(Wellington -Latham, all in favor) VOTED 4. Board reviewed the Form A Plan for George Farnam for land on East Street. Planning Director Maurer noted that the bearings on the plan are taken from the East Street layout and that it is 220 off from the true north. It was noted that a note had been added to the plan in this regard. Motion: To sign the Form A Plan for George Farnam for land on East Street. (Wellington -Latham, all in favor) VOTED 5. Board reviewed the Form A Plan for Earl Ware for land on Balcom Street. It was noted that the Form A application had been corrected as requested. Motion: To sign the form A Plan for Earl Ware for land on Balcom Street. (Wellington -Davison, all in favor) VOTED 6. Board reviewed the Form A Plan for Franklin Allen for land on Ware Street. It was noted that the land in the rear would be land locked and that this property was also owned by Franklin Allen. Motion: To sign the Form A Plan for Franklin Allen for land on Ware Street with the land _locked parcel in the rear being stamped "no building permit shall be issued for this lot without the prior approval of the Mansfield Planning Board". (Wellington -Latham, all in favor) VOTED 7. Board met with H. Patrick Kelly of Millhaus Realty Trust to discuss the Circle "C" Estates. Chairman Zaffini noted that there was a flaw in the letter for credit as it refers to the Planning Board's letter of June 5th and that the PlanningBoard sent two letters to Millhaus Realty Trust on that day, 1 referring to the removal of earth and one referring to the Bond Estimate. Chairman Zaffini also noted that there was a clause that the letter of credit be returned to the bank when portions of work is completed and noted that the letter could not be returned to the bank unless there was another letter of credit to replace it. Mr. Kelly noted that in regardti,to the referral to the date of the Planning Board letter that the letter of Credit is for the guarantee of the subdivision work and not for the removal of gravel and he could have the bank send a letter of clarification. Planner Wellington questioned in accordance with the rules and regulations how long that they had to build the roads. Planning Director Maurer noted that the roads would have to be build by October of 1975, which is two years from the date of endorse- ment. Chairman Zaffini felt that the letter should refer to the bond estimate letter. Planning Director Maurer noted that in some instances the letter of credit requires the signature of the owner and felt that this letter should have the signature of the owner as well. It was the consensus of the Board to return the letter of credit for correction and to also require the signature of the owner. Minutes June 18, 1975 8. Board met with Ralph Maloon to disucss the Peter's Park Subdivision. Board reviewed the revised plan along with the letter of the Planning Board dated May 8, 1975. It was noted that Item #1 in the letter referred to the off site drainage. Mr. Maloon presented a plan showing the proposed drainage ditch across the property of the Mansfield Housing Authority, Joseph Gonsalves and Fireside Realty. He noted that he had a signed agreement with Fireslide Realty and that the Housing Author Ityrequested one more item on the agree- ment, however he felt that they would sign it at the next meeting, and that he had been unable to contact Mr. Gonsalves. Planning Director Maurer noted that the agreement with Fireside Realty referred to the agreement being void one year after signing and questioned what the status of the ditch would be then. He felt that the subdivision is a permanent agreement if approved and felt that the agreement should be permanent. He felt that an easement should be put on the plan and be recorded for all three parties. It was noted that Item #2 in the letter requested a topographic plan for the lot drainage and Mr. Maloon noted that they would be swailing the drainage on lot 4 to avoid the pocket. It was noted by the Board that they cannot take the drainage over the sidewalk into the street that they would need a grate to tie into the street system. Item #3 in the letter was a note that approal of the plan is contingent upon the plan being connected to the town sewerage system. It was noted that this note has been placed on the plan as requested. Item #4 in the letter was a requestr=.that a three way gate valve be placed on East(Street. It was noted that this had been done on the utility plan. Item #5 was that the fire alarm pedestals be placed on the property line of lots 4 and 5. This was on the utility plan. Item #6 was that it be called Willis Street and not Willis Street Extension. It was noted that this had been corrected. A note was also added to the plan cross-referencing the plan to the covenant. Mr. Maloon presented to the Board a letter from Mr. Ceccarelli requesting an extension of time of 30 days for the Planning Board's consideration of Peter's Park Subdivision. It was noted that an easement and a notarized signature in agreement to the easement would be needed for all three parties for the drainage ditch. 9. Board met with neighbors who were concerned with the Peter's Park subdivision. Mr. Henry Austin questioned the water pocket on lot 5 and questioned where he was to pump the water from his cellar if this is developed. Mr. Maloon explained how the puddle would be graded to run towards the street. Chairman Zaffini advised Mr. Austin that in all fairnes to the developer that the developer is trying to solve the water problems in the area and will help the neighbors. C1erkDunn read the letter from Mr. Ceccarelli requesting an extension of 30 days for the Planning Board's consideration of the Peter's Park definitive subdivision Plan. -4 - Minutes June 18, 1975 Motion: To grant an extension of 30 days for the Definitive Subdivision Plan for Peter's Park for Planning Board consideration, until July 18, 1975. (Wellington -Davison, all in favor) VOTED 10. Board metwithRalph Maloon to discuss the preliminary subdivision plan for Americo P. Day for land on Fruit Street. It was noted that the Plan had not been officially filed, that he just wanted the Board's opinion. it was noted that the roadway going in is 50 feet plus or minus and noted that there probably a foot in either direction. It was noted that there is no corner roundings, but only a 30 foot curb radius. Mr. Maloon noted that tha sewer is running backward and that he would probably need permission from the Town to cross a few feet of Town owned land. The Board felt that the configuration of the roadway was inadequate and that it would have to be redesigned, even if it meant only having two lots instead of three. 11. Board met with Allen Willis to discuss the bond estimate for Spruce Acres subdivision. Mr. Willis noted that he could get $20,000 from the bank to complete the roadway and felt that he could complete the roadway for this amount and knew that the Town could also do this. He noted that the bond estimate received was $23,000:` He noted that it was the contingency that brings the cost up to high and that he is planning to ,go right in and do the work. He noted that the subdivision is 85% completed and questioned if the"Board could allow him something for the work which he;; has already completed on the other areas of the subdivision. Clerk Dunn noted that to bond one road they cannot take into consideration work done on another road in the subdivision. Chairman Zaffini noted that this is something that is required of all developers. Mr. Willis noted that he planned to install, rup to the and through the base coat before placing the bond. Chairman Zaffini felt that the contingency should remain the same, however the Board would consider his proposal. Mr. Willis stated that he has considered going underground on the electrical installation. The Board advised him to discuss this with Mr. Hall, superintendent of the Light Department. Board to get back to Mr. Willis. 12. Board discussed the bond estimate for Hemlock Lane in the Spruce Acres subdivision. Planning Director Maurer noted that the developeriput in extra work in Hall Street and that Mr. Willis got the short end of the stick from a local attorney who was trying to benefit his sone-, which held up the project for two years. He felt that if there was any way of giving Mr. Willis the benefit of the doubt they should do it as long as the Towns interest was protected. Planner Wellington noted that the installation of the sewer, water and storm drainage was installed for over one year and that the contingency for that amount of work did not have to be held, that they could just require the contingency on the work which remains to be completed. He also noted that this plan comes under the old regulations. Motion: That because the water, sewer and storm drainage was done prior to the Board's policy of retaining a 10% contingency that they will not require the contingency on the work which is completed. s IhPrP.fnrP_ the hnnd Psrinate set for work which remains to be Minutes June 18, 1975 -5 - completed for Hemlock Lane would be $21,270.00. (Wellington -Dunn, all in favor) VOTED 13. Board reviewed the letter of credit from the Taunton Co-operative Bank for work which remains to be completed in Magna Vista If for 650 feet of Lawndale Road. Motion: To accept the letter of credit from the Taunton Co -Operative Bank in the amount of $23,370.62 for work to be completed on the first 650 feet of Lawndale Road and to release lots 3,4, 5,23,24,and 25 on Lawndale Road. (Wellington -Dunn, all in favor) VOTED 14. Board reviewedthe memorandum prepared by the Planning Director regarding the revised bond esti% to for Elmwood Park. It was noted that a letter of extension of time was received for the letter of credit now being held for this work until June of 1976, however the new estimate comes to $47,850.16 and the letter of credit is only for $40,161.12. Motion: To accept the extension on the letter of credit in the amount of $40,161.12 and to request from Elmwood Park Realty Trust additional securities to bring the securities held up to $47,850.16 to cover the cost of increase in materials. (Wellington -Latham, all in favor) VOTED 15. Board discussed the request from Mansfield Industrial Park Realty Trust for a release of securities for work completed on Francis Avenue. Chair- man Zaffini questioned if anything had been done regarding the =hole in the pavement from the gas.; valve. Planning Director Maurer noted that he had not been back to check on it and that he has not mentioned it to Ryan, Elliott and Company. Board reviewed the memorandum prepared by the Planning Director comparing the work which remai'ned[:to'!:be completed as of February 6, 1975 and the work which has been completed. Motion: To release the monies held in the Union Warran Savings Bank in the amount of $34,464.00 plus all interest on this account, and explain why the balance of the monies is being held, as per the memorandum prepared by the Planning Director. (Wellington -Davison, all in favor) VOTED 16. Board reviewed the Board of Appeals notice of public hearing for George A. Doval for a variance for land on Mill Street with 30,000 square foot lot which does not have the proper frontage, itwas noted that the house which had existed on the lot had been destroyed by fire and that they plan to replace the house in a different location on the lot. Motion: To recommend to the Board of Appeals that since there was an existing dwelling on the lot that the variance be granted. (Latham -Davison, all in favor) VOTED 17. Board reviewed the Board of Appeals notice of public hearing for Edna Murray for a variance for a two family dwelling to a three family dwelling, making 4 families on one lot. Motion: To recommend to the Board of Appeals that the variance for Edna Murray not be granted. (Wellington -Dunn, all in favor) VOTED Minutes June 18, 1975 18. Dunner from North Attleboro for a variance to repair lawn mowers on Franklin Street at his mothers home, as a home occupation. Motion: To recommend to the Board of Appeals that the variance of Charles V. Dunner not be granted. (Dunn-Davision, all in favor) VOTED 19. Planner Latham questioned the status of the sign for Eastman Ford. Planning Director Maurer noted that he was not sure of the status of this. 20. Planner Dunn questioned if anything had been done with regards to the appointment of a new Planning Board Member. It was noted that nothing had been done. 21. Planner Wellington suggested the Board meet every two weeks, after next weeks meeting, as their summer schedule and to meet at 7:00 P.M. The Board was in agreement with this. 22. Planning Director Maurer informed the Board that they had met with the Mass. Division of Water Pollution Control and that there is no longer a regional sewer scheme, there is just the Town of Mansfield and that no district has to be formed as the Board of Selectmen are recognized as administrators of the program. However, they will be required to make provisions for Foxborough and Norton and funds are still available the same as if it were a regional project. He noted that if the two articles are passed at the Special Town Meeting on Tuesday, the facilities planning will start immediately. He noted that at the special Town Meeting that around $20,000 will be requested to be appropriated. 23. Planning Director Maurer noted that they talked a few weeks ago about the evaluation of the Planning Program and a sample questionaire was prepared, however they will not be ready for the Board until the next meeting as the copy machine broke down. 24.
