Planner Dunn notedithat if theroads.:ai-eibuirlt without a bond oh.the entire project that they should still hold a 10% contingency on everything and questioned how this would be set up, Planning Director Maurer noted that when the plan is approved that the Planning Board should prepare a bond estimate on the entire project, including the 10% contingency and if they do not request a bond figure immediately the figures will be up -dated when the bond is requested. If some of the work has been completed, rqquire a bond for the work which remains to be completed, plus an :!,additional bond for the 10% contingency for the entire project. Motion: To require this of all subdivisions. Planner Parsons suggested that if no projects are undertaken and if the agenda remains nil) that they consider meeting every other week. 16. Planner Parsons questioned why Taylor's land; on Brown Avenue was not required to go by the Wetland Protection Act of the Zoning By-law. Planning Director Maurer noted that there is 30,000 square feet 'of land with 5,000 square feet of wetland, which was filled with permission from theConservation Commission. Under the new Wetland Provision the lot was only undersized by a couple of hundred feet." The sink hole was filled in its entirety and'theBoard of Health has given permission for the septic ;tank. As far as the provision for the Wetland Protection, they felt that because it was filled it is nolonger considered wetland. Planning Director Maurer noted that it was the intent of the Zoning By-law that it be a buildable lot before it was filled but others - are not interpreting, it in this manner. Clerk Grant felt that the intent was that if the Conservation Commission allowed it to be filled that it could then be considered to be a buildable lot.Board reviewed the minutes of the Board of Health of 'February 25, 1975 in which the Town Counsel interprets that once the lot is filled it is then a buildable lot. Motion: To send a letter to town Counsel that it is the intent of the Zoning By-law that it must be a buildable area before any filling of the Wetlands.
