Planning Board to Town Counsel regarding Camelot -at -Mansfield.
Norton Planning Board to Easton Planning & Zoning Board regarding
Norton water 'supply.
2. Board discussed the minutes of February 12, 1975. Planner Wellington
questioned when the Water Department received the letter from the
State Department of Public Works regarding the condeming of the property
of'Vazza and stating that the utilities were now the responsibility of
the Town as the property was condemned on July 26, 1974 and felt that
if the letter was not sent to the Town on July 27, 1974 that a letter
should be send to the State since they are obligating the Town without
notifying them of this obligation. Planner Director Maurer to find out
exactly when the letter was received by the Water Department.
Motion: To atcept''the Minutes of February 12, 1975 as presented.
(Latham -Grant, all in favor) VOTED
3. Board discussed the Board of Health procedure for percolation tests and
Planning Director Maurer noted that he had been incorrect in his state-
ment at the previous meeting in that he noted that Camelot -at -Mansfield
had paid for and applied for 18 percolation tests in July and noted that
the correct application date was April 25, 1974 for only 15 lots and on
December 26, 1974 the remaining 20 lots were applied for by the developer.
However, he noted that there was a substantial amount of time from when
the application was made to when the Board of Health actually scheduled
the percolation tests, which was December 12, 1974. Planning Director
Maurer noted that he discussed this with Mr. Folan of the Board of Health

on Tuesday and Mr. Folan noted that there had been correspondence to the
developer regarding the scheduling of the percolation tests. Planning
Director Maurer noted that while thePlanningBoard was keeping the Board
of Health informed of the status of the plan for Camelot -at -Mansfield that
the Board of Health was not extending the same courtesy.to the Planning
Board.
Planner Dunn noted that he went to the Board of Health meeting because
he understood that a tape of the Planning Board meeting had been brought
to the home of one of the Board of Health members and felt that someone
should be present from the Planning Board to clear up any misunderstanding.
Planner Dunn felt that the Board should not get involved with the fact that
another Board is taking too long to make a decision and felt that the Board
should takc;acx, ignonly on what is submitted to them and if the 'Board of
Health has not granted approval then the plan should be disapproved as
advised by Town Counsel. Planner Dunn also noted that Town Counsel stated
that an extension of time could be granted for the Board 's'FcbnsIderation
of the plan if the disapproval is rescinded within the 20 day appeal period
and this would not require a new public hearing.
4. Planning Director Maurer advised the
from the Department Heads regarding
plan.
5. Planning Director Maurer advised the
from the Department Heads regarding

Board that no report had been received
the Green Acres preliminary subdivision
Board that no report had been received

Committee. Planners Wellington and 'Davison volunteered for the
appointment.
Motion: To appoint Planner Wellington to the School Study Committee.
at the Planning Board's representative.
(Parsons -Dunn, all in favor) VOTED
7. Board reviewed the application for the Board of Appeals variance for
Clifford B. Turner. Planning Director Maurer noted that MC. Turner
only owns to the right-of-way and not the right-of-way. (Planner Dunn
left the meeting to attend the Board of Selectmen meeting regarding the
mechanica:4 dewatAring device for the treatment plant) It was noted by
Clerk Grant that the deed states that Mr. Turner has rights to the right-
of-way along with others. It was noted that it was a 'land locked piece of
land with no frontage to it. To be discussed further when the Board of
Appeals notice of Public Hearing is received.
8. Board reviewed the Board of Appeals notice of Public Hearing for Earl
C. Goodwini for a variance to establish a lot for dwelling purposes
adjacent to; land owned by Warren Collins at 1094 School Street. Said
lot has a frontage of 103 feet which makes the use non -conforming in
an Agricultural Zone. It was noted that the parcel consists of 2.5 acres.
Motion: To recommend that the variance be granted for Earl C. Goodwin
with the condition that the 2.5 acres remain one lot.

9. Board met with Mrs. Margot Jellinek to discuss the Camelot -at -Mansfield
subdivision. (Planner Latham left the meeting),- Mrs. Jellinek read
letters from theBoard ofHealthto the applicant.for the -Camelot -at -
Mansfield subdivision. Mrs. Jellinek felt that the covenant for Camelot
was not sufficient and that the Board should require a bond. Mrs. Jellinek
stated that she was going to file with the clerk to make the Board members
personally responsible if anything happens because the covenant is not
sufficient unless they vote to require a bond.
Chairman Zaffini stated that Town Counsel reviews the covenant and the
Board has to go by Town Counsels acceptance. Mrs. Jellinek stated that
she would like to have Town Counsels signature of acceptance on the
covenant.
10. Board discussed the letter from the Easton Planning Board requesting
information on the well sites in the vicinity of the Easton line. Planner
Wellington suggested that the Planning Director send the necessary information
as to the location of the wells, how much land area is owned, and how far the
well sites are from the Easton town line.
11. Chairman Zaffini suggested that Town Counsel review the covenant for Camelot -
at -Mansfield.
12. Chairman Zaffini noted that he and Planners Dunn and Davison and Planning
Director Maurer attended a meeting on the regional sewerage. Planning
Director Maurer noted that the meeting was held for the Conservation
Commissions, Board of :Assessors and Planning Boards of the three towns and
also ,the Board of Health of Mansfield. He noted that the purpose of the
meeting was to explain the concept of the regional sewer and to answer
any questions the boards might have or get the answers for the Boards
prior to the Town Meeting.
13. Planner Wellington noted that he would like it to appear on record that he
has been a member of the Planning Board for five years and feels for the
first time that, as a member, he has been threatened by someone uh:lesshe -
votes a certain way.
14. Planner Wellington:stated that he made the comment before that the Planning
Director do his homework prior to the meetings such as in item #8 of the
minutes of February 12th when Mr. Antosca appeared before the Board. He
noted that it would have been much easier to have the 6 items listed before
him stating what needed to be complied with instead of having to go back
through all the correspondence. Planning Director Maurer noted that he had
not seen the plan until the meeting itself. Planner Wellington felt that
the items to be complied with should have been prepared ahead of time.
(Planner Dunn entered the meeting from the Selectmen's meeting.)
15. Planner Dunn noted that the Selectmen appear to be in favor of the dewatering
as proposed by Camp, Dresser, McKee and they feel that they could get it
through funds and not have to go through Capital Improvement funding. He
noted that they are talking $95,000 and that there is presently $60,000 that
must be used for the sewer plant and another $30,000 will be coming in. He
noted that it would require the hiring of one additional personnel at the plant.
He noted that the EPA sent a letter to the town two weeks ago that they have to
improve the plant.

16. Planner Dunn noted that the selectmen took a vote at their meeting to support
the Regional Sewer.
17. Planner Parsons questioned if any of the pipes for the sewer had been sealed
recently. It was noted that they have been working on this for the last two
weeks.
18. Chairman Zaffini noted that on the Maple Street end of Francis Avenue the rail
cars come in and leavethe freight cars right across Francis Avenue. It was
noted that they are only left there for about 1/2 hour.
19. Planner Wellington stated that based on Mr. Gra0y's, Town Counsel, opinion and
on all the other information received that he hopes the Board will take some action
next week so that in no way will they have to hold another Public Hearing
as they have already had two and he did not feel that there should be a third
hearing when the applicant has complied with all of the Rules and Regulations
of the Planning Board. Planner Wellington stated that the 3rd paragraph of
Town Counsel's letter be quoted to Mr. Antosca so that they can rescind their
decision, or do whatever they have to so that another Public Hearing will not
have to be held.
