MINUTES
March 31, 1975
Present: Chairman Zaffini
Planners: Davison, Latham, Dunn, Wellington, Parsons
Planning Director Maurer
1) Meeting called to order at 7:00 P.M. Discussion was held on the Sanitary
Engineers report for Camelot -at -Mansfield subdivision.Board ;reviewed the
comments made in ;the report. (Planner Parsons entered the meeting.) Board
adjourned the meeting until Town Counsel arrived.
2) Meeting reopened at 8:15 P.M. for discussion with the Town Counsel.
Motion: To go into executive session to discuss the details'of,cthe
Planning Board's decision on Camelot -at -Mansfield with the -
Town Counsel,
(Dunn -Wellington, Latham, Davison,, in favor, 'Parsons opposed)VOTED
Town Counsel advised that if the Board makes a decision they can amend that
decision only to 'support the original decision and that it is acceptable during
the appeal period to add additional reasons for the decision. The Board can '
t .not revise its original decision. The previous' disapproval by the Board was
a'technical disapproval whereby all the ,Information had not be submitted.
Town Counsel advised to 'reference the Planning Board's decision back to the
decision of the Board of Health that requires that the 'burden of proof be
placed upon the developer to prove that the drainage system will adequately
drain the property, it was noted that the approval of the 9 lots with the
ground in the existing condition does not make any sense for the magnitude of
the development as proposed. It was suggested that the Planning Board add
additional comments to the disapproval which would more definitively tie down;
the reasons for disapproval. The Planning Director to draft the reasons for
the consideration of the Board at the next meeting.
