3. Board reviewed the memorandum from the Downtown Advisory Committee
regarding the opening of Old Colony Way for through traffic and
parking. It wasnoted that at 8:00 P.M. the Board of Selectmen would
be holding a public hearing on this request. Planner Mahana questioned
how this would coincide with the request of the Downtown Traffic
Study Committee. Planning Director Maurer noted that it is consistent
in the fact that they want to utilize the Old Colony Way for circulation.
However, it is inconsistent in the fact that it does not go all the way
through to East Street and there will also be parking. Planning Director
Maurer noted that this is only a temporary proposalbecause they are
aware of the fact that the sewer interceptor will go through there.
Planner Mahana noted that there should be a time limit of perhaps 6 months.
It was noted that if it did not work out they should not have to stick
with it for 6 months.
Motion: To recommend to the Board of Selectmen that the proposal of the
Downtown Advisory Committee be approved for the opening of
Old Colony Way for through traffic and parking for a trial
period.
(Mahana-Lesuer, all in favor) VOTED
4. Board met with Karl Clemmey to discuss the covenant for Jenney Lane.
Mr. Clemmey presented two deeds transferring the sold property within
his subdivision off West Street back into his own name. It was noted
that the deeds had not been recorded as of yet, however, Mr. Clemmey
assured the Board that they would be recorded on November 17, 1977 and
that he would bring something back from the Registry of Deeds to show
that they had been recorded. Mr. Clemmey left the meeting.
Motion: To notify Mr. Clemmey that they have accepted the method
of deeding the land back to himself. However, they would
like a certification from the Registry of Deeds that the
deeds have been recorded.
(Hartmann-Lesuer, all in favor) VOTED
5. Board discussed the preliminary subdivision plan for Hobbitt Hollows.
It was noted that a letter was received from the Conservation
Commission stating it would need a wetland hearing. It was noted
that a letter was received from the Board of Health noting that they
will follow their engineers recommendations and attached the recommendations.
6. Board reviewed the siteplan for Codex Corp. along with the letter from
Carlson Corporation dated November 14, 1977 and the Planning Board's
letter of October 20, 1977 requesting additional information. It was
noted that the only itmes they have not complied with is the curb cut
and the lighting, however these items were discussed in their letter.

t Motion: To recommend to the Building Inspector that the site
plan application for Codex Corporation be approved

1. Board met with Ralph Maloon and Rusty Evans to review the Form A
Plan for Leo Costanzo for land on Pratt Street. Board discussed the
roadway easement.
Motion: To approve the Form A Plan for Leo Costanzo for land on
Pratt Street.
(Mahana-Hartmann, Lesuer, Parsons in favor) VOTED
8. Board met with Ralph Maloon to discuss preliminary subdivision plan
for Rumford!River Estates which was disapproved by the Board on
December 8, 1976. Mr. Maloon presented a roadway sketch to the
Board which proposed two one-way streets with an island of trees.
Question was raised as to who would maintain the island. Mr.
Maloon questioned if he could prepare the definitive plan with
the existing elevations being the proposed elevations after the
gravel is removed. It was the consensus of the Board that this
could be done, however, he would have to verify the finished grade,
when the earth removal operation is completed. It was the consensus
of the Board to eliminate the island with the two one-way traffic
lanes. Board questioned if the subdivision plan was to get the
gravel out of the 100 foot buffer. It was noted that the earth
removal operation would be in two phases and that the subdivision
should also be that way. It was the consensus of the Board to
review the preliminary plan informally and that this would not
require a new submission.
9. Board met with Mrs. Jellinek to discuss the W.R.C. Properties, Inc.
(Planner Hartmann left the meeting and did not participate in any
discussion.) Mrs. Jellinek noted that she felt that the Planning
Board had the right and obligation to ask Cabot, Cabot and Forbes
what is going into the industrial park so that the Town can be
protected. She felt that they should get a copy of the covenant
from Cabbt, Cabot and Forbes to get the wording and prepare a
zoning amendment on this to incorporate it into the Industrial
Zoning at tmwn,meeting.
10. Board discussed the amendment to Section V -G, Earth Removal, of the
Zoning By-law. Board reviewed alterantives A and B as prepared by
the Planning Director
Motion: To forward copies of the memorandum, as well as copies of
Alternative A and B to all Town Boards and Committees.

11) Planning Director Maurer noted that he had intended to bring everyone
up to date on the business zoning that the Downtown Advisory Committee
will be preparing, however, felt this should be put aside until
Planner Mangiaratti was present. He noted that on the proposal to
open up Old Colony Way that the Board of Selectmen will take it
under advisement and will make a decision in 3 weeks. Planning
Direttor Maurer noted that the Downtown Advisory Committee is considering
one zoning for the entire downtown area. He noted that the Committee
will be meeting on November 28, 1977.
12) Board reviewed the Form A Plan for Robert Davis for land on Franklin
Street.
Motion: To approve the Form A Plan for Robert Davis for land on
Franklin Street.

13) Board reviewed the letter from Attorney Foley regarding the Wm. Reed
property on So. Walnut Street. Board reviewed the Form A Plan signed
by them on September 15, 1976. Planning Director Maurer noted that
he had talked with Attorney Foley and noted that a new plan was not
required.
Motion: To write to Mr. Foley informing him that the Board feels
no additional action is required and no additional
submission is required.
(Lesuer-Hartmann, all in favor) VOTED
14) Board reviewed the Board of Appeals notice of Public Hearing on the
application of Bernard S. O'Malley.
Motion: To recommend to the Board of Appeals that the variance for
Bernard S. O'Malley not be granted.
(Mahana-Hartmann, all in favor) VOTED
15) Board reviewed the Board of Appeals notice of public hearing on the
application of Peter Marciano.
Motion: To recommend to the Board of Appeals that the variance for
Peter Marciano not be granted becuase it derogates from the
intent of the Zoning By-law and detracts from the downtown
as the number of over -sized signs within the downtown area
is causing sign pollution.
(Mahana-Hartmann, all in favor) VOTED
16) Mrs. Jellinek noted that the Planning Board had mentioned the bonds
running out for Cabot, Cabot and Forbes and felt they would be
renewed in the name of W.R.C. properties, Inc.
17) Mrs. Tighe of the Mansfield News questioned who W.R.C. properties was.
