Motion: To sign the form A Plan for James Wheeler for land on West
Street.

5. Board reviewed the definitive subdivision plan for Rustic Acres. It was
noted that it was originally submitted as a preliminary plan in December
of 1973, which was disapproved because all of the conditions of the
Planning Board had not been complied with. It was noted that the
disapproval was iba&elon the ditch in the street that ran parallel to
the street and an open ditch that ran along the proposed roadway. There
was also a request for elevations, which were not submitted. Planning
Director Maurer noted that the drainage ditch that ran along the roadway
was filled in and a pipe was installed through an easement and down around
250 feet in the proposed roadway. He noted that the plan should show the
pipe in the first 205 feet of roadway as existing.
Board reviewed the test holes taken. it was noted that lot 9, in the
area of the test hole would need about 2 feet of fill. Planning Director
Maurer noted that one concern on the plan was the low site and the amount

fill. The second area of concern is the storm drainage as it would
run through easements between lots 9 and 10 through a headwall and
would discharge into the stream in that location. He noted that one
item missing is several water elevations. Additional information which
the Planning Board had requested was season high water elevations, the
proposed elevation of each lot, and the elevation of the Canoe River
in relationship to the proposed development, the method by which the
water will drain into the Canoe River, and the impact of the filling
of the wetlands and what it will have on the surrounding property.
Planning Director Maurer noted that the character of the land has
changed considerably since the submission of the preliminary plan due
to the drainage ditch. Planning Director Maurer noted that an item
that is critical is the Canoe River as it is a fiat river. Planning
Director Maurer felt that they should reroute the drainage into a ditch
on the applicants own property to get to the stream in the rear.
Chairman Parsons suggested that they have a field trip of the site to
help in their discussion on the plan. Public Hearing to be scheduled
for January 12, 1977. Plan -,to be forwarded to the various department
heads for their comments. It was the consensus of the Board to walk the
site on Saturday, January 8, 1977.
Planning Director Maurer to get dates of test diggings and engineers
signature or stamp on the test boring information. Also to check and
see if the Town's engineer was present during the diggings.
6. Board reviewed the request of GenerCeccarelli for the release of securities
for work completed in Peter's Park. Board also reviewed the memorandum
prepared by the Planning Director. It was noted that regarding the loam
and seeding of the drainage ditch that there is a general clause in the
subdivision regulations tha all work shall be done in accordance with
accepted engineering practices and that the original security estimate
had included this work.
Motion: To release $12,165.70 fromthe Mansfield Cooperative Bank
passbook for the work completed in Peter's Park.'
(Tighe -Hartmann) MOTION WITHDRAWN
,Chairman Parsons noted that the curbing in the street entrance looks
bad and questioned if something could be done about it. It was noted
that it is not the type of granite curbing specified in the subdivision
Regulations.
Motion: To release $11,965.70 from the Mansfield Cooperative Bank
passbook for the work completed in Peter's Park and to notify
Mr. Ceccarelli of the amounts that they are withholding and
and the reasons that they are being withheld.
(Tighe-Lesuer, all in favor) VOTED
7. Board reviewed the request for the release of securities for Village
Estates Section I and III. It was noted that all of the work had been
completed as requested in the Planning Board's letter of November 3,
1976 and that the "as built" plans had been submitted.
Motion: To release the securities in the amount of $2,371.02 for Village
Estates Section I and $2,787.99 for Village Estates Section 111

8. Board discussed business zoning. Board reviewed the variances granted for
businesses in residential zones. =Planner Lesuer noted that he did not
feel that it would be beneficial to the downtown development committee to
rezone a business area at this time. He also noted that there i s still
space downtown for business uses and felt this should be more beneficial
to the town in general. Planning Director Maurer noted that with a couple
of the proposals that there may be more area available downtown. Clerk
Tighe noted that the feeling of the Board last year was that they should
not rezone because of the downtown area. Now, if they don't do anything
this year that, makes 2 years and there is no saying how far in the future
it will be 6ef4rethe plans of the Downtown Development Committee will be
carried out and felt that probably the Town could not wait. He noted that
in addition there is a problem with Eastman Ford and that there should be
i a more appropriate location for automobile dealerships. Chairman Parsons
felt that from the variances issued he did not feel it is a crying need for
business zoning. Board discussed standards that could be put on zoning
in a new business area to help eliminate a little store here and there.
Planning Director Maurer to contact SRPEDD and the Massachusetts Conference
of PlanningDlrectors to get information on problems which they have
encountered. Planning Director Maurer to comprise more information regard-
ing the standards.
9. Board discussed the: letter received from the Board of Selectmen regarding
the Community Development Block Grant application. Chairman Parsons
noted that they are looking for a total package of around $200,000.
it was noted that '1/2 of the money would go for the rehabilitation center
for the elderly. Planner Mahana noted that there should be some
consideration given to the abandoned railroad right-of-way. Planning
Director Maurer noted that in a few years the sewer 'interceptor Is going
through there. Chairman Parsons noted that they could add underground
wiring or putting the wiring to the rear of the property on North Main
Street. Planner Mahana noted that he would like to see some kind of
tie in between this project and the Fulton Pond Project.
10. Chairman Parsons noted that after last weeks meeting he was advised by
the Town Manager that the monies for the Christmas Party has to come
from the Board's expense account. Clerk Tighe noted that this came up
last week before the meeting and that he would not support such a motion
as he felt the expenditure would be illegale as it was not appropriated
by Town feting for a party. Planner Lesuer agreed with Clerk Tighe.
It was the consensus of the Board to advise the Selectmen that the
request of the Selectmen to pay for the party out of the expense account
was unfair because it did not state so on the invitation. It only stated
that they would be required to pay for their guests. It was noted that
the invitations were misleading.

I1. Mrs. Jellinek noted that the Board is interested In walking the Rustic
Acres site yet they are taking the Planning Directors word on the
Riverside Park subdivision and the discussion on the Cabot Pond site.
She noted the Town's need for a professional registered engineer.
12. It was the consensus of the Bard to hold the next planning Board meeting
on Wednesday, December 29, 1976 at 7:30 P.M.
13. 'Planning Director Maurer noted that he passed out a schedule from the
Department of Public Works for the rerouting of trucks through the
center of town. He noted that the selectmen have the power to do this
but only after they have justified the need for it. it was the consensus
of the Board to work this in with the planning for the downtown area.
14. Planning Director Maurer noted that he spent two days this week at the
Taunton Court House regarding the Great Woods Development which the
planning board had turned down on South Main Street because the State
took 25 acres for Route 25. The applicant is now suing the State for
damages. He noted that every piece of correspondence and every minutes
of the Planning Board were submitted as exhibits.
15. Planning Director Maurer noted that it would be advisable to have as
many of the Planning Board 'members present at the Wednesday meeting of
the Board of Selectmen as the Downtown Development Committee was formed
jointly by the Planning Board and Board of Selectmen.
16. Planner Mahana noted that if Board members came up with ideas on the
Community Development application that they should contact the Planning
Director during the week.
17. Chairman Parsons noted that in tonights-paper there was an article about
the Board turning down the Rumford'River Estates and that the Planning
Director says they need a gravel removal permit and it is not the
Planning Director, but the Planning Board that is requiring this.
