Board also reviewed their letter of September 23, 1977 requesting additional information on this plan. Planning Director Maurer noted that the Planning Board was requesting 7 parking spaces under section V -C -1-a of the Zoning By-law, however this is an office building with a residence and should come under Section V -C -1-e and only 5 parking spaces would be necessary. He noted that the location of the 7 parking spaces on the plan as shown it would be difficult to maneuver the cars. Motion: To recommend to the Building Inspector that the site plan application for Douglas Real Estate be approved for land on North Main Street with the condition that the parking be returned to the way it was originally submitted. (Mahana-Mangiaratti, all in favor) VOTED 6. Board reviewed the Form A Plan for Phillip Hatch for land on Central Street. Motion: To sign the form A Plan for Phillip Hatch for land on Central Street. (Mangiaratti - Motion withdrawn) Board discussed the plan in conjunction with the Subdivision Regulations Section A -1-d, which states thats<.the remaining land area and frontage of the land in the ownership of the applicant shall be shown in the case of the creation of a new lot. It was noted that there was conflict with the word "shown" as this plan had a notation of the amount of remaining land and frontage but was not graphically shown. Planning Mahana felt that perhaps an interpretation of the word "shown" should be received from Town Counsel. Planning Director Maurer felt that the Planning Board adopts the regulations and that it is up to them to interpret them. Planner Mahana felt that perhaps they should go through the subdivision regulations and Zoning By-law and change anything that could be ambiguous. Iti:was noted that the statement above the signature block read Planning Board Approval Not Required instead of Planning Board Approval Under the Subdivision Control Law not Required as in Section IIT -A -1-b of the Subdivision Regulations. Motion: To return the plan to have the wording corrected to "Planning Board Approval Under the Subdivision Control Regulations Not Required." (Mangiaratti-Hartmann Motion: To amend the motion to add to it that the boundary of the remaining land area be shown. (Tighe -Hartmann, all in favor) VOTED Motion: To approve the amended motion: (Tighe -Hartmann, Plourde, Mahana in favor; Mangiaratti opposed) VOTED Minutes September 28, 1977 Page 3 7. It was noted that the Zoning Classification was listed as Class A, which could indicate Residence A, Agriculture, or Business A. Motion: To return the Plan for Lloyd Keith for land on Central Street to have the zoning classification clarified. (Mangiaratti®Plourde, all in favor) VOTED 10. Motion: To return the plan for W.R.C. Properties, Inc. for land on Forbes Boulevard because the remaining area is not "shown" nor the frontage on West Street. (Plourde - ) Motion Lost for Want of a Second. Planning Director Maurer noted that the Planning Board has had a complete subdivision plan since 1970 for this area and all the information on each one of these lots is on record. Planner Tighe felt that the remaining land is shown to scale on the locus plan and the frontage is shown on West Street right up to the end of the road Motion: To approve the Form A Plan for W.R.C. Board discussed the primary areas in Mansfield for sand and gravel removal Planning Director Maurer presented a map of the soil limitations for the sources of sand and gravel within the Town of Mansfield. Board discussed the earth removal standards from various Towns within the commonwealth. Planning Director Maurer noted that the Town of Mansfield has more restrictions, such as restoration, then the other Towns. He noted that in some instances it stated that approval of a subdivision does not waiver the approval under the Zoning By-law for earth removal. Planning Director Maurer to prepare a draft on earth removal regulations. Minutes September 28, 1977 page 4 13. Board reviewed the Zoning Board of Appeals application of John M. Connor for a variance under Section V, Paragraph "H" of the Zoning By-law to erect a 4' x 6' sigh at 91 Chauncy Street. Said sign would be larger than allowed in a Residence "B" Zone. Planning Director Maurer noted that when the Zoning was first adopted in 1953 this was an Industrial Zone and without any town meeting actionrecorded it was changed and put on the map as a Business C. Then, in 1967 when the entire map was adopted it was shown as a Residence B. It was noted that if the Town Meeting adopted it as a Residence B and it was reviewed at a Public Hearing then they could have been aware of the change. Motion: To recommend to the Board of Appeals that the variance for John M. Connor not be granted as it would derogate from the purpose and intent of the Zoning By-law. (Tighe-Mahana, all in favor) VOTED 14. Board reviewed the Board of Appeals application of Michael DePalma for a variance under Section IV, Schedule "B" of the Zoning By-law to erect a dwelling at 4 Dane Street with a rear yard measurement of 15 feet. Said measurement would be non -conforming in a Residence "C" Zone. Planning Director Maurer noted that the Board of Appeals.had received a plan for this and that he would obtain it from them for the next Planning Board meeting. To be reviewed further at the next meeting. 15. Board reviewed the Board of Appeals application of Dominic Cimino for a Variance under Section III, Paragraph E of the Zoning By-law to sell used furniture from an existing garage at 566 East Street. Said use would be non -conforming in an Agirculture Zone. Motion: To recommend to the Board of Appeals that the variance for Dominic Cimino not be granted as it would derogate from the purpose and intent of the Zoning By-law. (Tighe-Mahana, all in favor) VOTED 16. Board reviewed the Board of Appeals application of Alexander Motyka for a Variance under Section Iv, Sehedule B of the Zoning By-law to divide a parcel of land to the rear of 87 central street which would leave an Existing building with 5 ft. side and rear yard measurements which are non -conforming in an Industrial Zone. It was noted that the buildings on the lot are existing and they are just dividing the lot. Motion: To recommend to the Board of Appeals that the variance for Alexander Motyka be granted. (Mahana-Plourde, all in favor) VOTED 17. Board reviewed the letter from Cabot, Cabot and Forbes regarding the acceptance of Forbes Boulevard, Suffolk Road and a portion of Plymouth Street. (Planner Hartmann left the meeting and did not participate in any discussion.) It was noted that on Forbes Boulevard there will be 8 possible cuts for water ( and sewerrafter the finished coat is put on.the roadway. Planner Mangiaratti suggested that theyadivse Cabot, Cabot and Forbes of their concern about tapping into the water and sewer after the road is completed. It was noted that once the road is accepted that beforeit can be opened up they would have to post a bond for the restoration of the roadway. Minutes September 29, 1977 Page 5 Planning Director Maurer noted his concern with paving the roadways after November 15th as cold wheather would be setting in. Motion: To write a letter to Cabot, Cabot and Forbes indicating that the Board is in favor of ther proposal but that they have concerns for patches on the road for utility cuts and would like to have them come back to the Board to indicate what they propose to do to minimize the cuts. (Mangiaratti-Tighe, all in favor) VOTED 18. Mrs. Jellinek came before the Board and noted that Mr. Dalton came in last week to discuss the street acceptances within the Industrial Park and that it is now owned by W.R.C. Properties, Inc. She questioned what W.R.C. stands for and noted that she has been to the State and there is no Inc. or Trust registered for W.R.C. It was noted that the Board was not aware of who the principal holders were for W.R.C. Properties, Inc. Mrs. Jellinek requested that they obtain this information before the next meeting if they are considering accepting the streets. 19. Next Planning Board meeting to be scheduled for October 6, 1977 at 7:30 P.M. 20.
