3) Board discussed the Minutes of May 14, 1975. Planner Parsons questioned
the Form A Plan for Carl Nelson for land on Williams and Tremont Street
and questioned if the driveway for lot 12A had been increased. It was
noted that it had not been.
Motion: To approve the Minutes of May 14, 1975 as presented.

Board met with Robert Eames to review the Form A Plan for Jess Realty
for land on Darby Drive. Mr. Eames noted that on the shaded area
Mrs. Rogovin of Jess Realty ownes about 37 acres in the rear and that
someday there would be a road going through and out to Stearns Avenue.
Mr. Eames felt that the easement for the roadway should be shown on the
plan for the benefit of the future buyer. Planner Dunn questioned if
the person who owns the lot owns the easement could a builder-: put a
road in as he really doesn't own enough land. Mr. Eames noted that the
deed reads that the shaded area on the plan is an easement to_be used
for road purposes. Mr. Eames noted that the plan could be submitted
without the shaded area as the easement would be put in the deed, but
felt that the shaded area should be shown on the plan to protect the
person buying the lot. Planner Dunn questioned if the plan came in
in the futre for the road could the Planning Board approve the roadway
without the applicant of the subdivision owning the entire radius. It
was n oted that the applicahtof the subdivision would have to prove
ownership of the entire right-of-way and radius. Planning Director
Maurer noted that the plan should be stamped with the statement that
approval of this plan does not imply approval of any future roadway
for any future subdivision.
Motion: To sign the Form A Plan for Jess Realty for land on Darby
Drive stamped "Approval of this Plan does not imply
approval of any future roadway for any future subdivision."

Board reviewed the memorandum from the Planning Director regarding the
release of securities for Village Estates Section III. It was noted
that Christian and Schromm had requested a release of $9,050. The
memorandum compared the work done with the amount being held for this
work for the water, drainage, and gravel, with the exception of the
headwall for the drainage. It was noted that since the request had
been received other work had been completed in the subdivision.
Motion: To release $9,050 of the$27,189.14 being held in escrow
by the Mansfield Co -Operative Bank for the completion of
the water installation, gravel, and drainage up to the
headwall in Village Estates Section III.

Board reviewed the memorandum from the Planning Director regarding the
Bond estimate for Foxf•iold Estates. It was noted that Mr. Scarpellini
had requested verbally to the Planning Director a request for a waiver
of sidewalks. The total of the bond estimate for the 313 feet of roadway
with the 10% contingency was $26,385.20. The Board noted that the only
subdivision which had received a waiver of sidewalks on one side was
Pine Needle Park and felt that this was not a good practice. It was noted
that no formal request in writing had been received.

Motion: To approve the Bond Estimate for Foxfield Estates for 313

Board met with Patrick Kelly of Millhaus Construction and Walter Millette
of Waldor Realty to discuss the approved Circle C Estates subdivision.
Mr. Kelly noted that they have signed a purchase and sale agreement with
Waldor Realty for the Circle C Estates and that the passing will be on
Tuesday, May 27, 1975. Mr. Kelly noted that they would like to develop
all of the streets hopefully by next year, however they would like to put
in an area of Morgan Road and put 3 houses in for models. He noted that
while they are building those houses they plan to work on the balance of the
development of the road system. Mr. Kelly noted that he is looking to
post a bond or letter of credit for the 650 feet of Morgan
Road. It was noted that the 650 feet would take in 6 lots. Mr.Kelly
noted that there is equipment at the site now and that they have not
moved any of the earth, only stockpiled the loam. He noted that there
is a surplus of material on the site. He stated that between now and
the end of fall all of the roads would be constructed.
Planning Director Maurer noted that in order tobond a section of Morgan
Road the drainage from the project all exits in one area and the Bond
Estimate would have to include the work in the drainage easement. He
noted that even though it is a short section of Morgan Road the bond amount
would have to include the completion of the drainage system which services
Morgan Road such as the drainage system in Pinto Way and a portion of
Maverick Drive, as well as the drainage easement. Planning Director Maurer
questioned if the lots requested to be bonded had received approval from
the Board of Health. Mr. Kelly noted that they had been.
Chairman Zaffini questioned if the Board of Health had given them any
restrictions on the disposal of the stumps. Mr. Kelly noted that they
had only piled the stumps as they knocked the trees down but they have
not buried them. He noted that the Board of Health had given them no
restrictions on this. Planning Director Maurer noted that it is the
Board of Health's policy to only allow the stumps to be buried on the
lot lines. Board to get back to Mr. Kelly.
Mr. Millette noted that he has received a substantial deposit on the
property and the titles have been searched and the passing of papers on
the property will be next Tuesday. Planning Director Maurer advised
Mr. Kelly that the Board could not release any lots to Mr. Kelley until
he proves ownership of the land.
Board met with Gregory Cauldwell to discuss a lot on East Street. Mr.
Cauldwell noted that he has purchased a lot on East Street from Mr. Flint
and after the purchase found it to be a non -conforming lot in area. He
noted that it has been an existing lot since the Civil War, however since
Zoning went in to effect Mr. Flint had purchasedit and had continous
frontage with other land, which now makes the lot non -conforming. He
noted that he took the liberty of having the percolation tests done.
He noted that the proposed dwelling conformed to all the zoning requirements.
He noted that he hoped the Board would give him a favorable recommendation
on this variance and questioned what the next step was..

The Board advised Mr. Cauldwell to file the application for the variance
with the Board of Appeals and that it is the Planning Board's procedure
to wait until the notice of the hearing is received from the Board of
Appeals then they make a recommendation. Mr. Cauldwell noted that when
the percolation tests were taken that no water was even poured into the
hole, that all Mr. Gaynor did was take a look at the soil, called it
boney gravel at 5 inches per minute and passed it.
9. Board reviewed the Zoning Board of Appeals application for the Town
of Mansfield to erect a sign to show the Businesses in the East:Mansfield
area. Planning Director Maurer noted that it is a similar sign to that
in West Mansfield. He noted that there is a proposal to put this same
type of sign on North Main Street on the island primarily for the
direction of traffic because there has been a problem with trucks for
Owens-Illinois and Blane Chemical. He noted that this request will be
made in the future.
Planner Latham noted that this sign should also be used to show where
the various streets are in East Mansfield.
Motion: To recommend that the variance be granted to the Town of Mansfield
to erect a sign to show the businesses in the East Mansfield
area and to recommend that the location of the streets in East
Mansfield be put on the sign as well.
(Latham -Dunn, all in favor) VOTED
10. Board reviewed the Zoning Board of Appeals.application of William A.
Regan. It was noted that the house was put in the wrong location on
the lot on Casa Drive and that it is too close to the property line.
Planning Director Maurer noted that the Regans went to remopgage their
home and that the bank would not give a new mortgage because of this
error. Planner Dunn questioned if there was an inspection on the
foundations forms before they are poured. Planning Director Maurer
noted that at the time these homes were bu l.t.that there were not
any plot plans required, but they are required on all recent permits
both by the Zoning By-law and by the State Building Code. Planning
Director Maurer noted that in Norton before a building permit is issued
they require a certified plan of the foundation. Planner Latham felt
that there should be something in the Building Inspectors laws that
the forms are certified before the building permit is issued.
Motion: To recommend that the variance for William A Regan be granted.
(Latham -Dunn, all in favor) VOTED.
It was the consensus of the Board to request the Building Inspector to
meet with them to review his procedure for issuing building permits to
see if this error can be eliminated.
11. Board met with John Smith and Bob Morrison of C & S Contracting Company
to review the site plan for land on School Street. Mr. Smith noted that
he would like to put a garden shop in but he did not want to put alot
of money in it until he finds out if it is going to pay off. He noted
that he did not plan to put any Plumbing into the building and that the
parking lot would be gravel and would run into the street unless this was
a problem, then he would regrade the lot. He noted that the lights are
on the tanks presently, and there would be not loading area.

Minutes

Chairman Zaffini noted that everything required in the Zoning By-law should
be on the plan. Planner Latham noted that most plans show where the
driveway opening will be and where the water from the parking lot will
drain. Planner Dunn noted that the parking area does not show any
relationship as to where it will be.
Chairman Zaffini felt that something should be shown to hold the refuse,
even if it is something that they build themselves. The Board noted
that they would need water to water the plants and Mr. Smith noted that
he may put a pump in with a faucet': for this, but this will not be done
for some time. It was noted that the following was needed:
1. Show area for refuse disposal
2. elevations of the parking lot to show where the water will run
3. elevations of street to show the water will not run in street
4. existing lights on tanks
5. show where the shhubs will be stored
6. show the openings for the driveways or if it is all open eliminate
the lines shown.
12) Board discussed the Memorandum prepared byt he Planning Dmrector for the
bond estimate for Circle C Estates. Board felt that no action should be
taken until some documentation of ownership is presented to the Board.
13) Board discussed the Bond Estimate for Magna Vista II. Planning Director
Maurer noted that they had completed about 85% of the storm drainage and
50% of the water. He noted that Home Developers requested a bond estimate
for after the binder has been installed. Planning Director Maurer noted
that the total cost of the project was figured first at $201,490.63 with the
10% contingency. Planning Director Maurer noted that he has seen the contract
with Bella Construction for this work and that the contract, which is good
for one year, is for $140,000 for the same amount of work as in the bond
estfemate with the exception of the gravel and the loam and seeding and setting
of bounds.
Planning Director Maurer noted that the estimate for the completion through
the binder coat would be $55,292.70 and the contingency would Ve for the
amount of the entire project, which is $18,377.33. Planning Director
Maurer noted that Home Developers had applied for percolation tests, but
the time period for this has elapsed and the Board of Health may not do
the tests. However, two lots have been tested and may be sold so Home
developers would like a bond estimate for the first 660c'feet;of Lawndale
Road for the releasing of 6 lots. However, the bond estimate for the
first 650 feet would include the drainage for Lawndale Boad, the draiaage
for Tanya Drive and the water and construction of Lawndale Road, which
comes to $43,368.75 plus a 10% contingency of $4,336.87.
It was noted that this plan was approved under the old regulations and
no granite curbing or underground wiring was required. It was noted that
if they bond only 650 feet that provisions will have to be made for a
temporary turnaround. It was noted that assuming the estimate is requested
for after the binder is installed then the bonding of the 650 feet of
Lawndale Road would be $13,404.37. It was noted that the bonding of only
650 feet was the most recent request by Home Developers because of the
delay in the percolation tests.

Motion: To forward the bond estimate for the first 650 feet of
Lawndale Road to Home Developers in the amount of
$47,705.62, which includes the drainage for Tanya Drive.
(Davison -Latham, all in favor) VOTED
Planning Director Maurer noted that when this plan was approved there
Was an easement provided out to Stearns Avenue for the looping of the
water system. He noted that Home Developers agreed to put the valve in
Tanya Drive and put the water main out 25 feet. It was understood that
at sometime the Town dould go in and extend the water line out to Stearns
Avenue. He noted that the Town put out to bid the 400 feet of water line
only and that the agreement is that the town supply the water pipe and
pay for the installation of the pipe up to $1,000 and anything beyond
that amount Home Developers will pay for. This is going to be completed
by Bella Construction in conjunction with the development of the project
at a price of $1,400. Home Developers will pay the $400.
14) Mrs. Margot Jellinek requested to be put on the Agenda for the next
meeting to discuss Circle C Estates.
15) Clerk Dunn questioned if the State was going to do anything with the
Regional Sewer District. Planner Latham felt that they may. Planner
Latham felt that the Commission should inform the State of their votes
and then go from there. Planning Director Maurer felt that communication
from the Town to the State is the next step as Mansfield can't sit back
while the other two towns try to find their way. Clerk Dunn questioned
if Mansfield still expected to go under Chapter 21 or if they would go by
special legislation, and noted that there were several questioned that
he felt should be answered Under Chapter 21 before the State mandates
the formation of a one town district.
16) Planner Davison questioned if the foundation had been poured in Village
Estates Section III before the release was signed for the lots last week.
It was noted that they had been. Chairman Zaffini questioned if the
Building Inspector was going to send the Planning Board a copy of
correspondence regarding this.
17) Chairman Zaffini read a letter presented by Mr. Brad Johhson requesting
a new Public Hearing for Camelot at Mansfield.
18) Planning Director Maurer advised the Board that a meeting is scheduled Wednesday
next week at 8:15 with the Board of Selectmen to discuss I-495 utility
connections. He noted that the Selectmen are also going to meet that
evening With the S6Wer Study Committee to discuss the future direction for
the sewerage.
19) Planning Director Maurer reminded the Board of the Public Meeting on
Thursday, May 22, 1975 at 8:00 P.M. for the presentation of the downtown
plan by the Harvard Graduate School of Design.
20) Clerk Dunn questioned if the plan for the Sears Mall had been turned down.
1 It was noted that they have two more weeks to conform to the State Laws
and that one of the reasons for the turning down of this was no way of
handling the effluent.
21) It was noted that the I-495 project had stopped because of no funds.
221 Meeting adjourned t 10: 5 P.M. 7
