Planning Director Maurer advised the Board that the advertisement
was in the paper incorrectly because the applicant did not make the
situation clear. He noted that there is two dwellings on one lot
in which there are three dwelling units and they want to make it
four dwelling units. He noted that it is going to be readvertised
and a new public hearing will be scheduled.
3. Planning Director Maurer advised that no additional comments have
been received on the Peter's Park subdivision. He noted that in
discussion with RIM engineering that they are still negotiating
with the Housing Authority and may be asking for an extension of
time as the Housing Authority only meets once a month. Planner Dunn
questioned if the Board could request them to ask for an extension
of time in the event that detailed information is brought in at the
last minute. It was noted that under the General Laws they could not
but that most of the developers have been very cooperative.
4. Planning Director Maurer noted that the Plan for Camelot -at -Mansfield
had been officially submitted on June 3, 1975 and that the Public
Hearing is scheduled for June 25, 1975 and questioned if the plan would
have to be circulated to the various department heads were there was
no change in that respect. It was the consensus of the Board to
ciruclate the revised plan and ask the department heads if there is
any additional comments they would like to add.
5. Board reviewed the Board of appeals application of George Blais for a
variance to divide a lot presently containing two single family dwellings
on a 19,450 square foot lot. The proposal is to divide the lots so that
one dwelling would have 6,675 squarefeet and the other would have 12,775
square feet. It was noted that under the Zoning By-law this is permitted
for lots existing prior to zoning however it did require permission from
the Board of Appeals. Chairman Zaffini felt that the letter to the Board
of Appea;s should refer back to the Zoning By-law Section I=C -3.
Motion: To recommend that the variance be granted for George Blais.
(Latham -Dunn, in favor, Wellington opposed) NOT VOTED
Motion: To advise the Board of Appceals that the application is in
conformance with the present Zoning By-law Section I -C-3 and
does not warrant a recommendation from the Planning Board.

6. Board met with Peter Picciandra to review the site plan application for
land on Samoset Avenue. Mr. Picciandra felt that everything requested
by the Board has been added to the plan. He noted that if there was a
problem with the septic system that he would either join the two builidings
together or try to connect to the municipal sewer system. Mr.
Picciandra stated that the use of the property would be for the sale of
retail parts for motorcycles and not for any repairs. Planner Wellington
akked Mr. Picciandra if he would be willing to add this as a note to the
site plan. Mr. Picciandra noted that hewould be willing to do so.

8. Board reviewed the Form A Plan for George M. Farnam for land on East
Street. Planner Wellington noted that there were two North arrows on
the plan and they were going in two different directions. It was the
consensus of the Board to return the plan and advise the applicant to
have the north arrow corrected, the description corrected with respect
to north, south, east and west, and that the applicant sign the form:
A application in the correct place, as he has signed in the place for
the Planning Board Clerk -

11. Board reviewed the Form A Plan for Earl Ware for land on Balcom Street.
It was noted that the signature of the owner was not shown and that
Shaw Real Estate had signed under owner as his agent. It was noted
that if they are describing Parcel C then the description is wrong
in regard to distances shown and if they are describing the whole area
then the abbuttors are not shown. Plan to be returned to the applicant
for correction.
12. Board discussed the request from Millhaus construction for a bond estimate
for Circle C Estates. It was noted that the transfer of ownership was
recorded at the Registry of Deeds on June 3, 1975. It was noted that
the bond estimate prepared by the Planning Director was for 758 feet of
Morgan Road and the drainage in Pinto Way, drainage for a portion of
Maverick Drive and drainage out into the easement.

from Mrs. Jellinek regarding this development. Mrs. Jellinek presented to

the Board a work order issued by the Conservation Commission. Planning
Director Maurer noted that the State department of Natural Resources
has issued a years extension on this work order. Chairman Zaffini
questioned why Mrs. Jellinek had brought the stake in and she advised the
Board that the work was supposed to stay 25 feet away from here property
line and that they are only 10 feet away and that Mr. Brunelle: stated
that they are planning to leave a 1-1 slope and the plan calls for a
4-1 slope. Chairman Zaffini assured Mrs. Jellinek it would be a 4-1
slope.
It was noted that the bon&estimate is for 758 feet of road but only
the first 650 feet of roadway will be released. Chairman Zaffini noted
that Planner Wellington found no problem with the bond estimate however
Chairman Zaffini felt that no earth should be removed from the property
until the whole subdivision is completed as that is the only way that
it can be determined as surplus material and felt that this should be
sent in writing to Millhaus Construction. It was noted that the 10%
contingency is on the . section : ;, being constructed and will be
held until the entire project is"completed and as other areas are done
new contingencies will be required.
Motion: To send the bond estimate as prepared by the Planning Director
to Millhaus Construction and advise them that the 10% contingency
will be held until theproject is completed and will be reviewed
on an annual basis.

560 feet of Hemlock Lane in the Spruce Acres subdivision. It wasnoted

on the water tank and that they are x-raying as they go along. He
noted that they feel they may be ready to fill it in July.
15. Planner Latham noted that he had heard that they have had some legislative
action on zoning and felt that they shouldreview their zoning. Chairman
Zaffini noted that what he had heard was that in Arlington there was a
case where they stopped construction on all apartment buildings and the
court ruled in favor of the city. Chairman Zaffini felt that the sub-
division regulations should be reviewed. Planning Director Maurer reminded
the Board of their decision to hold the public hearing on this in September.

16. Planner Dunn questioned if anything was being done on the survey the
Board had discussed sending out with respect to the Comprehensive
Planning Program. Planning Director Maurer noted that he is in the
process of putting together various sections of the program for up-
dating and that he has to check with the Committees on their status
of the program.
17. Planner Dunn noted that in the subdivision for Willis on Ware Street
that it appears that the size of the stream has been enlarged and questioned
if this was normal practice or if something should have been filed with
the Conservation Commission. Planning Director Maurer noted that this
usually required the filing of an intent with the Conservation Commission
but did not know in this instance as this was a man made stream. Planner
Dunn felt that in the future some notice of intent should be filed.
18. Planner Wellington noted that in the monthly statement from the Planning
Director on the status of subdivisions regarding the Mansfield Industrial
Park, that the intersection at Francis Avenue and Maple Street the report
states the adjustment of castings in the street and that sometha:Og:'g6t
left out and there is a ,.i hole in the pavement; and that Owens-Illinois
should be complaining about the driveway the way the street was put in
and that at the intersection of Francis Avenue and Oakland that around
the curve they have granite curbing, 40 feet of blacktop and then granite
curbing again and noted that, even though it conforms to the regulations,
it looks terrible for an entrace to an industrial park.
Planning Director Maurer noted that it is the gas gate and that they have
notified the gas company right along to have it raised and they never showed
up and that as far as Owens-Illinois driveway, the driveway should meet
the grade of the street and the adjustment should be made by Owens-
Illinois.
19. Motion: Not to meet until June 18, 1975.
(Wellington -Latham, all in favor) VOTED
Planners Parsons and Davison to be notified of this.
20. Chairman Zaffini questioned who surveyed the property on Casa Drive which
required the variance, as per last weeksminutes. Planning Director Maurer
noted that in talking with RIM Engineering that they were not involved
in the actual staking of the lots and that they were asked by a real
estate company to prepare a certified plot plan and when the plan was
being prepared the error was noticed. He noted that RIM has been
retained by property owners in the area to survey the lots and that
RIM mentioned two others that are incorrect and after the hearing they
have found that there may be six incorrect. Planner Director Maurer
felt that this was negligence on the part of the builder.
Planner Dunn questioned who is responsible of the staking of the lots and
it was noted that there is no requirement for this. Planner Latham felt
that the location of the foundation should be certified prior to the
issuance of a building permit.
21. Chairman Zaffini informed the Board that he received a telephone call from
Val Scarpellini regarding the waiving of the sidewalks in Foxfield Estates
and that he noted in Walnut 'Park they were not required to put in granite
curbing and questioned why he should. Chairman Zaffini has advised him that

advised the Chairman that this matter is going to be considered by a
state attorney.
22. Planning Director Maurer advised the Board that on the report on the
Flood Plain insurance that the Town received there will be a public
meeting on this in about 4 weeks. He noted that this as a federal
requirement and that persons trydng to obtain a mortgage in towns that
do not have this flood plain program that the mortgage can be refused.
Blanning Director Maurer noted that most of the conditions in the
program are covered in the Water Body Setback and wetland protections
Provision of the Zoning By-law however„ this should be compared and
checked out.

has advised that the pump for the Witch Pond Well will be delivered
