(Parsons -Wellington, all in favor) VOTED 5. Board reviewed the Form A Plan for Francis Vaz for land on Fowler Street. It was noted that this is only a paper street and is not an accepted street and that documentation is needed to show who has the actual rights on the property to determine the legal status of the street. Motion: To disapprove the Form A Plan for Francis Vaz until legal documentation of Fowler Street is received. (Tighe -Latham, all in favor) VOTED 6. Board reviewed the Form A Plan for Earle G. Ware and William Brauneis for land on Balcom Street. It was noted that it was for a transfer of a strip 1 foot by 29.9 feet in order to give Mr. Ware the required frontage. Motion: To disapprove the Form A Plan for Earle G. Ware and William Brauneis for land on Balcom Street as it is a derogation from the intent of the Zoning By-law. (Parsons, Wellington, all in favor) VOTED 7. Board met with Karl Clemmey to discuss the rezoning of land on Route 106 near the Easton Town Line. Mr. Clemmey advised the Board that he was not yet prepared and requested to be put on the agenda for the next meeting. Mr. Clemmey to meet with the Board at 8:00 P.M. at their next scheduled meeting. 8. Board reviewed the site plan for St. James Lodge for land at 5 North Main Street. It was noted that Fairfield Optical has moved into their new location at the Cabot, Cabot and Forbes Industrial Park and that they are planning to rent this location to Benjamin Moore Paint Company. In order for them to obtain a building permit the Building Inspector has requested that they go through a site plan approval so that the Planning Board could review the parking lot. It was noted that they are proposing a leaching basin in the parking lot. Planner Tighe questioned if the Planning Board had the authority to tell them not to put in a parking lot and if not, did they have the authority to tell them that they have to tie into the existing drainage. Planning Director Maurer noted that they did not have the authority to tell them they can't put in a parking lot and that the Planning Board does have the authority to make a recommendation to the Building Inspector regarding the drainage. Planner Dupont questioned if they could suggested that they come up with an alternative for the drainage. -3 - minutes February 4, 1976 Motion: To recommend to the Building Inspector that the leaching basins for the parking lot for St. James Lodge be tied into the 12 foot main drain line on North Main Street and that the catchbasin be designed to have two 2 foot stubs coming out of the basin at an elevation of six inches below the invert and be underlayed with stone, and to recommend approval of the site plan subject to the above. (Latham -Tighe, all in flavor) VOTED Clerk Wellington noted that if the leaching basins are used and it overflows that it will only affect their own private property. Board reviewed the Form A Plan for Howard Conred for land on East Street. Motion: To sign the Form AiPlan for Howard Conrod for land on East Street (Tighe -Parsons, all in favor) VOTED 10. Board reviewed the Form A Plan for Main Realty trust for land on North Main Street. It was noted that this land is located within the Business B Zone and that the plan states Business C. Motion: To return the Form A Plan for Main Realty Trust as the zoning classification is not properly described. (Tighe -Latham, all in favor) VOTED 11. Board discussed the memorandum prepared by the Planning Director regarding the status of unaccepted streets in the Town of Mansfield. It was noted that on King Street the Board of Selectmen had agreed upon a 24 foot right-of-way and on Fowler Street they are requesting a 26 foot right-of-way. Planning Director Maurer noted that something has to be tied in so that the improvements are guaranteed and felt that this could be tied in with the certificate of occupancy. Planner Mahana felt that as long as the requirements of water and drainage are met that the owners of the right of way have the right to go in and build and questioned if the Board had the right to make them put in an asphalt hardtop road. He questioned if it was legal to force them to put in acceptable streets. He noted that he was in agreement with the requirements for the street width, water and drainage. Planner Tighe noted that Section I -C 2 made it so that they will be required to build standard roads. It was noted that Bird Road is an accepted road as it was layed out prior to 1846. Planner Latham felt that they should draw up some regulations and have Town Counsel review them. Clerk Wellington noted that he was not certain whether they should set up a set of regulations or just set up guidelines and treat each road individually. He noted that, for example, Bliss and Day Streets exist right now and the portions left abut the railroad tracks and a different set of regulations could be set up for them than for Thompson street, which could become a through street. He noted that there is the possibility of a set of regulations for through streets as opposed to dead end streets. He suggested that a minimum of 24 feet be used, or at least the width of the existing portion of the street, whichever is wider. He noted that if the existing portion of the street is paved the extension should be paved and if the existing portion is gravel then gravel base be allowed. -4 - Minutes February 4, 1976 Chairman Dunn questioned the meaning of the requirement of drainage depending on local conditions. Planning Director Maurer noted that this would mean that if it is close to existing drainage system thatit be required to tie into it. Chairman Dunn questioned the wording of a good gravel base. It was noted that this is too loose and that they would have to adopt a set of regulations for this base standard and that if paving the road is required they will'hayeto set up a standard for this. Clerk Wellington noted that they could have a typical cross section made with variable width of 24 feet minimum. Planning Director Maurer to draft up a typical cross=section. Planning Director Maurer to check to see if a bond could be required for the completion of the roadways. Planner Tighe noted that on the requirement for a water main it should only be required if a main exists within so many feet. It was noted that, once prepared, these standards will only be a recommendation to the Board of Selectmen for their determination. 12. Board discussed the Notice of Public Hearing from the Board of Appeals on the application of Jocelyn Rosado to establish a business of lawnmower and small engine repair in the Agricultural'` Zone. Motion: To recommend to the Board of Appeals that the variance for 3ocelyn Rosado be disapproved as there is no hardship demonstrated and it would derogate from the intent of the Zoning By-law. (Tighe -Dupont, Wellington, Latham, Mahana, Dunn in favor Parsons abstained) VOTED 13. Board reviewed the notice of Public Hearing from the Board of Appeals on the application of Paul Thatcher for a variance for a sign in a Residence AA Zone. Motion: To recommend to the Board of Appeals that the variance for Paul Thatcher be disapproved as it would be adding to an existing non -conforming use, there is no hardship demonstrated, and it would derogate from the intent of the Zoning By-law. (Tighe -Parsons, all in favor) VOTED 14. Mrs. Jellinek advised the Board that Jocelyn Rosado is still filling shells with amo on Williams Street and felt that this could be more dangerous then lawnmow®r-repairs. She noted that she was very concerned for the children in the area. 15. Motion: To hold the next Planning Board meeting on Wednesday, February 18, 1976 at 7:30 P.M. (Latham -Wellington, all in favor) VOTED 16. Planner Parsons reminded the Board of the note on the bottom of the agenda that the Downtown Development Committee would like to meet with the Planning Board at the next Downtown Development Committee meeting. -5 - Minutes February 4, 1976 17. Planning Director Maurer noted that on Route 495 he attended a meeting last friday and that SRPEDD Staff interpreted GovernorDukarkis' last statement that the towns would have to prepare a growth policy study for Route 495 as a requirement and they have a grant of $25,000 for this work and that there may be another $5,000 available for this study. Planning Director Maurer felt that most of this was already discussed in the Environmental Impact Statement and that this growth study is going to be completed by the end of June so there may be another delay on the highway. Planning Director Maurer noted that the first stage of Route 495 is scheduled to go out to bid in June and the design plans are completed. The finalization of the Environmental Impact Statement has not been sent to Washington for their approval. It is scheduled to be sent on the 15th of this month. 18. Chairman Dunn questioned the status of the Homart Project and noted that if it was still alive he would like to get some traffic patterns from it. Planning Director Maurer to obtain this information. 19. Board discussed the budget for 1976-77 and Chairman Dunn questioned the authority of the Town Manager to recommend on the budget. 20. Meeting adjourned at 9:50 P.M.
