(Mulcahy-Mahana, all in favor) VOTED 6. Board met with Harry McPherson to review the Form A Plan for land on Maple Street. It was noted that the configuration of the land on the locus plan was still not correct and that the Form A applications had not been returned Mr. McPherson took the plans back to have the configuration of the lot corrected on the locus plan. 7. Board met with Ralph Maloon to discuss the proposed layout for the reconstruction of We"st'Stre@trr. It was noted that all of the taking is on the east side of the street as it would involve less existing houses. The pavement is 24 feet and the right-of-way is 40 feet. It was noted that this is the minimum that the State will allow. It was noted that this road would be reconstructed under Chapter 90 funding. Planning Director Maurer noted that the planning Board has to review the cross section on this as it would be a standard for what all reconstruction will be. He felt that if they are requiring all streets entering into these streets to be 30 foot pavement and the major street is only 24 feet, that perhaps the subdivision regulations are too strict. He noted that this is only solving an immediate problem and is not taking into consideration a long range traffic problem on this road. He noted that the Board may want to consider a wider pamement than 24 feet. He noted that another consideration the Board should give is the drainage in the area. Minutes February 9, 1977 Page 3 It was noted that the Board of Selectmen will be holding a public hearing on the relocation of West Street on Wednesday, February 16, 1977. 8. Board met with Paul Dalton and Mike Murphy of Cabot, Cabot and Forbes. (Planner Hartmann left the meeting and did not participate in any discussion.) Board reviewed the Letter received from Cabot, Cabot and Forbes regarding the release of the bond for work in the Industrial Park after acceptance of a covenant for that section. It was noted that this section contains approximately200 acres and is located on the southwest side of Route 495, It was noted that this section was approved in 1975 and that no improvements have been made in that area. This land is being held for large industrial users. He noted that with the economic situation that they did not need this property yet, but would like to keep it approved as it may be needed in the future. It was noted that they are paying $5,000 a year to hold the bond and they would like to change this to a covenant. It was noted that they are requesting that lots 800 and 820 not be included in the covenant as they have frontage on an existing Street. Acting Chairman Tighe noted that he did not like to approve covenants that are not the standard form without the opinion from Town Counsel. Motion: To submit,, -the covenant from Cabot, Cabot and Forbes to Town Counsel for his review, alnng with any information necessary to expl.Ain the ommitance of lots 800 and 820 from the covenant (Mulcahy-Mahana, all in favor) VOTED 9. Board met with Paul Dalton and Mike Murphy of Cabot, Cabot and Forbes. (Planner Hartmann left the meeting and did not participate in any discussion.) Board reviewed the letter from the Board of Selectmen regarding the taking of Forbes Boulevard for Route 495. It was noted that the State is asking the Town to accept a portion of Forbes Boulevard within the Cabot, Cabot and Forbes Industrial Park. It was noted that the purpose of this appeared to be so that the state would be crossing a public way and not taking private property from an individual. Mr. Dalton noted that there would be other private property that they would be taking in the area and noted that they are in the process of talking to thet.State, to see if they will take the land all at once since they are taking land on both sides of the roadway. This would eliminate the need for a public hearing by the Town. Planning Director Maurer noted that the plan, as submitted by the State, is not acceptable under the Planning Board standards for street acceptance as there is no engineers stamp and other small items to be put on the plan. He noted that the bounds would also have to be set. It was noted that there would be a problem with the bond for the final pavement once this road was accepted by the Town. Question was also raised concerning the snow removal. It was noted that the Board of Selectmen would be holding the required public hearing on this on February 23, 1977. Motion: To send a letter to the State noting the Boards concern in the plan that was submitted as it does not conform the the Planning Board requirements for street acceptance, note the concern with the setting of the final bounds, the bond on the final pavement, and snow removal. (Mulcahy-Lesuer, all in favor) VOTED Minutes February 9, 1977 Page 4 10. Board reviewed the Zoning Board of Appeals notice of Public Hearing on the application of Karl Clemmey to reduce the frontage on West Street to 98.65 feet to allow for a 50 foot right of way to the rear of the property. Minutes February 9, 1977 Page 5 Planning Director Maurer noted that the:proposed roadway will also be creating a corner lot and that a front ,yard setback requirement will not be met on the pr©posed street and a variance will have to be required for this. Motion: To notify Mr. Clemmey that they will review both requests for variances at the same time. (Mulcahy - MOTION WITHDRAWN) Motion: To recommend to the Board of Appeals that the variance for Karl Clemmey be granted. (Mulcahy -Hartmann, all in favor) VOTED 17. Board reviewed the Zoning Board of Appeals application for H & R Block for a variance to erect a 2.5' x 4.5' sign on South Main Street in a Residence B Zone. Motion: To recommend to the Board of Appeals that the variance for H & R Block not be granted. (Mahana-Mulcahy-all in favor) VOTED 18. Board reviewed the letter from the Mansfield Housing Authority to the Planning Board regarding the Peter's Park Drainage Ditch. It was noted that the drainage by the Town into the Peter's Park subdivision was between the Town Manager and Engineer. Planning Director Maurer noted that when the first section of the drainage ditch was constructed it was for storm drainage from East Street. Planning Director Maurer felt that this is not a Planning Board problem but is betwen the Housing Authority and the Selectmen and the Town Manager. Motion: To advise the Housing Authority that the problem is a concern of the Town Manager and Town Engineer, however if the Housing Authority would like to meet with the Planning Board that they would be happy to do so. Make reference to the Housing Authorities letter of October 15, 1976, in which they note they are not satisfied with the construction of the ditch. (Hartmann -Plourde, all in favor) VOTED 19. Planner Mahana to attend as the Planning Board's representative. 20. Board reviewed the Form A Plan for Home Developers, Inc. for the filing of the Green Acres subdivision in land court. It was noted that the Planning Board had requested that the Green Acres subdivision lot numbers be shown on the plan and this had been done. It was noted that the bank had not signed the revised covenant for the release of the lots which have frontage on Maple Street. Motion: That when the covenant is resubmitted with the signature of the Mortgagees that the plan would be approved for Home Developers, Inc. (Mulcahy-Lesuer, all in favor) VOTED Minutes February 9, 1977 Page 6 21. Allen Willis came before the Board and presented a definitive subdivision plan for Strawberry Meadow located off Fruit Street. It was the consensus off.thbiBoard=to>review this plan at the next Planning Board meeting. 22. Motion: To hold the next Planning Board meeting on Wednesday, February 16, 1977 at 7:30 P.M. (Mahana-Hartmann, all in favor) VOTED 23. Planner Lesuer questioned the article submitted by the Conservation Commission. for scenic roads. Planning Director Maurer noted that the way the legislature is written the Planning Board has jurisdiction over scenic roads. 'Planning Director Maurer noted that this conflicts with the authority of the Board of Selectmen and felt that it should be discussed between the Planning Board, Board of Selectmen, and the Conservation Commission. It ,-was the consensus of the Board to have a meeting with the Conservation Commission to discuss this. 24. Planning Director Maurer suggested that the Public Hearing for Strawberry Meadow be held on March 9, 1977 since the Board is holding other public hearings on that evening. It was noted that this would be no problem as long as there was not alot of other items on the agenda. Motion: To schedule the Public Hearing for Strawberry Meadow, on March 9, 1977.
