Motion: To approve the Form A Plan for Douglas King for land on Fruit St. (Tighe-Mahana, all in favor) VOTED Minutes March 9, 1977 Page 2 It was noted that the scele was not properly marked as to feet and that this is not a requirement of the Planning Board but one of the Registry of Deeds. 5. Board reviewed the notices of public hearings from the Town of Sharon and the City of Attleboro. It was noted in both instances it would have no affect on the Town of Mansfield. (Planning Director Maurer entered the meeting at this time.) 6. Board reviewed the letter from the Massachusetts Historical Society regarding the second funds available under the Public Works Employment Act. Planning Director Maurer noted that the project proposed by the Town of Mansfield is the East Mansfield Water Loop and that they have already received a letter from the Massachusetts Historical Society acknowledging the fact that they will not be interferring with any historical markers. 7. Chairman Parsons questioned the status of Route 495. It was noted that the trailers are out there today and they are going to be starting work on it. 8. Planner Mulcahy noted that he heard that the town cannot take the easements for the sewer interceptor in Norton by, eminent domain and questioned how this was going to be handled. Planning Director Maurer noted that there is an article in the Town Meeting for the purpose of acquiring the land, which will be purchased directly from the railroad company. He noted that they have talked to the railroad company and ` it now being surveyed and appraised. Planning Mulcahy questioned if there were any problems with Norton and Taunton. Planning Director Maurer noted that there was nothing that could not be ironed out and would just take time. Planner Lesuer questioned what state they had to be in by October. Planning Director Maurer noted that they just' have to have negotiations to acquire the outfall easements. 9. Mrs. Jellinek came before the Board and noted that they are having a petition going around to amend part of the Zoning By-lawto put the use variances into the zoning -by-law instead of having the Board of Appeals. She noted that the ketition is circulating and she anticipate s that there will be over 200 signatures, so it will come into a Special Town Meeting and that she hopes the Planning Board will look favorably on it as the Appeals Board has torn the Zoning By-law apart. It was noted that if this is advertised in the Mansfield News that the earliest possible date for a Public Hearing would be April 6th. Mrs. Jellinek requested that the Planning Board advertise this in the Sun Chronicle when it comes in. It was noted that this would be in the best financial interest of the Town. Motion: The Planning Director, when this petition is presented with the proper amount of signatures, be empowered to advertise in the Attleborough Sun for a Public Hearing on March 30, 1977 (Tighe -Mulcahy, all in favor) VOTED Minutes March 9, 1977 Page 3 10. Planners Mahana, Mulcahy and Hartmann were in agreement with this. 15. Planning Director Maurer noted that a few years ago the Town .got involved in a F1 ood Insurance Program and that there were regulations that the Town would have to adopt in order to maintain the Town'seligibility. He noted that this could be done through the Town By-law but would also require subdivision amendments. Planning Director Maurer noted that it is a Federal Program were you have to designate the flood plain areas in each community and once the government sites these areas the Town has to limit construction that will occur in 'these areas; then the insurance companies can write insurance for dwellings already in those areas. He noted thattwo years ago the Board of Selectmen held the public hearings for this. Planning Director Maurer noted that the Board of Selectmen received notices that unless the Town complies with certain requirements that they would cease to receive insurance. He noted that the Selectmen will be putting an article in the Special Town Meeting to amend the Town By-law and it Will also require 'a subdivision amendment regarding the 100 year flood elevation. He noted that there are 13 properties in Mansfield that have flood insurance. 16. It was the consensus of the Board to hold the next Planning Board Meeting on March 16, 1977 at 7:30 P.M. 17.
