Motion: That as long as the applicant has complied with all of the comments 3n the Planning Board's letter of March 7, 1975, as well as the Planning Directors comments, that the preliminary plan for Green Acres Subdivision be ;approved. (Wellington -;Latham, all in favor) VOTED 7. Board discussed the preliminary subdivision plans for Alperin Estates. Planner Wellington noted that they should deny the plan as the pro- posed route L40 relocation would be `'taking ;the access road to the subdivision. Planner Wellington noted that in Walnut Park the applicant relocated his lots in accordance with the proposed taking of the roadway. Chairman Zaffini and Planner Latham questioned if they could legally deny the subdivision because of this. it was the consensus of the Board to write a letter to Town Counsel telling him that they have to have an answer by the next meeting and question if they can deny the plan; as it is obvious that the taking 'line of 'Route 149 will not leave a suitable access to the site and if they can ,not deny the plan for this reason, what action can they take. 8. Board reviewed the memorandum from the Board of Selectmen regarding the Rumford River Sanitary District. Motion: To send the Board of Selectmen a letter recommending .the'formation of the Rumford 1iver,Sanitary4Distrlct. ,; (Wellington -Dunn, all in favor) VOTED (Planning Director Maurer entered the meeting at this time.) Planner Dunn noted that the 'acceptance of the District would give the District Commissioners the authroity to make all decisions, Chairman Zaffini questioned what would happen if at Town Meeting In Mansfield voted to form the district and Norton and Eoxborough did not. It was noted that it could then still be formed by mandate from the State and the State would select the District Commissioners. 9. Planner Dunn noted that the Capital Improvement Committee suggested an appropriation of $40,000 instead of $80,000 forthe Regional Sewer; and questioned if they would have to go back to Town Meeting for additional funds if the district wasn't formed and more money was needed if it was just two towns. Planning Director Maurer noted that the ';$40,000 would be in an account for the Regional Sewer District only and :noted that it might be announced at the Public Hearing on Tuesday, March 18, 1975 that the money is available from the State so that the Towns will not have to put up as much funds.
