Planning Director Maurer noted that Mr. Francis of Ryan, Elliott and Company would not be attending this meeting but would meet with the Board next week. Mr. Francis is coming before the Board to request that Francis Avenue be accepted at the 1976 Annual Town Meeting. He noted that the ,year after construction completion is not up until May 5, 1976, however, Mr. Francis feels that it is so close to Town Meeting that it should be placed on the warrant for acceptance. Planner Tighe questioned if this had been discussed by the Board previous to his appointment to the Board. It was noted that it had been. Planner Tighe requested that copies of the minutes referring to this discussion be forwarded to the new members of the Board for their review prior to the meeting with Mr. Francis. Pertinent correspondence also to be forwarded. -2 - Minutes January 14, 1976 5. Board discussed the proposed revision to Section V -C-1 regarding off-street parking in the business area on North Main Street. Planner Tighe requested that the wording be changed from "which would take away from off-street parkina already serving that structure" to "in such a way as to reduce off-street parking already serving that structure". Motion: To request the Board of Selectmen to place the proposed zoning amendment, as revised, on the warrant for the 1976 Annual Town Meeting. (Tighe -Wellington, all in favor) VOTED It was the consensus of the Board to see if any zoning amendments are requested from citizens to the Board of Selectmen prior to holding the required Public Hearing and hold all hearings on zoning amendments at the same time. 6. Board discussed the Local Growth Policy Committee. It was noted that the interpretation of the office of State Planning is that the Chairman of the Board of Selectmen appoints the members at large. However, the law states that the Board of Selectmen as a body appoints the members. It was noted that the Planning Board Chairman would have to serve on the Committee or appoint a delegate. Planning Director Maurer noted that today he received a sample of the types of questions that will be on the questionnaire and that he will forward copies to the Board. Chairman Dunn noted that the Land Use and Growth Development trends report would be helpful to the Committee. Planning Director Maurer felt that they should fol'l'owthe Comprehensive Planning Program and see if they are going in the right direction instead of starting a complete new study all over again. 7. At 8:00 P.M. a Public Hearing was held on the proposed amendment to the drainage within the Magna Vista II approved subdivision. Transcript of that hearing is on file. 8. Board discussed the letter from the Norton Planning Board regarding the Public Hearing on proposed amendments to the Zoning By -:law. It was noted that copies of the changes had not been received. Planning Director Maurer to obtain copies of the proposed amendments prior to the next meeting. 9. Board discussed the letter from Millhaus Construction requesting partial release from the letters of Credit with the City Bank of Boston. Planning Director Maurer noted that the request did not come in until late this afternoon and he did not have time to review it and suggested that the Board put it off until next week. It was noted that the storm drainage is installed with the exception of the ditch. Planning Director has to check with the Light Department on the status of the underground wiring. Planner Latham questioned if the drainage was in so that the water was flowing. It was noted that it was. -3 - Minutes January 14, 1976 10. Planner Mahana questioned on the questionnaire that instead of putting out a long questionnaire on a yearly basis if it would be easier to put one out quarterly by section. Planner Tighe felt that if it is sent out frequently it would be ignored and the results would be less reliable. Planning Director Maurer noted that the last questionnaire was not specific enough and felt that in May something be designed on what would be on the questionnaire to be send out in September and October. 11. Board discussed the new zoning legislation act which was handed out by the Planning Director. It was noted that the zoning must be amended to conform to this by 1978, which means that it does not have to be considered for this Town Meeting, but something has to be done for next year's.Town Meeting. It was noted that there is one area that cettain powers can be taken away from the Board of Appeals and given to the Planning Board and that the Board of Appeals will be limited to variances for dimensional requirements and not uses. It was noted that there are provisions for Cluster Zoning and Planned Unit Development. Clerk Wellington asked if there was any penalty clause if it is ignored. Clerk Wellington noted that theywork involved, the Public Hearings, the advertising, and the reprinting would cost the town between $500 and $1,000. Planner Tighe noted that if it is ignored and there is conflict between the State law and the Town law that the Town may end up spetdfng more than that on law suits. Noted that it would have to be reviewed first to determine this. 12. Board discussed the copy of the preapplication for the Community Development Assistance. It was noted that the preapplication has to be submitted by February 13th and the Board of Selectmen has to hold two public hearings prior to that time. If it looks like a fundable project then the Town will be requested to submit an application. Noted that the Town is requesting $100,000 for work on the Back Bay Brook. 13. Planning Director Maurer noted that at the meeting on Monday with Governor Dukarkis regarding Route 495 the Governor noted that there is $35 million available and there is another $20 million coming from the State level and there may be another $20,million coming from the Federal level. He noted that the Governor reluctantly approved it. He noted that the environmental impact has not been finally approved in Washington. If everything goes in line it will be a year and a half before they start anything. 14. Chairman Dunn suggested that the Board take 15 minutes at the end of each meeting to answer any questions from the audience pertaining to what was discussed at the meeting. In this way, it would avoid people having to come back on the agend at the next meeting. The Board was in agreement with this. 15. Mrs. Jellinek requested to be put on the agenda for the next meeting regarding the drainage in Circle C Estates. She noted that Clerk Wellington had said he would not look at the land until the drainage is finished and she would like the Board to review the drainage before they released the funds being requested to be released. Planning Board members to review the site individually. It was noted that the drainage ditch is not complete. -4 - Minutes January 14, 1976 16.
