Southeast Region Cooperative Extension Service - ECOGRAM, July, 1975 2. Board discussed the request from Camelot Realty Trust for an extension of time for the Planning Board's consideration until September 10, 1975. Planner Latham felt that it was not right for the Board of Health to hold up the Planning Board when the plan meets all of the Planning Board's requirements. Motion: Not to grant the extension of time for the Planning Board's consideration. (Wellington) Motion lost for want of a second. Planner Wellington felt that a decision should be made at this meeting, and that the submission of the new plan would not change the plan as far as the Planning Board is concerned. He felt that the Board of Health gave their guarantee at last nights meeting that they would approve the plan when it is resubmitted. Chairman Zaffini felt that the applicat was asking for an extension and felt it should be granted. To be discussed further. -2 - Minutes July 23, 1975 3. Motion: To accept the warrant of July 29, 1975 in the amount of $77.40. (Wellington -Latham, all in favor) VOTED 4. Motion: To accept the minutes of July 9, 1975 as presented. (Latham -Davison, all in favor) VOTED 5. Board continued their discussion on the Camelot -at -Mansfield request for an extension of time. Planner Wellington suggested that they approve the request for extension of time and if the plan comes in with no drainage changes and no roadway changes, only lot line changes, that the Planning Board will not hold another Public Hearing, as it is not a substantial change in the plan. Planner Wellington noted that Town Counsel's opinion was to deny the plan if the Board of Health did not approve it, however another lawyer would take the opposite stand point on it. Clerk Dunn noted that on another matter something came before the Board and it was stated that the opinion of the Town Counsel should be followed. Clerk Dunn felt that he has to respect the opinion of Town Counsel. Planner Latham questioned if there were any other plans which were not approved because of Board of Health denial. Planning Director Maurer noted that Coweset Farms was disapproved, however it was noted that there was no corrective alterantives made by the Board of Health on Coweset Farms and there were on the Camelot -at -Mansfield subdivision. Chairman Zaffini questioned if it was legal for the Planning Board not to grant the extension of time when it was requested, and to state that they will not hold a public hearing. Planner Wellington noted that Town Counsel has stated that unless there is a substantial change in the plan it is not necessary to hold a new hearing. Planner Wellington stated that he would strongly oppose and would never attend another hearing for Camelotat Mansfield. Motion: To grant the extension of time for the Planning Board's consideration of the Camelot -at -Mansfield subdivision until September 10, 1975 (Wellington -Dunn, all in favor) VOTED Planner Latham felt that someone should make contact with the Board of Health and Town Counsel and find out when the Planning Board can approve plans and when they can't. 6. Board met with Val Scarpellini to disucss the Foxfield Estates subdivision. Mr. Scarpellini questioned why he had to have granit curbing and sidewalks in his subdivision. He noted that Geneva Street and Leonard Street did not have this. The Board advised Mr. Scarpellini that Geneva Street was built back in the 1950's and that the granite curbing came into effect in 1972. Planning Director Maurer noted that only 8 subdivisions were approved since the new regulations went into effect and that only three have started construction. Mr. Scarpellini stated that he could not build for his own children because the regulations were too strong. He stated that he would be putting the land up for subsidiary and that the state already has his plans for low- income housing development. -3 - MINUTES July 23, 1975 Board discussed the definitive subdivision plan for Peter's Park. The Board reviewed the signed documents from the Mansfield Housing Authority, Kelton Potter and Joseph Gonsalves. Planner Wellington noted that the Board had requested the easements so that the Town of Mansfield would be able to maintain the ditch. He noted that the easements are made out to Mr. and Mrs. Ceccarelli and not to the Town of Mansfield.. Board felt that it should be made out to Gene J. Ceccarelli and Lydia J. Ceccarelli, their heirs, successors, and assigns. (Planner Parsons entered the meeting during this disucssion.) Planning Director Maurer noted that the easements should be cross-referenced on the plot plan that will be recorded in the Registry of Deeds. Board was in agreement with this. The above information to be forwarded to Mr. Ceccarelli. 8. It was noted by the Planning Director that no comments had been received from the department heads regarding the preliminary plan for Americo P. Day. 9. Board reviewed the Form A Plan for Walter Holm for land on West Street. It was noted that the foundation is now shown on the plan as requested. Motion: To sign the Form A Plan for Walter Holm for land on West Street. (Wellington -Parsons, all in favor) VOTED 10. Board discussed the Bond Release for Robert Rizzo for work to be completed on Saddle Ridge Road in the Wayside Estates subdivision. The Board also reviewed the memorandum prepared by the Planning Director outlining the work which remained to be completed. (Planner Davison left the room and did not participate in any discussion.) It was noted that the sidewalk still needed to be installed on the easterly side, loam and seed on the easterly side, setting of stone bounds, and submission of as built plans for the first 650 feet of road. It was noted that a temporary "hammer head turn around" should be installed. Motion: To require above described work to been completed and once it is completed the entire securities will be released and the 650 feet of Saddle Ridge Road will be petitioned for acceptance at the 1976 Annual Town Meeting. (Wellington -Latham, all in favor) VOTED 11. Board discussed the Zoning Board of Appeals application for Mark Higgenbottome for an earth removal permit on Ware Street. Planning Director Maurer presented a memorandum which showed the technical requirements of the Zoning By-law which were not on the plan. Motion: To forward the comments in the Planning Directors memorandum to the Board of Appeals and recommend that once these technical requirements are complied with the Special Permit be granted. (Wellington -Latham, all in favor) VOTED Planner Wellington noted that with the size of the lot he did not think it necessary to require a plan at 1"=40'. =4 - MINUTES July 23,1975 ' 12. Board reviewed the gravel removal permit application for Gastons Avotnieks for the renewal of a permit granted on July 3, 1973. Board also reviewed the memorandum prepared by the Planning Director. which noted that there is silty clay running from the site to an adjacent stream. Planner Wellington suggested that they provide a run off from the site and provide a suitable erosion barrier. Motion: To recommend that the gravel removal permit be granted provided that provisions are made to correct the erosion problem. (Wellington -Parsons, all in favor) VOTED 13. Board reviewed the gravel removal permit application for renewal of an existing permit for Boro Sand and Stone. Board also reviewed the memorandum prepared by the planning Director which noted that the removal operation is less than 100 feet from the southeasterly property line. Motion: To recommend that the special permit be granted to Boro Sand and Stone with the condition that the operation be moved to within 100 feet of the property line on the southeasterly property line. (Wellington -Davison, all in favor) VOTED 14. Board reviewed the Zoning Board of Appeals application of Andrew Fantasia for a variance to keep ponies at 95 Union Street. It was noted that this had been applied for once and denied. Motion: To recommend to the Board of Appeals that the variance not be granted and to note that the Board of Appeals has already denied this variance. (Wellington -Dunn, all in favor) VOTED 15. Board reviewed the Zoning Board of Appeals application of Karl Clemmey, Inc. for Eastman Ford to store and sell vehicles on Copeland Drive. It was noted that Eastman Ford is presently doing this illegally and that there is a sign in violation of the by-law also there. Motion: To recommend that the variance for Clemmey, Inc. be denied. Board noted several changes and a new revised draft to be prepared for the Planning Board's review. -5 - MINUTES July 23, 1975 18. Planner Latham questioned how the RegionalSewer was going.
