Motion: To Table the Minutes of June 16, 1976 until the next meeting (Latham-Mahana, all in favor) VOTED 4. Motion To approve the warrant of June 29, 1976 in the amount of $50.57. (Mahana-Laham, all in favor) VOTED 5. Board met with Robert Chavaree to discuss the bond estimate for the Riverside Park definitive subdivision. Mr. Chavaree requested a bond estimate on Riverside Drive up to lot 6 and Basin Street up to where it meets Union Street. He noted that this would be his first phase of construction on the project. He noted that rather than bond the entire drainage system on Riverside Drive that he would place a headwall at lot 14 with the drainage still going through to the swail. He noted that the first estimate prepared included 700 feet of sewer and there would now only be 500 feet, 350 feet for drainage instead of 670 feet and less catchbasins and manholes, only 94 ;feet of granite curing instead of 124 feet. -2_ Minutes June 23, 1976 Mr. Chavaree noted that on Basin Street he would only construct it to Union Street Extension instead of the complete area, during the first phase of construction. Chairman Dunn questioned would he , conform to the minimum radius and -it -was noted that he would conform at the intersection and would not require --a minimum radius. Mr.' Chavaree proposed a headwall at :the edge of the 50 foot right of way on Basin Street; instead of the pipe into the swamp as lots 25, 24, and 26 have riot -been released from the Conservation Commission. Mr. Chavaree noted that the Board included paving of the Town way and that the subdivision starts a portion of the way down Union Street Extension. Mr. Chavaree noted that he would like to change the location of the sewer lift station from the corner of lot 36 to the end of Union street. Mr. Chavaree noted that, even with these changes, that the discharge of the surface water would be at the same destination. Mr. Chavaree noted that tke amounts used in the bond estimate is 33%+ higher than what is contracted for the actual work and what the bank will allow for construction. Chairman Dunn noted that it is a set amount that is used on each item in all developments. Planner Latham noted thatwhere`the roads are ended as proposed that they will need temporary turnarounds and that if RIM is going to draw up designs for the relocation of the lift station that they should have plans showing the alterations in the drainage. It was noted that the Board uses the Means Estimate Guide in preparing the bonds, however the asphalt prices have gonedown and perhaps the prices should be reviewed. Mr. Chavaree noted that on the contingency that it was his understanding when the subdivision was approved that the only amount of contingency that would be required was the 10% on the amount that was being bonded as his subdivision was approved in 1974. Mr. Chavaree noted that each step of installation is inspected and that if it is all tested and approved than he should no longer be responsible so a contingency should not be necessary. Chairman Dunn noted that the contingency is held for the Town's protection. Mr. Chavaree noted that he could see holding $2,000 for emergencies, but he could not see holding $15,000. Board requested an overlay of: -the work to be completed in the first phase of construction as well as a plan showing the changes in the location of the sewer lift station. Mr. Chavaree requested to be allowed to sit in on the Board's discussion after the revisions are made. 6. Board reviewed the request from Ernest White for an extension of time for the Planning Board's consideration of the Woodland Park definitive subdvision plan until July 7, 1976. Motion: To grant Ernest White an extension of time for the Planning Board's consideration of the Woodland Park definitive subdvision plan until July 7, 1976. (Latham-Mahana, all in favor) VOTED -3 - Minutes June 23, 1976 7. Board reviewed the Letter of Credit #90 from the City Bank & Trust Company for work to be completed on Pinto Way.. It was noted that the Board had sent a letter to Town Counsel to be reviewed and Mr. Grady noted his concern with having to notify City Bank and Trust Company 10 days prior to the withdrawal of funds as it was not in the Town's best interest. It was noted that a new Letterof Credit #90 had been received and that the 10 day notice period had been omitted. Planning Director Maurer advised that Town Counsel has said that the Letter of Credit is now acceptable and will send a letter to the Board to confirm this. It was the consensus of the Board not to take action on this until a written approval had been received from Town Counsel. 8. Board met with Val Scarpellini and Bob Lowe of Iacuzzie Construction to discuss the Foxfield Estates Subdivision. Mr. Scarpellini noted that he has decided to complete the entire roadway and that he did not realize that he had to but granite around the entire cul-de-sac and that it would cost him $3,000 to do this and requested a waiver of the granite in the circle and to be allowed to put berm instead. It was noted that the roadway will only serve 4 house lots, of which 2 will belong to his children. Board to takeunder advisement. 9. Board met with Mrs. Margot Jellinek who noted that she had requested in May that theBoard look into the earth removal project on Jewell Street owned by Carl Nelson. She felt that they had already removed the gravel below the water table and that the Planning Board should acquire a topographical map of what the land looks like now and what the material is going to be after the cuttings. She questioned if anything had been done by the Planning Board and if they had acquired any plans as what the land looks like now. Chairman Dunn noted that it was the duty of the Building Inspector to inspect these gravel pits. It was noted that this goes under the Grandfather Clause and the only plan that was submitted then was the perimeter plan of the property containing 6.8 acres, which was registered as a gravel pit. Mrs. Jellinek noted that .Chairman Dunn is 'going on record as not going to do anything about the gravel pit. 10. Board met with Ralph Maloon, Engineer, Norman Gray, Sr. and Norman Gray, Jr. to review some sketch plans of a preliminary subdivision for land on South Main Street. One sketch was for a conventional subdivision and one was for a Cluster Development. Chairman Dunn questioned if this area had been related to the Soil Associations Map. Engineer Maloon noted that they have not done this but have done some tering in the area. It was noted that the road leading into the subdivision is approximately 1800 feet, which may present a problem. Mr. Gray, Sr. noted that if they went cluster development they may make a deal with the Town for the land not used in the rear of the groperty, as a gift. Mr. Gray felt that the subdivision would be more attractive as a Cluster development than a conventional development, and questioned if the Board felt it would be worth while to move forward on both the proposals until they find out which way they will be going to developithis land. Planning Director Maurer noted that there is a lot of ground work that has to be done before the Cluster Development proposal is ready for`Town Meeting. It was noted that proposals of this nature would have to be presented by the developer to Town Meeting. It was noted that there would probably be a special Town Meeting in early Fall. It was noted that the area would have to be defined for Cluster Development to be an overlay zone in the Agricultural Zone. -4 - Minutes June 23, 1976 It was the consensus of the Board to eeview this further at the next workshop meeting 11. It was the consensus of the Board to table action on the Board of Appeals recommendations until the next meeting. 12. Planning Director Maurer advised the Board that a letter had been received last week from Elmwood Park Realty Trust requesting the release of the balance of the securities in the Commercial Union Account amounting to $3,475;14 for work which had been completed on Bonney Lane. Motion: To Releas($3475.14 from the Commercial Union Insurance Co. account for the work which has been completed on Bonney Lane. (Latham-Mahana, all in favor) VOTED. 13. Planner Latham requested that copies of the letter from SRPEDD regarding Chapter 808 of the Acts of 1975 be sent to the various Board members. 14. Planning Director Maurer advised that regarding Mr. Gray's proposal he will send them=Board% as copy of the old proposed Cluster regulations for their review. 15. Mrs. Jellinek noted that a letter was read that the Bank will be responsible for the funds for Pinto Way under the letter of credit and not Millhaus however, if the bank flops the Town will only get a percentage. It was noted this also holds true of Passbooks. 16. The Planning Board will hold their next meeting on Wednesday, June 30, 1976 at 7:00 P.M. 17. Motion: To adjourn (10:30 P.M.) (Mahana-Latham, all in favor) VOTED Date
