any
securities in Walnut Park.

Wellington questioned who owned the land across the street and what
rights the deed had to the right of way. Planning Director Maurer
to get this information for the next meeting.
15. Board signed the defintiive subdivisions plans for Camelot -at -Mansfield
as voted on September 17, 1975. It was noted first that no appeals had
been filed with the Town Clerk. (Planner Parsons entered the meeting
to sign the plan.)
