5) Hobbit Hollows plan. Planning Director Maurer noted the Board voted
tentative approval on March 31, 1978 with the understanding that adjust-
ments would be made because of State takings in connection with relocated
Route 140 and the applicant was looking for a better bargaining position
with the State. He also stated a preliminary plans has no legal standing
and to endorse a preliminary plan would be contrary to Planning Board
practice. Planner Grant noted the Board should accept it as is as he
sees nothing wrong with it. Planner Mangiaratti suggested the Board send
a letter to Mr. Epstein telling him if he wants the plan signed he must
go through a hearing.
Motion: Send a letter to Mr. Epstein telling him he must have a hearing
to have the plan signed.

6) At 8:00 P. M. Mr. Frank Morgan from Henley-Lungren met with the Board to
get their feelings on a new earth removal proposal. The estimated quantity
would be 500,000 yards of material more or less from a forty acre site.
The operation would last for one year. Travel rights would not be
applicable. Hours of operation would be from 7:00 A. M. to 5:00 P. M. or
3:00 P. M. depending on the discretion of the Board. The engineering firm
will be Norwood Engineering Co. Log of soil borings would be one per acre.
Under operational standards the requirements he stated the reason for the
restrictions is to keep the trucks off the road. This pit would be adjacant
to the highway and if he was restricted in time it would extend the length
of the operation. Chairman Pro -tem Lesuer felt the Board couldn't discuss
that at this time. Planner Grant wanted to know if there would be any
home affected in the immediate neighborhood of the pit. Mr. Morgan said
no.
Under the Commercial standards, Mr. Morgan stated for the type of work
they are doing it would be impractical to be limited to five acres at a
time, also leaving the banks at a 450 angle at the end of each working day
would create a hardship. Under the monitoring wells section Mr. Morgan

stated initial borings indicate they can live with the six foot requirement.
Concerning the borings over a four month period he stated they would like
to be able to operate around April 1st of 1979. They might need a variance
for this.
Planning Director Maurer stated he has talked to Town Counsel concerning
inion
variances from items required under special permits. Mr. Mulchahy's °ermits

next few days for their information.
Under the provision of the By-law concerning elevation below the street
level or lowest elevation of the property, he stated the street is 500'
away but it is broken by the Rumford River. South Main St. is high and
the river would be a natural block. Mr. Morgan feels he would comply
with the By-law by using the river for the lowest point. Planner Hartmann

ember 29, 1978 at 7:30 P. M.

specifics in Zoning cases. He stated if someone comes in and complies
with the By-law in everything they are acting in the best interest of the
Town.
14) Planner Mangiaratti reminded the Board that the Downtown Advisory Committee
meeting on November 20, 1978 is to discuss the traffic flow and extended an
