6. At 8:00 P.M. the Planning Board held the required Public Hearing on Rustic
Acres Definitive Subdivision Plan. Transcript of that Hearing is on file.
(Planning Director Maurer entered the meeting at this time.)
7. Board met with Mr. Norman Gray, Sr. to discuss the earth removal application
for land on South Main Street. Engineer Ralph Maloon noted that they had
met with the Board of Appeals and received a copy of the Planning Director's
memorandum noting the discrepancies in the plan and withdrew their application.
He noted that before the application is refiled that they are going to have a
number of borings taken. The Board of Appeals can only issue a permit
for one year on the first 10 acre section and has given permission to do the
1 boring per acre on the first 10 acres and borings at random on the rest of
the property. Planning Director Maurer noted that the purpose of the test
borings is to make sure that the entire site is suitable for earthremoval.
Mr. Gray noted that he would not just take out the good material, he will
take out the impervious material as well as he intends to build houses here.
Clerk Tighe noted that the responsibility of the Planning Board is to make sure
the earth removal application complies to the Zoning By-law and that the
application has been withdrawn, so there is nothing to review.
8. Board discussed the Rustic Acres subdivision. Planner Plourde questioned if
there was anything that could be required so that they did not increase the
water on the property of Mrs. Jones. Planner Mulcahy noted that they can
develop the property as long as they don't channel the water on to property,
but if it naturally drains on to other property there is no recourse.

Planning Director Maurer noted that they should request the distance to the
river and the elevations out to the river. Planning Director Maurer suggested
that the Board forward the comments in his memorandum to the applicant along
with the Board of Health comments.
Motion: That a letter be sent to the applicant pointing out to him the items
to be submitted before the subdivision plan can be approved, as follows:
1) The existing elevation of the brook at the headwall
2) The existing elevation of the brook at the intersection.
3) The elevation at the swamp
4) The gradiant of the brook at those two elevations
5) The distance to the river and the elevations out to the river.
6) A note should be added in the lower right hand corner of all plans
that the subdivision has been designed in accordance with the
Rules and Regulations Governing the Subdivision of Land, Mansfield,
Mass. dated October 23, 1975, and including all amendments through
to August 6, 1976. For detailed construction specifications refer
to those Regulations (Section III -C -2-a.)
7) The surface water from this development is going to discharge on
to adjacent property. Permission has to be obtained from the
owners (Bonvie) that such discharge is satisfactory. (Section III -
C -2-n.) An alternative would be for the developer to investigate
the possibility to drain the development across his property to
the swamp that is on his property that ultimately flows to the
Canoe River. The drainage study for this project notes that the
drainage system will be picking up the storm run-off from the
development, as well as a portion of Ware Street and the Gloriad
Estates Subdivision approved by the Board in 1971.
8) Forward the letter from the Board of Health requesting that he
comply to those conditions.
9) Advise that the conservation Commission has noted that an application
should be made in accordance with Chapter 131 of the Massachusetts
General Laws. This will have to occur after the Planning Board
takes action.
10) Prepare the utility plan for fire alarm and electricity.
11) Advise the Board of the method you will insure the completion of
required improvements, either by bond or by covenant (Section III -
C -9.).
12) Review the possibility of the ditch being dug to the Canoe River.
Note that the Planning Board intends to walk the site and additional
cofimenttimay be forthcoming.

Clerk Tighe noted that he is not familiar with the Planning Board Engineering
account and that he should have checked into it more. Chairman Parsons notdd
that the money was appropriated to the Board before he became a member of the
Board and that it was used when Owens-Illinois was considering the retention
area and the Board hired a private engineer to review the drainage.
Planning Director Maurer noted that it had been used twice since lie had been
hired, once on Cabot, Cabot and Forbes and once on Owens-Illinois. Chairman
parsons noted that there is going to be an article in the up -coming Town
Meeting to establish $1,000 for engineering for the Planning Board. Planning
Director Maurer noted that the recording of accepted streets also came out
of this account.

Rustic Acres subdivision.
19. Planner Mulcahy noted that regarding the train situation in Mansfield, should
the Board take a stand on it. Planning Director Maurer noted that the student
from Bridgewater State College has finished his survey and that he has
misplaced the bulk of the survey. The Selectmen have a letter from Conrail
saying that they are going to curtail all service as of March 13, 1977.
20. Planning Director Maurer advised the Board that he went to a meeting in
Foxborough this evening regarding the sewer and that people in Foxborough
are .realizing: it is a good thing. They had a consultant present and a
schedule was presented to the Town as how Foxoborough could, at this stage,
catch up to Mansfield and tie into the system and do this without altering
Mansfield's schedule of being in service by 1981. Planning Director Maurer
noted that they discussed the formation of a district and he advised them,
as a representative from Mansfield, that they would not consider forming a
district at this time as it would slow them down, but would consider an
intermunicipal contract.
