Board discussed the definitive subdivision plan for Rustic Acres. It was noted that the Public Hearing is scheduled for January 12, 1977 and that the Board has requested that the department heads submit their comments prior to the Hearing. Planner Tighe recommended that they make sure the reports from the department heads are submitted in writing in order that the Board will have a statement from each department concerning their review of the project. Planning Director Maurer reported that Ralph Maloon had submitted a revised statement on the test holes that indicated who witnessed the test holes and the document was stamped and signed by Ralph Maloon. The Board will walk the site on January 8, 1977. RIM Engineering will stake out the roadway and the drainage easement. Planning Director Maurer noted that most of the roadway had already been cut and that most of the loam was used for lots that had frontage on the street. Board reviewed the earth removal application for Norman Gray off South Main Street. Planning Director Maurer submitted a memorandum noting many discrepancies between the plan as submitted and the Zoning By-law. Ralph Maloon was in attendance and went over several of the points with the Planning Board. Question was raised <'concerning the fact that the 100 foot buffer as required in the Zoning By-law is not maintained, and Ralph Maloon stated that the purpose of this was for the applicant to acquire more material from the operation as well as provide better locations for the houses when they are constructed as part of the sub- division. He also noted that the elevation as shown on the earth removal plan was lower than that proposed elevation as shown on the definitive subdivison plan. It was the consensus of the Board to ask Mr. Gray to meet with the Board prior to their making a formal recommendation. Board met with Mr. and Mrs. Gene Ceccarelli regarding the loam and seeding of the drainage ditch south of East Street. Mrs. Ceccarelli noted that the Town has tied into the drainage on Park Street and this goes through their subdivision and to the ditch and that prior to the construction that the Town had several catchbasins on East Street that ran into the ditch. The Planning Director advised that the drainage ditch did exist prior to the subdivison, however it had to be lowered approximately 1 foot to pick up the drainage from Peter's Park subdivision, as well as be relocated through the Housing Authority property. Mrs. Ceccarelli noted that the plans, as approved by the Planning Board, do not contain the statement that the ditch would have to be loamed and seeded and that the project was put out to bid with a contractor and the bid was based upon the construction of the ditch alone. She noted that at the time of the Planning Board preparing a security estimate that she objected to the Planning Director that he had figured in the loam and seeding. However, it was not pursued and they posted the money because they were interested in proceeding with the project as soon as possible. Mrs. Ceccarelli also questioned the problem with the granite curbing at the intersection of Willis Street. It was noted that it did not conform to the Subdivision Regulations and that her contractor would contact the Planning Director. The Ceccarelli's left the meeting. 3 Minutes December 29, 1976 -f' - Board discussed the request of Mrs. Ceccarelli. It was noted that the subdivision regulations do contain a provision for seeding slopes and that it is a normal engineering practice tol;oam and seed slopes after they are completed. Motion: To write a letter to the Ceccarelli's advising them that the Board will require the loam and seeding of the slopes on the ditch as required in conformance with the Subdivision Regulations and as outlined in the original estimate of securities dated March 5, 1976 in the amount of $2,880. (Mahana-Plourde, all in favor) VOTED 7. Board reviewed the approval not required application for Paul Boyden for land on Dean Street. It was noted that it complied to the Planning Board Regulations with the exception that there was a reference to a subsketch A and there was no subsketch A shown on the plan. Motion: To return the plan to Paul Boyden to have the plan adjusted to clarify the statement on the subsketch. (Mulcahy -Hartmann, all in favor) VOTED 8. Board discussed the Business Zoning. Planning Director Maurer advised that he was unable to contact SRPEDD as they were on vacation last week. Planning Director Maurer gave a summary on the meeting with the Board of Selectmen and the Downtown Development Committee. Clerk Tighe felt that the Planning Board should still proceed with a rezoning for business areas. 9. Board reviewed the letter from Christian and Schromm regarding the release of securities for Village Estates Section II. It was noted that they are requesting the release of securities for all of the work that has been completed, as well as an additional $9,743.94 of the contingency, which would leave a balance in the account of $5,765.18, which is the contingency based on the value of the work they had to complete at the time of the posting of the securities. The original contingency was $15,509.12, which was based on the 'value of the entire project. Itwas noted that the drainage and water has been installed for more than a year and a half. It was noted that Christian and Schromm wants to release the entire' letter of credit and then will post the contingency in a passbook. Motion: To release the entire letter of credit for Christian and Schromm with a balance of $45,813.50, subject to Christian and Schromm filing with the Town of Mansfield a passbook in the amount of $5,765.18. This amount is the contingency for the project and will be held by the Town until December 29, 1977. (Mahana-Hartmann, all in favor) VOTED 10. Planner Mulcahy recommended that the bonds be adjusted in order to clarify the situation of contingencies. He noted that the past several bonds that have been release there has been an adjustment in the con- tingency due to the change in the Planning Board's policy. He felt that -4 - Minutes December 29, 1976 this should be clarified. Chairman Parsons felt that a list of all of the Board's policies be prepared. 11. Clerk Tighe felt that for the next meeting a list of changes in subdivision and zoning should be submitted in order for the Board to determine what action should be taken. 12. It was the consensus of the Board to hold the next Planning Board meeting on January 12, 1977. 13. Planning Director discussed the Annual Report and advised that he would send a copy out with the next mailing. 14. Meeting adjourned. LV16, e Clerk ,f iZ77- Date, At the meeting of the Planning Board on March 17, 1976 there were 2 points listed which should be clarified prior to the meeting of March 31st. 1) The minutes of March 3, 1976 showed Planner Dupont as being present and having participated in the vote on items 5, 11, and 14. The minutes have been adjusted accordingly, and I want to apologize for any inconvenience that this may have caused the Board. 2) Gas bills for the Town Managers car; forthe past two years I have not used my personal vehicle on Town business because I do not feel that the 14t per mile reimbursement is adequate to cover the cost of using the vehicle. Instead, I use the Town Manager's vehicle for the routine Planning Board inspections and any trips that have to be made on Town business. During the period for which the bill covered I made one trip to SRPEDD on the downtown development project, one trip to Easton on the Clemmey rezoning, weeklyrtrips to the flowmeter, and several trips on inspections for subdivisions, including Circle "C" Estates, Peter's Park, and Magna Vista II. While the total amount of travel may not have been equivilent to the total value of $39.67, I feel that throughout the year the use on the vehicle averages out and that less money is spent by paying the gas fee as opposed to paying the mileage of 14 a mile. The last bill that the Planning Board paid was for $29.43 on January 20, 1976. I feel that the utilization of the Town Manager's vehicle for the travel of the Planning Director in forfilling his responsibilities is a much more efficient and economic use of Town resources.
