Board reviewed the memorandum prepared by the Planning Director. Planning Director Maurer noted that he did not feel that the application for a variance met any of the criteria for which a variance should be granted as no hardship has been demonstrated. He recommended that the Planning Board recommend that the variance be denied and that the applicant be requested to petition to have the area of West Mansfield rezoned as recommended in the Comprehensive Planning Program, and then the determination of the use would be with the Town Meeting. Motion: To recommend to the Board of Appeals that the variance for O.C. S., Inc. d/b/a The Old Country Store be denied for the reasons as outlined in the Planning Director's memorandum of January 6, 1976. (Tighe -Latham, Parsons, Wellington, Dunn in favor, Mahana opposed) VOTED Board reviewed the memorandum from the Planning Director regarding the amendment to the requirements for parking in the Business B Zone on North Main Street. It was noted that this should be limited to North Main Street and that the same provision as is on the intensity schedule for North main Street could be added to the parking requirement section. Board felt that the wording should be changed from "can not be expanded" to "shall not be expanded". To be reviewed further by the Board and discussed at a future meeting. H. Board discussed the streets to be petitioned for acceptance at the 1976 Annual Town Meeting. It was noted that there are three streets that the time limit of one ,year from construction completion is up on. a) Saddle Ridge Road - The funds have all been released and the as built Plans and description have been submitted. Acting Chairman Wellington questioned if the temporary turn around was all on Town property. Planning Director Maurer noted that it is all within the right-of-way. b) The second section of Bonney Lane - It was noted that the first 600 feet have been accepted and now the plan for the remaining portion of the street is ready to be accepted. It was noted that the loam and seeding has not been completed on this section, and that a bond in the amount of $2,500 is still being held by the Town. - 3 - Minutes January 7, 1976 Motion: To advise the developer of the Planning Boards intent to petition the Town Meeting for Acceptance of the Street, with the understanding, by signing the letter and returning it to the Planning Board, that the acceptance of the street by Town Meeting does not relidve the developer of his requirement to loam and seed the area as required. Motion: To advise the developer of the Planning Boards intent to petition the Town Meeting for Aceeptance of the Street, with the understanding, by signing the letter and returning it to the Planning Board, that the acceptance of the street by Town Meeting does not relieve the developer of his requirement to slope the banks of the ditch properly as required.
