(Tighe-Mahana, all in favor) VOTED 6. Board met with Karl Clemmey and his engineer, Dean Sly, who presented a proposed subdivision plan for landonWest Street. Mr. Clemmey noted that he is 2 feet short on the frontage on lot 1, which 'fronts on West Street and requested the Board to waive the frontage requirement by 2 feet. He noted that the first, 200 feet from West Street is in Residence A zone and that the next 800 feet is in Agricultural Zone and after that is Industrial zone, in which he now operates his salvage yard. He noted :that the State looked into this area for the proposed Route 140, however the State did not have any plans for the exact location. Planning Director Maurer advised that when a subdivision is proposed near. a.future state roadway that the plans are forwarded to the ;State for review. He noted that the Planning Board will need the run-off calculations for a < 25 year storm. Mr. Sly noted that the slope of the road is not over a 2% grade It was noted that the Board does not have the authority to waive the frontage requirement for Jot 1 on West Street. It was noted that the only way to rectify this would be to obtain a variance from the Board of Appeals or post securities to guarantee the, construction of the roadway prior to the, approval of the plan so that the house would then have frontage on the new street. "It was noted that the ;sewer manholes are placed 325 feet, apart and that the regulations only allow them to be '300 feet apart maximum. Board advised Mr. Clemmey that theywould review the plan in more detail after it has been officially submitted, as either a preliminary plan or a definitive plan. 7. Board met with Ralph Maloon and Charlie Boutas to dicuss'the definitive subdivision plan for Rustic Acres, along with the Planning Board's letter of January 13, 1977. The Board gave considerable discussion on the drainage out to the Canoe River. 'It was noted that the drainage will now run in an ;open ditch along the property - line of, Home Developers,Inc. and out the the Canoe River. In accordance with this, an easement is no longer needed across the property of.Bonvie. It was 'noted that they would be proposing to do some work on the swamp on Grant's property and that this Would also require permission of Mr. Grant. Chairman Parsons noted the Board's concern of the impact that all of the developments are having on the whole watershed area and that the Board wants to look at the total affect of development in East Mansfield. (Covenant was presented to the Board.) Minutes ` January 26, 1977 Page 3 ( 8. Board ..reviewed the Form A Plan for .Home Developers, 'Inc. for land on Maple Street. It was noted that the purpose of the Form A application was the record the entire Green Acres subdivision in land court. It was noted that they were requesting a release of the lots that have frontage j on Maple Street from the covenant filed with the subdivision plan ,as they are on an existing street. (lots 11-18.) It was noted that lots 11, 12 and 13, which were being requested to be " ' released from the covenant were not included n the Form 'A plan. It- was noted that the lot numbers on the Form A plan are the 'house numbers and not the 'lot numbers shown on the Green Acres subdivision plan.' Motion: To return"the Form A Plan to Home Developers, Inc. to change the lot numbers to correspond with the lot numbers on the subdivision plan and to include lots '11, 12 and 13 prior to their release from the covenant. (Tighe -Mulcahy, all in favor) VOTED (Mr.`Boutas took the plans back for correction.) 9. Board met with Jerry Williamson, who represents Nelson!'Doore, who has been trying to operate a?real estate office on Chauncy Street. Mr. Williamson noted that the difficulty is that he wants to hire persons and he cannot do this in 'accordance with Home Occupation. Mr. Williamson noted that he has not been able to obtain the required variance for this and questioned if the Board had any suggestions. Clerk Tighe noted that there is an item on the Agenda for business zoning; and that some of the members of the Board are of the opinion that business zoning is needed and that this location is in the general area, however it may not be included. Chairman Parsons noted that Mr. Doore has the right to go ;before Town Meeting to have the parcel rezoned. Planning Director Maurer noted that three years ago the Planning Board was petitioned for this and the required Public Hearing was held and that the petitioner did not appear at the Town Meeting so the item was dropped. It was noted that Mr. Doore+has been living on this property since 1972 and that he lives on the second floor and would operate his business on the first floor. Mr. Williamson noted that he would present this alternative to his client. (Planner Mahana left the meeting.) 10. Board reviewed the Planning 'Board articles for the 1977 Annual Town Meeting. Planning Director Maurer noted that there is going to be an article for engineering accounts for the various boards, such as Selectmen, Planning Board, and Board of Health and that the finance committee is recommending $1,000 for the Planning Board. x Motion: To notify the finance Committee that they are not submitting an article for Planning Board Engineering in the amount of $1,000 as it is the Planning Board's understanding that it will be submitted in the budget by the Finance Committee.
