Finance Committee to Department Heads, Commissions, Boards and
Committees regarding budget reviews.
RIM Engineering to Planning Board regarding Woodland Park
Russell A. Wheatley and Associates to Planning Board regarding

3. Board discussed the definitive subdivision plan for Woodland Park.
Planning Director Maurer noted that they had added the fire alarm
pedestals, the typical cross section, changed the abuttor from
MacFarlane to Moss, and showed the flows in the Back Bay Brook, as
requested. He noted that permission from the abuttors for easements
across their property had not been received from the Morses or
Jess Realty Trust. All of these items were requested in accordance
with the Planning Board's letter of November 20, 1975. It was noted
that the Riprap is shown and the drainage on the property of Shaw
was corrected and a separate plan for the underground wiring had
been submitted as requested in the Planning Board's letter of December
4, 1975. It was noted that once the easements are established a
definitive plan showing the easements should be submitted and recorded
with the subdivision plans if approved.

4. Board met with Charles Francis of Ryan, Elliott and Company, who noted
he was requesting that the Board consider submitting to the warrant for
this years Town Meeting an article for the acceptance by the Town of
Francis Avenue. He noted that the Planning Board's letter of September 5,
1975 stated that they had inspected the roadway and that there was one
outstanding item';, which consisted of cleaning up of loam and seeding,
which was deferred until spring. Mr. Francis felt that it came so close
in time to the required period of one year after completion and that if
it is brought up at the Town Meeting it usually takes 4 or 5 weeks before
it actually comes before the meeting for a vote, which would bring it to
the actual` year of completion. Mr.Francis felt that they had completed
their obligations and that it would not be a burden to the Town.
Clerk Wellington questioned if Mr. Francis would object to the
Town sending them a letter saying that these items have to be completed
prior to the Town Meeting and if not they would pull the article.
Questioned if Mr. Francis would sign such a letter. Mr. Francis stated
that he would be in agreement with this. Mr. Francis noted that if the
article come before the Town Meeting prior to the time period then he
would understandithe Boards position if they pulled the article.
5. Board discussed the amendments to the Magna Vista II subdivision Plan.
Planning Director Maurer noted that last Thursday he and Planner Tighe
had reviewed the site and home Developers has a ditch which is probably
2 feet lower then the surrounding property and Carrines property slopes
towards the Home Developers property. The Board noted that at the public
hearing there was a gentlemeni:s agreement to put a swail in the property
to divert the water from Carrines property.
Motion: To send a letter to the developer noting that the Board
will bequirethat the swail on the back of lots 16, 17, and 18
be shown on the plan as discussed at the Public Hearing on
January 14, 1976.

6. Board discussed the request from Millhaus Reality Trust for the release
of securities for work completed -within the Circle C Estates subdivision,
along with the memorandum prepared by the Planning Director
Clerk Wellington questioned if the amount of release for letter of Credit
#79 included any monies for the drainage ditch work. Planning Director
noted that they will be retaining all monies posted for the drainage ditch
work.
7. Board met with Mrs. Margot Jellinek to discuss the drainage within the
Circle C Estates subdivision. Mrs. Jellinek felt that the pipe was tipped
several inches towards her ' property line. Mrs. Jellinek presented pictures
to show the headwall at the edge of her property in which a puddling situation
occured during the installation of the drainage system. She noted that
the Planning Director told her that it was because the drainage was not
finished and Mr. Wellington said that it was not pitching towards her
land it was going the other way. She noted that the subdivision by-laws
have sample sheets which list step by step what has been completed on the
drainage and bn roads and should be signed by the Highway Department, the
Water Department and the Planning Director when inspections are made.

Mrs. Jellinek presented the Board with plans of the drainage system
and elevations. The Board advised her that they were not the signed
plans and amendments had been made to the plan prior to the Signing
of the Plans. Mrs. Jellinek stated that the headwall is about 500 or
600 feet from West Street. Clerk Wellington noted that it is closer
to 800 feet from West Street. It was noted that the drainage was
required to be put in at elevation 155.17 so that the overflow will come
into a'swail behind the lots and back into the initial drainage system
and the swamp would not have an outlet and there was concern from Mr.
Desantis`regarding water backing up on his property. According to the
plan the present elevation is 156.
Mrs. Jellinek noted that Mr. DeSantis has not signed off as he is not
satisfied with the drainage system. Mrs. Jellinek stated that the
drainage is now in and she is still having water. Clerk Wellington
advised her that the ground shows the water running from Mrs. Jellinek's
property to the Circle C Drainage system. He noted that the Board also
has as built which show the water flowing from her property onto the
Circle C Estates propetty. Clerk Wellington noted that the water on Mrs.
Jellineks property was only temporary being caused by construction.
Planner Tighe noted that he also got the impression from the flow
marks in the ice that the water is flowing from Mrs. Jellineks property
to the Circle C Estates property.
Mrs. Jellinek noted that in the letter of approval'' indidated that lots
27 through 33 were approved and questioned if this included lot 33.
Board noted that the restriction on the plan with regard to lot 33 was
a Board of Health restriction and that the letter ha d already been
forwarded to the Board of Health. It was noted that the Planning Board
has not released lot 33 as of yet.
Mrs. Jellinek questioned what the Board felt was a good waiting time
after compaction before the binder coat could be put on the road. It
was noted that the compaction had been completed out there on the 31st
of July. Clerk Wellington heted`<that with the condition of the land in
that area there was no need for a waiting period after compaction and it
is mostlly gravel and no silt.
8. Board met with Efigineer Ralph Maloon to discuss the Woodland Park definitive
- subdivision plan. Board reviewed their letter of November 20, 1975. Mr.
White noted that he had discussed the easements with Mrs. Rogovin of Jess
Realty Trust and felt that they had come to an agreement and did not
forsee any problems with getting the required easements. Mrs. Rogovin
noted that they have agreed to extend the brook another 200 feet into
a further away swamp so that there would be no flooding on her property.
Planning Director Maurer noted that a plan also has to be drawn to show
the easements, which can be recorded. The Board also reviewed their
letter of December 4, 1975.

Clerk Wellington suggested that the 12 inches of rip rap be broken up
so that the velocity will be slowed down. He noted that this could be
achieved by putting larger stones occasionally.
Ernest White, Trustee for Woodland Park, presented a letter to the Board
requesting an extension of time for the Planning Board's consideration of
the Woodland Park definitive subdivision plan until February 18, 1976.
It was noted that if the brook is extended an additional 200 feet a
detailed plan and information of this would have to be submitted,
and an easement would have to be obtained from a third party.
9. Motion: To grant an extension of time for the Planning Board's
consideration of the Woodland Park definitive subdivision
plan until February 18, 1976.
(Tighe -Latham, all in favor) VOTED
10. Motion: To release $54,558.60 from the City Bank and Trust Company
letter of Credit #79 and $37,847.25 from the City Bank and
Trust Company letter of Credit #82 for work completed in the
Circle C Estates subdivision as per the Planning Director's
Memorandum of January 19, 1976.

11. Board discussed the notice of public hearing on the application of
Earle G. Ware from the Board of Appeals. It was noted that the notice
from the Board of Appeals stated that the hearing was February 3, 1975
Motion: To recommend to the Board of Appeals that the variance for
Earle G. Ware not be granted.
(Tighe -Wellington, all in favor) VOTED
12. Planner Tighe noted that regarding the new Chapter 808 zoning law that
he had expressed concern that they might find themselves in conflict with
the State law. Suggested that since the new member, who is a lawyer, has
to read the law anyway, possibly he could report to the Board on this.
Planner Dupont in agreement with this.
13. Planner Tighe noted that he would like copies of the handout prepared
for the Downtown Committee. Planning Director Maurer advised that he
would prepare copies for the entire Board.
14. Planner Parsons questioned if they should check with Town Counsel on the
acceptance of Francis Avenue ahead of time and regarding the letter to be
signed by them. Planner Tighe noted that he was in favor of the
acceptance of the street, however, he also questioned how forceable such
an agreement would be. It was noted that the major pipe work was completed
in 1973 and the water was turned on in 1974 and the base coat of pavement
was in in 1973. It was noted that the roadway itself has been down for
over two years., and the utilities in operation for over two years. The
9th of May was the date the last coat of pavement was put down.
Motion: To request the Board of Selectmen to insert an article in the
1976 Annual Town Meeting for the acceptance of Francis Avenue.

Motion: To advise the developer of the Planning Board's intent to
petition the Town Meeting for Acceptance of Francis Avenue
with the understanding, by signing the letter and returning
it to the Planning Board, that the acceptance of the street
by Town Meeting does not relieve the developer, of his
requirement to complete work outlined in the Planning Boards letter
September 25, 1975. Ifthisis not agreed upon, or if the work
is not completed by Town Meeting, the article will be pulled
at the Town Meeting

15. Planner Parsons noted that next Wednesday, SRPEDD will be reviewing
the grant for Mansfield for $100,000 requested for the Back Bay Brook
work and also the relocation of Route 140 project and suggested that
if the Planning Board wanted to have any comments recorded that they
forward them this week.
16. Clerk Wellington noted that Chairman Dunn is sitting with one Agenda and
that the Board has a different agenda. Clerk Wellington noted that the
Agenda that the Chairman has is the one that should be recorded in the
records. He noted that in this way if they have to refer back they can
check it by the agenda. Noted that it should be added in by ink so that
i,t can be seen that it was added after the Agenda was mailed out.
Clerk Wellington noted that where the agendais so light he would like
to go back to the original format to send it out on Monday and still
keep the agenda open until the meeting.
Motion: To go back to the original format of mailing the agenda and
minutes to the Board members on the Monday before the meeting.
(Wellington -Parsons, all in favor) VOTED
Clerk Wellington noted that when an item is on the agenda he would rather
see the handout on Tuesday with the agenda instead of the night of the
meeting.
17. Clerk Wellington noted that several weeks ago he asked for a report on
the outstanding paper streets in Town, including the number of house
lots on the paper streets, as a decision was needed to be made on King
Street. He questioned the Planning Director as to the status of the
report and why it was not together. Planning Director Maurer noted that
he had not done anything on it to investigate it.in detail as there were
other projects he was involved in, as he had the Downtown Development
Committee which needed information prior to their meeting. Clerk
Wellington noted that the Town Charter states the Planning Directors
primary responsibility is to the Planning Board. Planning Director
Maurer noted that the Downtown Development Committee was established
in a joint effort with the Planning Board and Selectmen and the vote
taken stated that the Planning Director be involved in it. He noted
that he felt it was necessary to get that information to keep the
Committee going. Clerk Wellington noted that he would like to see the
Planning Board information take top priority.

18. Planner Latham noted that Ralph Maloon mentioned that he took the
Woodland Park Plan around to the various departments and questioned
if this was a new practice. Planning Director Maurer noted that this
was done just for the wiring plan and felt thl<t the':details of this should
go right to the Light Department directly.
19. Planner Latham noted that he thought there was money left in the Town Hall/
Police Station Building Fund and that the bulletin board should be put
under lock and key,;,with one key to the Town Clerk and one to the Town
Manager. Suggested that they check through the scchol or regional school
to see if they could get one cheaper. This should be done for official
notices of the Committees, which would be 1/3 of the bulletin board
or a separate board if necessary.
Motion: To forward a letter to the Town Hall/Police Station Building
Committee suggesting they consider the possibility of having
a bulletin board made with lock and key for the official notices
of the Town.
(Latham -Wellington, all in favor) VOTED
20. Planning Director Maurer requested to discuss the distribution of his
time. He noted that when any deadlines are set by the Planning Board
he has met those obligations. He noted that the charter also states
to work for the Town Manager as time permits. The Town Manager has
assigned projects to him, which he feels are Planning related , such
as the sewerage treatment, the application for the grant for the Back
Bay Brook, and he is also involved in the DownTown Development Committee,
which was established between the Planning Board and Selectmen; and now
he will be involved with the Growth Policy Committee, which is a state
requirement. Planning Director Maurer noted that if the Planning Board
has a problem with his time that they should get a meeting between the
Planning Board and the Town Manager and himself as he felt he was filling
all his obligations as administrative responsibilities, his responsibility
to work for the Planning Board and also his responsibility to work with
the Town Manager. He noted he wanted to get this squared away so there
wouldn't be any problem.
Planner Tighe noted that if such a meeting was held they would not know
what hours he was working for whom and suggested that the Planning
Director get a booklet and write down how many hours he works on each
project.. He noted that unless you have data such as that the Planning
Director will still be in the middle. Planner Tighe felt that the
meeting was in order if this was a constant problem. Clerk Wellington
noted that it is not a constant problem, but a rarity.
21. Chairman Dunn questioned the setback between the industrial and residential
zones. It was noted it is 50 feet, which the roadway in the Woodland Park
takes care of.
22. Meeting adjourned at 10.0 P.M.
