(Mangiaratti-Lesuer, all in favor) VOTED Minutes November 1, 1978 Page 2 4) Motion: To approve the warrant of November 7, 1978 in the amount of $20.16. (Grant-Mangiaratti, all in favor) VOTED i 5) Board reviewed the draft report of the Community Attitude Survey. (Planner Matoian entered the meeting at this time.) Planning Director Maurer noted that this is only a draft and that a report will be prepared that will compare this years results with the results from the 1975 survey. 6) At 8:00 P.M. the Planning Board held the required Public Hearing on a petition of 111 citizens to rezone a portion of land located at the intersection of Chauncy Street, Central Street, Rpute 140 and Paine Road. A transcript of that hearing is on file. Chairman Parsons explained that this petition, in the form of an article, will be presented to the Special Town Meeting on November 13, 1978 and the petitioner will be required to present the article. He noted that the Planning Board will make a recommendation on the article and the only way it will be approved as a zoning change is by a 2/3 vote of the Town Meeting. 7) Board discussed the proposed zoning change from a residential zone to a general business zone on the land located on Chauncy Street. Planner Grant noted that either side of the property is a General Business zone. Planning Director Maurer noted that 4 years ago this same property was petitioned for rezoning and no one showed up for the hearing so the Planning Board did not give a favorable recommendation to the Town Meeting. Planner Mahana noted that they considered a larger area last year and they felt that they should maintain the integrity of the district so did not recommend approval and now they are going to nibble away at the land. He felt that unless the Board is prepared to rezone the whole area this rezoning would do an injustice. Motion: To recommend favorable Town Meeting action on this petition. (Grant-Mangiaratti, Matoian, Lesuer in favor, Mahana opposed) VOTED Planner Mahana felt that the Board was making a mistake as now there will be petitions all along the triangle. Planner Mangiaratti noted that the people in the immediate area of the rezoning are in favor of it. Planner Lesuer noted that the residential zoning of this property does create a hardship for the people if they want to sell their property and he would not be concerned with further rezoning in this area. Planner Matoian noted that this parcel, as it is zoned now, is singled out and he is in favor of keeping the area uniform. 8) Board reviewed the Form A Plan for Gilbert Olden for land on Otis Street. it was noted that the locus plan had been corrected to deliniate the property and that the description on the Form A application had been corrected. Motion: To approve the Form A Plan for Gilbert Olden for land on Otis Street. (Grant-Matoian, all in favor) VOTED (Planner Hartmann entered the meeting at this time.) Minutes November 1, 1978 Page 3 9) Board reviewed the memorandum prepared by the Planning Directo regarding the 1979-80 budget. It was noted that the proposed budget is a decreaseover the last budget year by $160, and this d6crease is due to a proposed cut in the advertising account. Chairman Parsons questioned why the phone account was recommended to remain the same and not decreased since there has been a substantial amount of work completed on the sewer project. Planner Mangiaratti noted that there will not be calls for the downtown project throughout the State. Planner Grant felt that there is really no property available for a project and that if they are calling the proposed Fairfield Project the downtown project this should come under the Housing Authority as it will contain Housing for the Elderly. Motion: To approve the proposed budget for 1979-80 as presented by the Planning Director in the total amount of $2,240. (Lesuer-Matoian, all in favor) VOTED 10) Board reviewed the Board of Appeals application of John J. Gula, Jr. for a Variance to add a room to his home at 240 Plain Street with a thirty (30) ft. rear yard measurement, which would be non -conforming in a Residence A zone. It was noted that the proposed addition would not be any more non -conforming than the existing dwelling. Motion: To recommend to the Board of Appeals that the variance for John J. Gula, Jr. be granted. (Grant -Hartmann, all in favor) VOTED 11) Board reviewed the Board of Appeals application of Raymond Collins for a Variance to divide a parcel of land located at 50 Jewell Street into two lots, one would be conforming and the other would have a frontage of 42.77 feet for the purpose to erect a single family dwelling, which is non -conforming in the Agricultural Zone. It was noted that the lot with 42.77 foot frontage would contain 122,355 sq. ft. in area. Motion: To recommend to the Board of Appeals that the variance for Raymond Collins be granted. (Grant -Hartmann, all in favor) VOTED 12) Board reviewed the Board of Appeals application of Winfred Spencer for a Variance to divide a parcel of land located oat245fAtwood eet on Atwood Street into two separate lots, each lot havingfrontage Street, which is non -conforming in a Residence A zone. Planning Director Maurer felt that if they do not have the required frontage they should increase the lot size as they have a total of of 7.7 acres remaining after dividing off the lot proposed to contain 15,100 sq. ft. Planner Mangiaratti noted that they just recommended approval on Jewell Street for the same situation, just a different shaped lot. Planning Director Maurer noted that there was a similar situation of Fox Street and those people were made to come in with a subdivision plan, even though they only wanted the twolots. Motion: To recommend to the Board of Appeals that the variance for Winfred Spencer not be granted. (Grant -Hartmann, Mahana, Matoian in favor, Lesuer, Mangiaratii Minutes November 1, 1978 Page 4 13) Board reviewed the Board of Appeals application of Guy Nardone for a variance to erect two signs at 666 East Street. One would be a free standing sign three by four and one a roof sign two by six. Said signs would be larger than allowed in an Agricultural Zone. (Planner Mangiaratti left the meeting and did not participate in any discussion.) Planner Mahana noted that the Texaco sign was denied reentlnextnext door. Planning Director Maurer noted that when the shopping plaza or was approved under the variance that they were hold how many square feet could be divided for the different signs and they were trying to exceed that amount. He noted that there is a problem in the area whereby the signs are blocking the view of the side streets. Planner Grant noted that the greenhouse is 30 to 40% of the size of property as the plaza and all he is asking for is 36 square feet and the plaza must have at least 100 square feet of signs on the building, and felt that this request was not out of context. Motion: To recommend to the Board of Appeals that the variance for Guy Nardone be granted with the restriction that the freestanding sign be high enough or setback enought so as not to obstruct traffic. (Grant -Hartmann, all in favor) VOTED 14) Board reviewed the Board of Appeals application of Joseph F. Mace for a Variance to convert an existing three family dwelling located at 39 Church Street into a two family dwelling with a doctor's office on the first floor. The doctor would not reside in the building which makes the use non -conforming in a Residnece "C" Zone. Planner Mangiaratti noted that the request for the variance was noted because of a financial hardship and in accordance with law the hardship has to be shown on the land. Clerk Lesuer felt that there was no exception shown and that there may be a problem with parking in the area. Planner Mangiaratti noted that part of planning is to try to direct certain activities into certain areas and this Board enlarged the downown and General Business Zones with the idea to direct business into those areas. Planner Grant noted that there is alread a Church, a doctors office and a lawn mower repair service directly within that area. Planning Director Maurer noted that the doctors offices would be permitted if the doctor was residing there. Motion: To recommend to the Board of Appeals that the varaince for Joseph F. Mace be granted. (Grant -Hartmann, Matoian in favor, Lesuer, Mangiaratti, Mahana and Parsons opposed) NOT VOTED 15) Mrs. Jellinek came before the Board and questione d the Chairman concerning the new secretary and suggested that perhaps he would like to check with Town Counsel to see if there is a conflict because she presently works for the Board of Appeals. Judy Scott npted that she has resigned from the Board of Appeals. Planning Director Maurer noted that she may be required to assist the Board of Appeals during the next set of hearings. Minutes November 1, 1978 Page 5 16) Chairman Parsons questioned if the memorandum on Wetland Zoning had been sent out to the Board of Health and Conservation Commission as well as the applicants to the Wetland Advisory Committee. Planning Director Maurer noted that a date was not set for this meeting so the memorandum was not forwarded yet. Chairman Parsons noted that there was an indication in the minutes that the Board may be stepping on other toes and felt that this project required a cooperative effort between the Board and hoped that the Board would not be involved in areas that did not concern them. ld the ext 17) it ws the consensus Wednesday,of the N Novemberd to r 1978oat 7:30nPlanning Board P.M 18) Planning Director Maurer advised that next Wednesday at 8:00 the Selectmen will be holding a Public Hearing on the Street Acceptance articles and perhaps the Board would like to send a representative to this meeting. 19) Planning Director Maurer noted that the Downtown Advisory Committee is working on the Fairfield Project where they are coming up with a developers proposal for the site, which will be presented to the 1979 Annual Town Meeting. He noted that going along with the preparation of this article they have contacted developers to get input as to how the proposal should be prepared, as well as the Massachusetts Housing Fiannace Agency and the Department of Housing and Urban Development. He noted that on Monday, November 20, 1978 there will be a public hering on the downtown traffic and the subjects to be discussed are the recommen-ations made in previous studies. He noted that they hope to get a good response from the hearing. 20) Meeting a .o ned at 9:20 P.M. I
